1. What is arbitration?

 Arbitration is a voluntary dispute resolution process i which one or more arbitrators, appointed
in accordance with the agreement of the parties or rules promulgated pursuant to the ADR act,
resolve a dispute by rendering an award.

In Arbitration, the ARBITRATOR is the one that decides the dispute and renders an arbitral award to
conclude the proceeding.

13. Arbitration is International if ANY OF THE FOLLOWING INSTANCES OCCUR:


A. The parties' PLACES of business, WHICH AT THE TIME OF THE CONLCUSION OF THE ARBITRAION
AGREEMENT, is in DIFFERENT STATES.
B. The PLACE of ARBITRATION provided in the arbitration agreement and in which the parties have
their places of business is OUTSIDE the Philippines.
C. The place where a substantial part of the obligation is to be performed or the place with which the
subject matter of the dispute is most closely connected, and in which the parties have their places of
business, is OUTSIDE OF THE PHILIPPINES; or
D. The parties have expressly agreed that the subject matter of the arbitration agreement relates to
more than one country.
