WARRANTY TERMS AND CONDITIONS

1 - Warranty period is 12 (twelve) months from the date of start up at Buyer’s site, but
no longer than 15 (fifteen) months from the date of shipment.
2 - Machines and parts that are produced by VARLI Plastic Machiney (Manufacturer)
are under warranty against manufacture defects.
3 - Parts that are supplied from other manufacturers (such as gearbox, engine,
electrical – electronic equipment, hydraulic system etc.) are under warranty of its own
manufacturer. Warranty period for the supplied parts are as follow; (starting from the date of
supplier’s invoice)
- Motors: 24 months
- Gearboxes: 24 months
- Electrical components: 24 months
4 – Right of Warranty will lapse, if the machine is not started by the authorized service
of the Manufacturer.
5 – Seller’s Warranty obligation shall not apply to defects due to;
a) processing of non-contractual input material
b) damages caused by foreign objects (metals, stones, chemicals etc.) and/or external
influences (ambient temperature, humidity, external damage, operation by untrained workers
etc.)
c) improper operation or service not in accordance with the User’s Manuals and/or which
have been communicated by the authorized start up service of Manufacturer
d) inadequate installation of a part by the Buyer or Buyer’s representatives, inadequate
maintenance, inadequate repairs or modifications undertaken by other persons than
Manufacturer or Manufacturer’s authorized service.
e) operation above allowed maximum parameters which are set by Authorized Service
f) inadequate operation conditions (as per Sales Contract)
g) defects caused by normal wear and tear
6 – A certain life time for parts, in direct with the material to be processed, can not be
promised as the life time is strictly depends on the kind of input material.
7 – The Buyer has to notify the Seller in written in case of a defect with technical
details and photos of the defect, that the service department of Manufacturer can carry out the
required remedy work.
8 – The Manufacturer shall, after being informed of defects in the mentioned way, at
his own choice either,
a) rework the defective goods on Buyer’s site
or b) have the defective parts or defective goods shipped back for reworking
or c) replace the defective parts
or d) replace the defective goods

9 – If Manufacturer asks for the defective part or good to be returned for the purpose
of reworking, replacement or investigation, Buyer is obliged to send the parts or goods under
DAP Canakkale Turkey delivery terms.
10- Delivery terms of parts or goods from Manufacturer’s factory after reworking or
replacement is EXW Canakkale-Turkey.
11- In case of sending a replacement part during warranty period, before warranty
inspection of a defected part, replacement part will be invoiced first. As soon as the
Manufacturer’s Service Department (or Service Department of the part’s own manufacturer)
confirmed the existence of a warranty claim a credit note will be issued for this invoice.
12 – Costs for repair or replacement work on Buyer site during warranty period, such
as transport and accommodation costs, are at Buyer’s expense. As soon as the Manufacturer’s
Authorized Service confirmed the existence of a warranty claim, costs of transport and
accommodation will be reimbursed by Manufacturer.
13 – Manufacturer and/or Seller is not liable for loss of profit.
