I, SHUBHANGI DASHRATH HINDLEKAR adult, Indian Inhabitant, aged about


56 years, residing at 280/C, Saibaba Welfare Society, Registration No.F-46880,
Moru Compound, Maheshwar Nagar, Nr. Popat Compound, Appa Pada, Kurar
Village, Malad East, Mumbai 400 097, do hereby state on solemn affirmation as
under:-

I say that I am the lawful wedded wife of deceased DASHRATH PANDURANG


HINDLEKAR and my husband is expired on 17/02/2013.

I say that I am the lawful wedded wife of my said deceased husband and I
am residing at above mentioned address.

I say that my said deceased husband was a owner and member in respect of
the above mentioned room.

I say that after expiry of my said deceased husband, I became the lawful
owne of the said room.

I say that I have got AADHAAR Card, Pan Card, Election Identity Card,
Ration Card, Electricity bills and above mentioned documents are in my own
name in respect of the above mentioned room.

I say that I am entitled to transfer the membership of the Saibaba Welfare


Society in my name in respect of the above mentioned room.
I say that I am making this affidavit to produce the same before the Chawl
committee, for transferring the membership of the Saibaba Welfare Society in my
name in respect of the above mentioned room.

The contains herein above has been read over and explained to me in my

We say that the Deponent No.1 is a lawful wedded wife of the said
deceased. The Deponent No.2 is a lawful daughter of the said deceased.
The Deponent No.3 is a lawful son of the said deceased.

We say that there is also another legal heirs and representatives of


the said deceased namely SURESH SUMANBHAI GAJJAR aged about 44
years.

We say that except ourselves there is no other legal heirs of the said
deceased.

We say that the said deceased SUMANBHAI GAJJAR was a lawful


tenant in respect of Block No.2, First floor, Shailesh Niwas, Subhash Lane,
Off. Daftary Road, Malad (E), Mumbai 400 097.

We say that after the expiry of the said original tenant, we became
joint lawful tenants in respect of the said tenanted premises.

We say that we have surrendered and relinguished our all right, title,
interest, whatsoever nature including the tenancy right in respect of the
above mentioned block in favour of SURESH SUMANBHAI GAJJAR who
is residing in the tenanted premises.

We say that we have handed over the exclusive possession of the


said block and/or tenanted premises in favour of Suresh S. Gajjar on
the day of execution of this declaration.

We say that ourselves and anybody claiming through us will not


claim any right title interest, whatsoever nature in respect of the said
tenanted premises.

We say that we have no objection if the landlord transfer the rent


receipt in the name of SURESH SUMANBHAI GAJJAR we have no
objection to that effect and we have given our free consent to that effect .
We say that the SURESH SUMANBHAI GAJJAR will be the lawful
tenant in respect of the said block and/or tenanted premises.

We are making this affidavit to produce the same before the relevant
authorities.

We say that we have surrendered and relinguished our all right,


title, interest, whatsoever nature including the tenancy right in respect of
the above mentioned block in favour of SURESH SUMANBHAI GAJJAR
who is residing in the tenanted premises.

We say that if the landlord transfer the rent receipt in respect of


the above mentioned block premises in the name of Suresh Sumanbhai
Gajjar, we have no objection for the same.

We say that if the landlord transfer the rent receipt in respect of


the above mentioned tenanted premises and due to the same any third
party claims any right, title, interest in respect of the said tenanted
premises, we will solve the said claim at our own costs and the landlord
will not be responsible for the same.

We say that if the landlord transfer the rent receipt in respect of


the above mentioned tenanted premises in the name of Suresh S. Gajjar,
and due to the same the landlord sustained any loss, injury we will
satisfy the same at our own costs, and the landlord will not be
responsible for the same.

We say that we are making this indemnity to produce the same


before the landlord for transferring the rent receipt in the name of
Suresh S. Gajjar, who is one of the legal heirs of the said deceased.

lawful tenant in respect of Block No.2, First floor, Shailesh Niwas,

AND WHEREAS after the expiry of the said original tenant, we


became joint lawful tenants in respect of the said tenanted premises.

AND WHEREAS we have surrendered and relinguished our all


right, title, interest, whatsoever nature including the tenancy right in
respect of the above mentioned block in favour of SURESH SUMANBHAI
GAJJAR.

AND WHEREAS I am desirous of appointing fit and proper


person to look after and manage the affairs of the said Room. AND
WHEREAS I do hereby appoint, nominate SURESH SUMANBHAI
GAJJAR as our true and lawful attorney to do the following acts, deeds,
matters and things i.e. to say:-

1. To give evidence on our behalf, and to make an application in


the court, to file a case in small causes court, High Court, and any
other court against landlord and to deposit money and to withdraw us
money from the court.

2. For us and in our name on behalf of us to accept a service of


any letters, writ of summons, notices or other legal process and to
appear and to act and to represent us in all the courts of law and
before all Magistrate and Quasi Judicial or Judges, or other Public
Officers or any officers as us said attorney shall consider advisable and
proper and for us and in our name on behalf to commence any action
and/or other proceedings in any court of law in respect of the said
block.

3. To file written statement on behalf or to make an application on


behalf, in any court, to file a case in any court and to appoint Advocate
and Advocates on our behalf, and to file defenses to pay the money in
the court, and also to withdraw the money from the court, to give the
witnesses with on behalf of our name in any court.

4. To make an application for adjournment and to file defense in


the respect. Our said attorney shall consider advisable and proper
concerning and for that purpose to appoint umpire or arbitrator and to
take action to declare all transactions of transfer of our block null and
void and recover back and the possession from the person who took
possession of our block under such illegal and void transactions.

5. To give the evidence in the court, to make an application in the


court, to file a suit in respect of the above mentioned premises, to
deposit the amount in the court, to withdraw the amount from the
court, to receive postal correspondence on our behalf.

6. To make an application to the Government of Maharashtra


and/or Collector and/or Competent authority and/or census
authorities, and/or Maharashtra Housing Board under the Free
Housing Scheme of the Maharashtra Government and to make an
application to that effect under the Maharashtra Slum Rehabilitation
Scheme. To sign on the relevant documents with the private builder,
to accept the permanent alternate accommodation in lieu of our said
premises.

7. To form Co-operative Housing Society and to make payment on our


behalf. To sign on the relevant papers, forms, on our behalf, regarding
the Co-operative Housing Society. To remain present before the
Registrar of documents and to sign relevant documents, agreement for
sale, affidavit, declaration and any deed on our behalf, and to sign on
the relevant forms and papers on our behalf. To make the payment to
the Government and/or any builder on our behalf.

8. To declared plaint, affidavit, written statement and any application


on our behalf to file appeal in the Small Causes Court, High Court,
and any other Court. To file writ petition on my behalf in the High
court, in respect of the said block. To declare appeal Memo and Writ
and Writ Petition on our behalf.

9. To attend to Court matter on our behalf, to make an application


for adjournment and to make an application before the Dy. Collector,
and/or to attend before the Deputy Collector regarding the census,
and/or in respect of the said block. To make correspondence to the
City Survey Officer, Tahsildar and B.M.C. in respect of the said block
on our behalf. To make an application for transfer of census record
and to sign on our behalf.

10. Personally attend in the court, to give the instructions to the


Advocate on our behalf, in respect of the premises. To surrender the
tenancy right on our behalf, and to pay the rent receipt on our behalf.

11. To surrender the tenancy on our behalf, to hand over the


possession to the landlady on our behalf, to apply for the census
record on our behalf, to file a consent term on our behalf, to settle the
case in respect of the above mentioned Room on our behalf.

12. To enter into an agreement with the Builder on our behalf, in


lieu of this premises, and to become a lawful member in respect of the
proposed Co-operative Housing society in respect of our above
mentioned block. To accept permanent alternate accommodation in
the newly constructed building in lieu of my premises.

13. To accept the Photopass on our behalf, and to make an


application to the census Officer, for accepting the Photopass on our
behalf. To pay the necessary charges to the census officer. To make
an application to the Collector, Deputy Collector, competent
authorities, and any other Census Officers, and to pay necessary fee to
that effect.

14. To surrender the tenancy right on our behalf in respect of the


above mentioned premises To file a consent term in any court, to file a
case on our behalf, to file Standard rent application on our behalf, to
deposit the rent in any court on our behalf, to file suit standard rent
application, Memo of appeal, Revision application on our behalf, in any
court, including High court on our behalf.

15. To approach before the Census authorities, and/or Photopass


Officers, including Tahsildar, Talati, Census Officers, to collect the
Photopass on our behalf. To pay the Photopass charges, and/or
Census charges, penalty, and other charges to the government on our
behalf. To make the payment on my behalf., to collect the Photopass
on our behalf. To make an application to transfer the said Photopass
and/or census record. To approach before the census authorities, and
to make the payment, penalty, and damages on our behalf. To sign on
the receipt of the Photopass. To make any application for census
authorities on our behalf.

16. To make an application for entering the name of said tenants


in the Eligibility list to be prepared by the Slum Rehabilation
authorities and no objection for transferring the name of the said
Tenants in the annexure under the S.R.D. Scheme

17. To execute agreement on our behalf with the Builder and to


execute agreement on our behalf in respect of the said room and to
admit the execution of the same and to remain present before the
Registrar to complete the Registration formality on our behalf.

AND IN GENERALLY to do all other acts, deeds acts between


the things whatsoever or in or about our aforesaid premises and for
unholding, enforcing, protecting, furthering and defending our right,
title, and interest, therein as ample and effectively as if we personally
acting and could have done in all such and all other related matters of
mine and we further state and declare that this Power of attorney is an
Irrevocable General Power of attorney and to receive the writ of
summons, on our behalf, and to receive the writ of summons, on our
behalf, and to receive any letter/register letter on our behalf, and to
make an application before the Tahsildar, E.N.C. & B.M.C. for transfer
the record of the said premises.

AND KNOW YE FURTHER THAT we do hereby agree to ratify and


confirm all and whatsoever acts, deeds and things including the
management of the affairs of our aforesaid block that our said attorney
to SURESH SUMANBHAI GAJJAR as lawfully do or cause to be done
by virtue these presents and the same shall be binding upon us and our
heirs, executors, administrators, and assigns.

I ACCEPT
AGREEMENT FOR ASSIGNMANT

THIS AGREEMENT FOR ASSIGNMENT is made and entered


into Mumbai on this 19th day of December, 2012, by and between
the parties (1) MANGLABEN SUMANBHAI GAJJAR ADULT, Indian
Inhabitant aged about 86 years residing at 2 Shailesh Niwas, First floor,
Subhash lane, Daftary Road, Malad (E), Mumbai 400 097 (2)
KISHORIBEN DHIRAJLAL GAJJAR adult, Indian Inhabitant, age: 60
years, residing at Surat, Gujarat state (3) MR. MUKESH SUMANBHAI
GAJJAR adult, Indian Inhabitant, aged about 54 years, residing at
Surat, Gujarat state hereinafter called as THE ASSIGNORS (which
expression shall unless it be repugnant to the context or meaning thereof
mean and include their heirs, executors, administrators and assigns) of
the ONE PART.
AND SURESH SUMANBHAI GAJJAR an adult, Indian
inhabitant, Shailesh Niwas, First floor, Subhash lane, Daftary Road,
Malad (E), Mumbai 400 097 hereinafter called the party of the second
part as a ASSIGNEE (which expression shall unless it be repugnant
to the context or meaning thereof mean and include his heirs,
executors, administrators and assigns).

WHEREAS the assignors are the legal heirs and representative of the
deceased SUMANBHAI GULABDAS GAJJAR who was expired on
15/6/1996.

AND WHEREAS the Deponent No.1 is a lawful wedded wife of the


said deceased. The Deponent No.2 is a lawful daughter of the said
deceased. The Deponent No.3 is a lawful son of the said deceased.

AND WHEREAS there is also another legal heirs and representatives


of the said deceased namely SURESH SUMANBHAI GAJJAR aged about 44
years.

AND WHEREAS except Assignors there is no other legal heirs of the


said deceased.

AND WHEREAS the said deceased SUMANBHAI GAJJAR was a


lawful tenant in respect of Block No.2, First floor, Shailesh Niwas,
Subhash Lane, Off. Daftary Road, Malad (E), Mumbai 400 097.

AND WHEREAS after the expiry of the said original tenant,


Assignors became joint lawful tenants in respect of the said tenanted
premises.

AND WHEREAS Assignors have surrendered and relinguished our


all right, title, interest, whatsoever nature including the tenancy right in
respect of the above mentioned block in favour of SURESH SUMANBHAI
GAJJAR

AND WHEREAS the party of the second part have approached


with the party of the first part and requested to assign the said room.
AND WHEREAS the party of the first part have agreed to the party of the
second part to assign the said room. WHEREAS both the parties are
agreed to the following terms and conditions between them.

NOW THIS INDENTURE WITNESSETH AS UNDER:-


1. That the Assignors herein above have assigned their all rights,
title, interest, whatsoever nature in respect of room to the party of the
second part along with all right, title, interest, in respect of the above
mentioned room for the total consideration of Rs. 5,00,000/- (Rupees
Five Lakhs only) by cash as a full and final consideration and the party
of the first part handed over the exclusive possession in respect of the
above said premises.

2. That the party of the first part have already handed over
exclusive and peaceful possession of the said premises on the day of
execution of this agreement. That the Assignor hereby declare that he
had not executed any agreement, document, deed, indenture etc. in
respect of the said premises in favour of any third party, or person
and/or otherwise encumbered the said room or any part of the said
room thereof in any manner whatsoever and the Assignors hereby
declare that the said premises is free from all encumbrances, and the
Assignors have absolute powers and authority to sell and assign the
said premises in favour of the Assignee.

3. That the Assignees shall be entitled to get said room in all the
records pertaining thereto, such as, assessment bill, electricity meter,
water connection and all other papers and documents, pertaining to the
said premises duly transferred and in names in all the records of the
Tahsildar / Collector / BMC / Reliance Energy Ltd./ Revenue authority
and everywhere, the said room. The Assignor hereby agree and
undertake to extend all his co-operation to the Assignee, in respect of
the said block, effecting the transfer of the said block records thereof.

4. The Assignors hereby agree and undertake to execute and


sign all such deeds, documents, indenture affidavit, etc, as may be
required from time to time for more effectually transferring the said
room in the name of the Assignee without any further demand or
without any let, or hindrance at the cost of the Assignee.
5. The Assignors hereby declare that they have already paid all
the taxes, dues and outgoing, including his shares in respect of the
said block to the concerned authorities, prior to the execution of
these presents, and hereafter the Assignee alone shall be liable and
responsible to pay the same, and the Assignors shall not be liable and
responsible for the same.

6. The Assignors hereby indemnify and keep indemnified the


Assignee against all claims, suits, damages, loss, etc. that may be
caused to the Assignee on account of any claim, by third party
including shares in respect of the said block.

7. The Assignors hereby execute Irrevocable General Power of


Attorney and Affidavit in favour of Assignee authorizing her to take
all necessary step for more effectually transferring the said room and
the records pertaining thereto, including shares in the name of
Assignee and also for all other purposes.

8. The name of the Assignee in the Chawl Committee and/or


Society, in respect of the said room and the Assignee will be the
lawful member of the said Chawl Committee and/or society.

9. That the Assignors herein above have no objection for


transferring the name of the Assignee in the water connection record,
including lawful member.

10. That the Assignors herein above have no objection if the


proposed committee and/or proposed Housing Society and/or Builder
granted permanent alternate accommodation in lieu of the said
premises to the Assignee for which the Vendors have no objection
for the same, and if the Builder have granted flat in lieu of the said
premises, the Assignors have no objection for the same.
11. That the party of the first part will have no objection for
transferring the rent receipt, in respect of the said premises in the
name of the party of the second part.

12. It is hereby agreed by and between the parties that the


party of the first part will not claim any right, title, interest,
whatsoever nature in respect of the said premises.

13. It is hereby agreed by the parties that the party of the first
part have already handed over the entire original documents and the
party of the second part on and will sign on the relevant papers as
and when require for transferring the said premises in the name of
the party of the second part, in respect of the said premises.

14. It is hereby agreed by and between the parties that the


party of the first part have also no objection for obtaining new
electricity meter in the name of the party of the second part in
respect of the said block.

15. It is hereby agreed by and between the parties that the party of
the first part have also no objection for obtaining new ration card
and new electricity connection in the name of the party of the second
part in respect of the said room.

SCHEDULE OF THE PROPERTY:-

That a block situated at Block No.2, First floor, Shailesh Niwas,


Subhash Lane, Off. Daftary Road, Malad (E), Mumbai 400 097.

AGREEMENT FOR TERMS OF TENANCY
THIS AGREEMENT FOR TERMS OF TENANCY is made at

writing and now this agreement for terms of tenancy is made on

2. The party of the first part Landlords hereby admits and


confirms that they have hand over the possession of room No.
30 in Sai Sadan chawl, as referred above to the party of the

before execution of this Agreement.

3. The party of the Second part tenants agree and undertake


to pay monthly rent of Rs. _____/- every month regularly to the
first part the Landlords and shall not withhold the same on any
of the grounds or reasons whatsoever nature may be.

4. The Party of the second part the Tenants will not sublet,
underlet as and by way of paying Guest, Care-taker etc. and if
he do so the Landlords are entitle to evict him without due
process of law and for which tenants will not raise any objection
of any nature whatsoever may be.

alteration or addition into the said premises, and shall not kept
his utensils on the passage etc. and shall not wash the Clothes
and Utensils on the passage, and shall not make any nuisance or
annoyance to the Landlords or neighbouring occupants.
