NOUIE SOCO

I, NOUIE R SOCO, of legal age, single and a resident of 888 Onyx Street,VML Subd., North
Fundidor, Molo, Iloilo City, state under oath as follows:

PRELIMINARY STATEMENT
The person examining me is Atty. Hayacenth Rodriguez with address at ________. The
examination being held at the same address. I am answering her questions fully conscious that I
do so under oath and may face criminal liability for false testimony and perjury.

This affidavit/testimony of is offered as a counter-affidavit of the accused Nouie R. Soco in the

abovementioned criminal case filed by plaintiff.

Questions (designated by “Q”) by Atty. Hayacenth Rodriguez.

Answers (designated by “A”) by Nouie Soco.

Q.1: Will you state your name and other personal circumstances?
A: I am NOUIE R SOCO, of legal age, single, and a resident of 888 Onyx Street,VML
Subd., North Fundidor, Molo, Iloilo City.

Q.2: Do you know why you are here?

A: Yes, ma’am I am here because I’m accused of killing Ms. Eve B Cedullo my ex-
girlfriend.

Q.3: Do you know the offended party or the victim in this case?
A: Yes, ma’am.

Q.4: How do you know her?

A: She is my ex-girlfriend.

Q.5: Did you invite Ms Eve B Cedullo to attend the birthday party? How come she was in
your house?
A: Yes, ma’am. I invited her to attend said birthday party I give her an invitation letter.
However, she didn’t know that there will be a surprise engagement.

Q.6: Now, can you tell me what happened that led to the death of Ms. Eve B Cedullo?
A: During said celebration, I wanted to make good with my ex-girlfriend (Eve B
Cedullo) and share to her my engagement. Upon her knowledge of my
engagement, she reacted differently and she is seemed to be disturb to the fact
 that I am engaged already to another woman. An argument transpired between
us. She told me that she expected that inviting her to the birthday party is a
gesture that I wanted her back, that both will give a second chance to our
relationship.

Q.7: What happened after or what are your responses with her reactions?
A: As I tried to hold her and make her understand that things have changed, that I
am in love with another, she slapped me. She said to me that she still loves me,
and she waited for almost 7 years and she didn’t even have any relationship with
another. Angrily as she is crying, she told me in a fierce voice that she will not
allow this to happen, that I will be engaged to another woman. She ran outside
my room and after a few minutes she returned with a gun

Q.8: When she ran outside your room, did you not follow her or do you have an
idea of where did she go?
A: No, ma’am, I did not follow her. I am surprised and afraid when she came
back, she pointed a gun to me as tears falling in her eyes and uttering, indi gd ini
pwidi nga matabo nga makadto ikaw sa iban, kay asta xbng, palangga ko
gihapon ikaw. Pwes, indi ka man lang magin akon, indi ko man ikaw ipaghatag
sa iban, then Eve pulls the trigger but it did not fire, she pulls it again but fails
again. There I had the opportunity to grab the gun beneath my bed and Shoot
her because I feared that on the third time she pulls the gun it will fire up and kill
me.

Q.9: What happened after you shoot her with your gun?
A: After I shoot her, I immediately call and reported the incident to the Police and
surrender to them my person as they will conduct their forensics and
investigation.

A: None, ma’am.

being duly sworn depose and say:

1. I was the one who conducted the examination of accused NOUIE R SOCO at
my aforementioned office in the same aforementioned address;

2. I have faithfully recorded or caused to be recorded the questions asked and the
corresponding answer that the witness gave; and

3. I, nor any other person then present or assisting him coached the witness
regarding his answers.
