EXTRA-JUDICIAL SETTLEMENT OF THE ESTATE

OF THE LATE SPOUSES EMILIANO NATIVIDAD and

MACARIA ESQUIVEL WITH WAIVER OF RIGHTS
KNOW ALL MEN BY THESE PRESENTS:

This Extra-Judicial Settlement is executed by:

LUZVIMINDA NATIVIDAD-MANIGBAS, Filipino, of legal age,

married and a resident of City of Koronadal, South Cotabato;

EUGENIO E. NATIVIDAD, Filipino, of legal age, widower and a

resident of Brgy. San Felipe, Tantangan, South Cotabato;

ANGELICA NATIVIDAD-DIEGO, Filipino, of legal age, married and a

resident of Tarcan, Baliwag, Bulacan;

ZENAIDA NATIVIDAD-WALTON, Filipino, of legal age, married and a

resident of _____________________________;

ROSALINA NATIVIDAD-MALAN, married to Avelino Malan (both

deceased) herein represented by their only son:

JOEY MALAN, Filipino, of legal age, married and a resident of Bo.

1, City of Koronadal, South Cotabato; and

ELIZER E. NATIVIDAD, Filipino, of legal age, married and a resident of

City of Koronadal, South Cotabato;

DECLARE AND MAKE MANIFEST

That we are the surviving heirs of the late spouses EMILIANO

NATIVIDAD and MACARIA ESQUIVEL, who died intestate in ____________
and __________________, respectively, both at City of Koronadal, South
Cotabato, that we are their legitimate children;

That at the time of their death, the said spouses EMILIANO

NATIVIDAD and MACARIA ESQUIVEL, left property which is more
particularly described as follows, to wit:

“A parcel of land known as Lot No. 207-B, Psd-11-

002929, being a portion of Lot 207, Pls-221, situated in
the Barrio of San Felipe, Tantangan, South Cotabato,
containing an area of TEN THOUSAND (10,000)
Square Meters, more or less and covered by
TRANSFER CERTIFICATE OF TITLE NO. T-27279.”

That no personal properties are involved in this Extra-Judicial Settlement;

That to the best of our knowledge and information, the late spouses
EMILIANO NATIVIDAD and MACARIA ESQUIVEL left no debts;
 That the parties hereto being all of legal age and with full civil capacity to
contract, hereby by these presents agree to divide and adjudicate, as they hereby
divide and adjudicate among themselves the above-described real estates in the
following manner:

That we, LUZVIMINDA NATIVIDAD-MANIGBAS, EUGENIO E.

NATIVIDAD, ZENAIDA NATIVIDAD-WALTON, JOEY N, MALAN and
ELIZER E. NATIVIDAD, by virtue of these present hereby waive, relinquish,
repudiate, and renounce whatever share and participation we have over the
above-described parcel of land, unto and in favor of:

a.) ANGELICA NATIVIDAD-DIEGO

“NINE THOUSAND SEVEN HUNDRED

FIFTY (9,750) Square Meters, more or less,
portion of Lot No. 207-B, Psd-11-002929,
situated in the Bo. of San Felipe, Tantangan,
South Cotabato.”

- and –

b.) CRISPIN NATIVIDAD

“TWO HUNDRED FIFTY (250) Square Meters,

more or less, portion of Lot No. 207-B, Psd-11-
002929, situated in the Bo. of San Felipe,
Tantangan, South Cotabato.”

NOW THEREFORE, for and in consideration of the foregoing premises

and invoking the provisions of Sec. 1, Rule 74 of the Rules of Court, WE,
LUZVIMINDA NATIVIDAD-MANIGBAS, EUGENIO E. NATIVIDAD,
ANGELICA NATIVAD-DIEGO, ZENAIDA NATIVIDAD-WALTON, JOEY N,
MALAN and ELIZER E. NATIVIDAD , adjudicate unto ourselves the above-
mentioned real estate of the late spouses EMILIANO NATIVIDAD and
MACARIA ESQUIVEL, subject however, to the liabilities imposed by Section 4,
Rule 74 of the Rules of Court in favor of other possible heirs, persons or creditors
who might have been deprived of their lawful participation over the estate of the
said deceased person for a period of two (2) years.
