SUBJECT : POLICIES ON DUST EMISSION CONTROL IN CONSTRUCTION
SITES BY THE LOCAL GOVERNMENT.

Particulate emissions, notably the Total Suspended Particulates (TSP) and Particulate
Matter 10 (PMic) is emitted from construction works and has been a nuisance to everyday
activities, More significantly, its impact to health on both workers and neighborhood is an obvious
hazard, much more to the vulnerable groups.
‘The annual average concentration of TSP from the air quality monitoring stations in Metro
Manila shows a decreasing trend; from 150 jig/m? in 2010 to 102 pg/m? in 2015. Nevertheless,
more effort is still needed in order to meet the annual air quality guideline value of 90 jig/m? set
forth by the Philippine Clean Air Act (RA 8749).
Under Section 36 of RA 8749, local authorities have a role in the management and
maintenance of air quality in their territorial jurisdiction. Additionally, several DENR functions
has been devolved to local government units as per DAO 1992-30 or the “Guidelines for the
Transfer and Implementation of DENR functions Devolved to Local Government Units”. Under
Section 3.3 (c) of this order, abatement of nuisance as defined by law is a function devolved to
LGUs.
With much desire to improve the air quality from the localities, we need to enjoin LGUs in
the implementation of control measures. It is imperative that more attention should be given to
regulating the exposure of the general populace by issuing regulations from the LGUs.
Environmental programs / activity for the abatement of construction emission including burning
of construction materials may be implemented thru the Environment and Natural Resources Office
(ENRO). Moreover, it is recommended to issue a city ordinance that identifies activities for
abatement or an enforceable regulations preventing construction activity emissions,
Therefore, the regional offices is hereto directed to urge the cooperation of the LGUs within
your region to exercise their functions in the abatement of such emission.
