Dear Ms. Averia,

We write on behalf of our company, WIZARD MANPOWER & ALLIED


SERVICES, INC., in connection with this Honorable Office’s Notice dated
February 2, 2021 and received by our office on March 24, 2021 directing us to
submit a settlement proposal, if any, for the following persons:

1. Raymon Santos
2. Nerio Mark Morante
3. Lover Lucky Luza
4. Macnan Pagcaliwagan
5. Alfredo Aranas Jr.
6. Dexter John Atun
7. Sonny Boy Palabon
8. Renne Masing
9. Oliver Domingo
10. Marwin Estoque
11. Roel Francisco Jr.

All of the above-named persons are assigned at Wilcon - Montalban


Dispatching Unit and have asked the assistance of this Honorable Office for
the collection of their Holiday Pay, Service Incentive Leave and 13 th Month
Pay. They also demand regularization. Furthermore, they claim that they have
been illegally dismissed.

First, we would like to inform this Honorable Office that our company is
more than willing to settle this matter immediately.

Second, based on the company records, only Mr. Lover Lucky Luza
and Sonny Boy Palabon has existing claims.

For Mr. Lover Lucky Luza, the payment due is in the amount of Six
Thousand Two Hundred Thirty-Five Pesos and Thirty-Five Centavos
(Php6,235.35) representing his 13th Month Pay and Service Incentive Leave
Pay for 2019-2020.

For Mr. Sonny Boy Palabon, the payment due is in the amount of Five
Thousand Seven Hundred Seventy-Five Pesos and Forty-Five Centavos
(Php5,775.45) representing his 13th Month Pay.

Lastly, contrary to their claims, there was no illegal dismissal that was
allegedly committed against them since after the company they were
previously assigned was greatly affected by the Covid19 Pandemic forcing the
company to place them in a new work assignment through a Transfer of
Assignment/Temporary Lay-Off Letter dated October 20201. Our company is
in the process of finding a new work assignment for all of them.

In view of the foregoing, may we respectfully request this Honorable


Office to consider all the matters we raised in this letter and the attached
supporting documents. Unfortunately, our company cannot offer any other
proposal but to pay their remaining 13th Month Pay and Service Incentive
Leave Pay of Mr. Luza and Mr. Palabon.

We sincerely hope that we have sufficiently explained our company’s


side and that you understand our position.
