WHEREAS, the VENDORS have offered to sell and the VENDEE has agreed to
buy the above-described property, for the consideration and the terms and conditions
set forth herein below:
NOW, THEREFORE, for and in consideration of the aforesaid premises and
more specifically of the sum of THREE HUNDRED FIFTY THOUSAND PESOS
(Php350,000.00), Philippine Currency, the receipt whereof is hereby acknowledged in
full from the VENDEE to the entire satisfaction of the VENDORS, the said VENDORS do
hereby SELL, TRANSFER, CONVEY and DELIVER, in a manner absolute and irrevocable,
in favor of the VENDEE, their heirs, assigns and successors in interest the property
above described;
That the VENDORS hereby warrant valid title to and peaceful possession of the
property herein sold and conveyed and further declares that the same is free and clear
of all liens and encumbrances of any kind whatsoever. They further warrant that the
property is not occupied by any third persons, tenants or any other person who may
hold a title or right of possession, actual or implied on the property;
That the VENDORS further warrant that the property and shall be in the exact
conditions as these have been inspected by the VENDEE immediately before the
execution of this Deed of Absolute Sale;
That the VENDORS shall bear the expenses entailed in causing the transfer of
the title from the name of the Vendors to the name of the Vendee herein, including but
not limited to, Capital Gains Tax, Documentary Stamps, Transfer Fees for the
Treasurer’s Office of Davao del Norte, Transfer fees for the Register of Deeds, Notarial
and other legal fees;
