JUDICIAL AFFIDAVIT

I, CHEEZ MUSA, of legal age, married, Filipino


and a resident of a resident of 12 Estrada St.,
Sunhills Subdivision, Cebu City, Philippines after
having been duly sworn in accordance with law, do
hereby depose and state:

1. Q: Do you know the complainant in this case?


A: Yes.

2. Q: How did you know her?


A: I knew the complainant because I sell her
jewelries on a commission basis for almost
five years (5) now.

3. Q: Do you know the accused in this case?


A: Yes.

4. Q: How did you know her?


A: She was my college classmate and I was the
one who introduced her to the complainant.

5. Q: Why did you introduced her to the complainant?


A: Because she also wanted to sell jewelries

under a commission basis after learning that
I was into such business and I am earning
good enough from it.

6. Q: What happened after you introduced her to the


complainant?

A: The complainant agreed to her proposal and


they agreed that she shall remit the proceeds
of the sale, and/or, if unsold, to return the
items to the complainant, within a period of
60 days but the over price shall be kept as
her commission, which is the usual terms and
conditions the complainant is having with her
other resellers.

7. Q: What happened next?


A: The complainant turned over to her the
following items: (1) An 18k diamond ring for
men; (2) a woman’s bracelet; and (3) one men’s
necklace, with an aggregate value of
P100,000.00 on October 31, 2017.

8. Q: How did you know about the turn-over?


A: The accused talked to me about it and I was
also there in the house of the complainant at
the time the turn-over was made because I was
also about to get my items.

9. Q: What happened next?


A: After that I have not hear anything from the
accused or seen her. I just recently learned
through her facebook account that she fled to
abroad one month ago after the items were
turned over to her.
