Cause comes on for hearing on Defendants’ Motion to Dismiss. The Plaintiffs,
ILLINOIS BAPTIST STATE ASSOCIATION, an Illinois not-for-profit corporation,
SOUTHLAND SMILES, LTD, an Illinois corporation, DR. RICHARD MANTOAN
ROCK RIVER CARTAGE, INC., and CURT HOUSE, appears by and through their
attorneys, Randall A. Mead of Drake, Narup & Mead, P.C,, and J, Matthew Belz of,
Ottsen, Leggat & Belz. The Defendants, ILLINOIS DEPARTMENT OF INSURANCE
and ROBERT MURIEL, in his official and individual capacities, appears by and through
their attorneys, Sarah Gallo and Elizabeth Morris, Assistant Attorney Generals for
Kwame Raoul, Attorney General of Illinois. The Court took the matter under
advisement and after having considered the arguments, evidence, case law and all
relevant statutory factors presented by the parties makes the following findings:
1. The Plaintiffs have not specifically alleged a legally and factually sufficient
cause of action.
2. The Plaintifis' complaint fails to establish that the Reproductive Health Act
provision substantially burdens their religious beliefs as required under the
Ilinois Religious Freedom Restoration Act. See 775 ILCS 35/15.NOW, THEREFORE IT IS HEREBY ORDERED:
1. The Defendant's Motion to Dismiss pursuant to Section 2-615 (a) of the Illinois
Code of Civil Procedure is GRANTED.
2. The Plaintiffs are allowed 28 days leave of court to file an amended complaint.
