COUNTER-AFFIDAVIT

I, CARLOS T. MAKASILANG, 30 years old, married, Filipino, and a resident of

Alaska Mambaling, Cebu City, Philippines. After having been sworn to in
accordance with the law hereby depose and state that;

1. I am CARLOS T. MAKASILANG accused in the Criminal Case No. 10323

for the crime violation of the R.A No. 9262 otherwise known as Anti-
Violence Against Women and Their Children act of 2004.

2. I categorically deny the accusation leveled against me, the truth is on October
2, 2022, around 9:oo P.M., when my friend Marlou sent me home drunk, my
wife nags me for having no money left on my salary. I disregard her nagging
and went to sleep immediately.

3. Such fabricated allegation has no basis in fact and in law, but merely designed
to weave a story to further implicate me.

4. I am executing this Counter-affidavit to attest to the truth that I did not commit
the crime R.A 9262 otherwise known as Anti-Violence Against Women and
Their Children act of 2004 in whatever form as erroneously and maliciously
alleged by the complainant.

1. That I am testifying as a private complaining witness in the above-entitled

case.

2. That this Judicial affidavit is taken upon examination of ATTY. RENALYN

A. CUEVAS at his law office at CUEVAS and ASSOCIATE LAW OFFICE,
Fourth Floor, GV Tower Building, Sanciangko St., Cebu City, Cebu,
Philippines, where my statements were taken;

3. That I am answering the questions asked of me, fully conscious that I am

doing this under oath and that I may face criminal liability for false testimony
or perjury if I state a falsehood in my testimony. The whole process has been
done in Visayan language is understood by me, and translated into English
and explained to me;

A3 : That time I was at my friend’s house drinking.

A5: Afterwards, my friend named Marlou Isabelo drive me home for the
reason that I could be able to go home with my current state at those times.

A7: I saw my wife at the living room with our neighbor named Marites.

T8 : Gatan aw sila og Netflix.
Q8: As you enter inside your house, what did they do?
A8: They were watching Netflix.

P9 : Unsay sunod nahitabo?

T9 : Iya kong ge yawyawan asa daw akong sweldo og nganong nauli ko nga dugay
og nganong hubog.
Q9: What happened next?
A9: She nagged at me saying that where was my salary goes, and why did I
come home late and drunk.

A10: I disregard her nagging towards and continue to walked towards our
bedroom to sleep and shouted that we will continue their argument tomorrow.

A11: I don’t know, because I was just sleeping and they enter inside our room.

A12 : I observed that my wife had many bruises and I wonder what
happened.

A5 : I drove him home for the reason that he can’t be able to commute all by
himself.

iyahang asawa kabahin sa iyahang sweldo og nganong nauli siya nga hubog og

A6: After arriving in Carlo’s home, his wife nagged him about his salary and
why he came home drunk and there was also another person which is a woman
present in the house.

A9: Carlos enter his bedroom and I walked towards their window which was
closed and I hear that the wife and her neighbor had a plan to sabotage my
friend and I immediately turn on my cellphone and record what they have
planned.

MAKASILANG did not commit the crime of R.A 9262 otherwise known as
the Anti-Violence Against Women and Their Children act of 2004 (VAWC).

A5 : No, we are not close I just know him.

T6 : Pag-agi nako sa ilang balay abli ang pultahan og nakita nako nga ang usa sa
among silingan gesagpa siya og gekulata-kulata ang asawa sa akusado.
Q6: As you walked through their house, what did you saw?
A6: As I walked through the victim and accused house, I saw that their door
was open and I also saw one of my neighbor Marites, slapped and punched
the wife of the accused.

P7: Wala ba ka nahibong nga nganong nahitabo to imong nakita?

T7: Nahibong ko, pero naa sa akong hunahuna ga away siguro sa utang.

Q7: Did you not wonder why did it happened?

A7: I also wonder, but in my mind I think they argue because of debt.

T8: Dali-dali kog dagan sa amoa para ingnon nako akong papa para maka tabang og
uwang sa duha nga ga away, pero naabtan nako sa akong papa kay naa nay mga

A8: I ran immediately to our house and told my father what happened and ask
him for help however when we arrived we witnessed Baranggay Tanods
inside their house.

from the Sari-Sari store near the complainant’s house.

2. That as I walked through the house of the victim and accused I witnessed that
my neighbor Marites slapped and punched the victim of this case.

3. That, after witnessing the scene I ran immediately to our house and told my
father about what happened.

4. That after more or less than 10 minutes of running towards our house and
going back to the victim’s and accused house, I saw Barangay Tanods entered
