3. QUESTION: I would like to inform you that you have the right to have a counsel or

ANSWER: Yes Sir. Actually he is with me now, Bro. LOUIE (LUISITO NARCISO A.
ORDOÑA), whom I gave Special Power of Attorney (SPA) to be my
Attorney-In-Fact and legal counsel in this investigation. (See Annex
___)

4. QUESTION: Can you please state your name and other personal circumstances?
ANSWER: I am Genna P. Desic, Filipino Citizen, 39 years old, female, a solo
parent with two (2) children, and presently residing at Abella Road,
Bgy. Kaypian, City of San Jose Del Monte, Bulacan.

5. QUESTION: What prompted your presence in this office?

ANSWER: I came here to file my formal complaint against (1) MARIA IWA
MOTO, (2) AILEEN RECLA, (3) BENJAMIN RODRIGUEZ, (4) SAMUEL
REIZA, and (5) RAMON CASAJES, JR., for their illegal acts of
HARRASSMENT, TRESPASSING, GRAVE THREAT, MALICIOUS
MISCHIEF, ORAL DEFAMATION and UNJUST VEXATION.

6. QUESTION: How did the Incident Happen? Can you please narrate?
ANSWER: On December 01, 2022, around 3:30 p.m., the group of above-named
persons, together with their hired workers who were unknown to me
at that time, came to my residence along Abella Road, Bgy. Kaypian,
CSJDM, Bulacan and claimed that they are the legal owners of the
property where my residential house which I constructed in 2019 is
erected. They threatened to demolish my house and likewise
threatened me that they will request MERALCO to cut the supply of

 electric line to my house. Then, AILEEN RECLA, (who claimed being a
retired Colonel with a bodyguard by her side who is armed with a
gun), instructed their hired workers to start clearing the area. They
cut not only the grasses but also the banana trees and other fruit
bearing trees which I planted inside my property. They also destroyed
and demolished the structure which I am constructing for my sari-sari
store. Then, they brought a nipa-bamboo rest house and placed it
inside my property. They likewise, erected a tent and started to dig a
hole, which according to them will be used by them as septic tank for
their plan to construct a toilet.

7. QUESTION: What happened next?

ANSWER: I reported the incident to our Barangay, and on December 8, 2022, at
around 9a.m. we had a dialogue/ clarificatory hearing at our
Barangay Hall, presided by our Barangay Chairman, ZOSIMO B.
LORENZO and two (2) of his Kagawad. (See Annex ____). However,
the said dialogue ended into a failed conciliation, so I requested for a
Certificate to File Action (CFA), which was granted to me on
December 12, 2022. (See Annex ____). Thus I decided to come here
today to our City Police Station to formally file my complaint, because
I believe that I am a legitimate resident in that particular lot area and
I have the legal rights over the subject land in dispute.

9. QUESTION: Do you have any proof in all your statements?

ANSWER: Yes Sir.
