JESUS LEVY T. DACERA

I, JESUS LEVY TURNO y DACERA, of legal age, Filipino, Single with

postal address in Upper Casili, Sto.Niño 1, Purok Tulip Consolacion Cebu, after
having been dulys sworn to in accordance with law, fully conscious that I am
answering the following questions under oath, and that I may face criminal liability
for false testimony or perjury and said judicial affidavit.

PRELIMINARY STATEMENT

This was conducted at the Law Office of Atty. Argie Dionio, Located at
Saac II Lapu-Lapu City Cebu, which taking was done in English which I clearly
speak and understand and what the other information or requirements of Sec. 3,
A.M. 12-8-8-SC as explained to me by the administering officer, hereby deposes
and states as follows:

PURPOSE

This affidavit of the accused, JESUS LEVY TURNO y DACERA is being

offered to prove the existence of doubt on the charge of rape against the accused
and deny all allegations against him.

1. Q: Please state your name, age, address and other personal

circumstances for the record.
A: I am Jesus Levy T. Dacera, 25 years old, single, a Criminology Student,
and I currently reside in Upper Casili, Sto.Niño 1, Purok Tulip Consolacion
Cebu.

2. Q: How are you related to the plaintiff in this case?

A: She was my acquaintances Sir.

3. Q: Do you know Miss Codillo?

A: Yes, Sir

4. Q: What relation do you have with Miss Codillo?

A: We were acquaintances Sir.

5. Q: How did you meet Miss Codillo?

A: We met though our common friends Sir.

6. Q: Where were you on March 21, 2021?

A: We were at the Blue Reef Resort in Lapu-Lapu City, Cebu. Sir, we were
celebrati0ng our Graduation Party.

7. Q: What were you doing in that Graduation Party?

A: We were eating and drinking Sir.

8. Q: Where you drunk during that party?

A: Yes, Sir

9. Q: What time did you leave the party?

A: At around 12:00 am Sir.
10.Q: How did you leave the party?
A: I offered Miss Codillo to take in my car because I wanted her to take
home because she is drunk at that time Sir.

11. Q: What happen then?

A: I put her in the back seat so that she can rest well, Sir.

12. Q: Was there anyone else with you on the car?

A: No, Sir.

13.Q: After that what happen next?

A: I find a Motel because I am also tired and drunk at that time, Sir.

14.Q: Where is the location of the Motel did you brought Miss Codillo?
A: Andy Hotel around 12:30 am, 727 A.S Fortuna St, Mandaue City, Cebu.

15. Q: After you arrived at the motel what did you do?
A: I booked 2 rooms and Alexandra Damayo the room attendant assisted me
and we immediately help Miss Codillo to enter the room 14 that I booked
Sir, because she is vomiting.

16.Q: After she vomit what did you do?

A: After she vomit around 12:41 am, I went back to my room which is room
15, so that I can rest sir.

17.Q: Did you check Miss Codillo time to time?

A: Yes, Sir. I went back to room 14 at around 01:00 am because I ordered
noodles sir, so that she would sober up.

18.Q: What happened next?

A: I entered her room shes at the Comfort room at that time sir, I put her in
the bed and suddenly she grabbed my hand says
“Will you not stay with me?” after that I stay in her room and I went to the
Comfort room to urinate and Miss Codillo follow me and suddenly she kiss
me Miss Codillo grabbed my belt and she unzipped my zipper she did a
blowjob.
19.Q: After that what happened?
A: Alexandra Damayo knocked the door at around 1:05 am to bring extra
towel and bed sheet then I push Miss Codillio to stop and I checked who is
knocking the door.

20.Q: Did Alexandra Damayo entered the room?

A: Yes, Sir, changing the bed sheet.

21. Q: What happen next?

A: I went back to the room and help Miss Codillo to lay down into bed and
me and Miss Alexandra Damayo Exit the room. And I go back to my room
at around 01:10 am so that I can rest well sir.

22.Q: What time did you check-in and check-out at the motel?
A: we check-in around 12:30 am and we check-out at exactly 02:30 am

23.Q: Around 02:30 am what did you do?

A: I went outside to buy some foods and to get some clothes to my car and
after that I want also too take her to her home safely.

24.Did you bring any weapon?

A: I have a pocket knife attached to my car keys, for self-defense Sir.

25. Q: Did you threat Miss Codillo that if you didn’t sex with her you will
kill her?
A: No, Sir.

26.Q: Did you pointed a knife to Miss Codillo?

A: No, Sir
27. Q: Did you force Miss Codillo to blowjob you?
A: No, Sir.

28. Q: Did you dragged Miss Codillo back to the bed and force to lie down
and spread her legs?
A: No, Sir.

29. Q: In connection to this case do you remember having executed a

sworn statement?
 A: Yes, Sir

Motion: May I request this Honorable court to mark this sworn statement as
Exhibit 1

30.Q: In connection to this case do you remember having executed a

judicial affidavit?
A: Yes, Sir.
