1. The Role of Judiciary in India

The judiciary in India comprises the Supreme Court at the apex. The States have High Courts (in some
cases two or more States have a common High Court). Down below there are District Courts and below
them the courts at lower levels.The interest of the people is further safeguarded by the existence of an
independent judiciary. As guardian of the Fundamental Rights and the watchdog of the constitutional
provisions, the judiciary has powers to declare void any legislation that in its opinion is violative of the
provisions of the Constitution of India.The power of judicial review ensures that neither the Legislatures
nor the Executive can ride rough over the rights and interests of the people of India. In the case relating
to the OBCs referred to earlier, the Supreme Court held the legal validity of the order but asked the
government to make certain modifications in the original order.

The Court wanted that the creamy layer within the OBCs should be excluded from the benefits of
reservation. In effect it meant that the benefit of reservation would go only to such people among the
OBCs who were not already well placed. The original order of 1990 was modified in 1993 to include the
modifications asked for by the Supreme Court.But for the provision of judicial review, the dispute
between those who wanted reservations for OBCs and those who were opposed to it would have
continued with harmful consequences for the OBCs and also the rest.The judiciary in India comprises the

A distinguishing feature of the Indian judiciary is that it is totally independent of the Executive. The
judges of the High Courts and the Supreme Court are appointed by the President in consultation with
the Chief Justice of the Supreme Court and on the advice of the Prime Minister. The system has
functioned well all these years. There are no instances where the executive could have tinkered with the
functioning of the judiciary.

The Constitution provides that a judge of the Supreme Court or the High Court cannot be removed by
any executive authority. He can only be removed by impeachment. The process of impeachment is
parallel to the process prescribed for the impeachment of the President. There has been no case so far
where a judge was removed by impeachment.

Any citizen of India can approach the judiciary if he feels any of his fundamental right has been infringed
by an act of the executive. Courts can also be approached through Public Interest Litigations. The courts
have thus been acting a braking force that comes into action any time the executive tries to misuse its
powers.While the people of India have their reservations about the fairness of government actions, they
have complete faith in the judiciary. This is good for the health and survival of democracy in the country.

2. INDIAN POLITICS DURING PANDEMIC


The COVID-19 pandemic has impacted politics, both international and domestic, by affecting the
governing & political systems of multiple countries, causing suspensions of legislative activities, isolation
or deaths of multiple politicians and reschedulings of elections due to fears of spreading the virus. The
pandemic has triggered broader debates about political issues such as the relative advantages of
democracy and autocracy, how states respond to crises, politicization of beliefs about the virus, and the
adequacy of existing frameworks of international cooperation. Additionally, the pandemic has, in some
cases, posed several challenges to democracy, leading to it being fatally undermined and damaged.

Politicians, all around the world are famous for doing dirty politics even during very serious pandemic
time. This is not new with politicians around the world. This has been happening for ages, for centuries.
And continues to happen even now – during coronavirus pandemic time, more “vigorously and
efficiently”!Politics is their profession. No doubt about it. But they should not use a pandemic situation
like this for their selfish survival. Isn’t it? But who cares?

The COVID-19 pandemic affected the political systems of multiple countries causing suspensions of
legislative activities, isolation or deaths of multiple politicians, and rescheduling of elections due to fears
of spreading the virus.In India, the impact of the pandemic might be felt most in the expansion and
reach of the state and the centralisation of power. We are already seeing the pandemic’s impact on
national politics in different parts of the world.

There has been a wide variation, too, in the response of the different Indian states to the pandemic.
Kerala, where the Communist party is ruling, never toe the line of the Central government. States like
Kerala, with its strong public healthcare system and high levels of literacy, have tackled the pandemic
well while others have been laggards. A study has shown that the case fatality ratio was the lowest in
Kerala and the highest in states like Maharashtra, Gujarat and Madhya Pradesh. The rate of testing, the
enforcing of social distancing and health infrastructure possibly explains the variation.

The way the crisis is being handled is itself intensely political. There is a concerted effort by the Central
government to show that the pandemic, particularly the number of infections and fatalities, is under
control and by state governments to do the same even if that means massaging numbers.

The poor and marginalised have borne the brunt of the lockdown with thousands of migrant workers
stranded in their place of work or on highways. Modi has used the opportunity to address the nation on
multiple occasions. By labelling the threat of the virus as a war, demanding sacrifices of the Indian
people and invoking the Mahabharata.

So Think. Start doing good for the virus affected right now and help others who are in need of your
service and improve your winning chances. For God’s sake leave dirty politics. Good luck.
