MOST RESPECTFULLY SHOWETH:

1. That the Petitioner has filed the Writ Petition No. 1142/202o

before this Hon’ble Court for setting aside the order dated

19.08.2019 passed by the Ld. District Magistrate in an

Application under Section 23 filed by the Petitioner herein.

2. That the Petitioner had filed an application for urgent hearing in

the above-mentioned matter and vide its order dated

11.06.2020, this Hon’ble Court granted a week’s time for filing of

Counter Affidavits to the Respondents.

3. That it is humbly submitted that the Respondent could not file

the counter affidavit within the stipulated time as in the Writ

Petition many facts have been alleged by the Petitioner and it


was pertinent for the Respondent to go through all the relevant

documents and to counter them. It was the duty of the

answering Respondent to bring all the material facts before this

Hon’ble Court for the proper adjudication of the present dispute.

Hence, in getting all the relevant documents and to file an

appropriate reply, there has been a delay of 20 days

approximately. Also, many facts have been suppressed by the

Petitioner, which the Respondent had a duty to bring forth before

this Hon’ble Court.

4. That the present application is bonafide may be allowed in the

interest of justice.

PRAYER

For the facts, circumstances and reasons set out hereinabove, it is

respectfully prayed that this Hon’ble Court be pleased to:

I. Condone the delay of 20 days in filing the present

Application on behalf of the Applicant(s).

II. Pass such other or further order, which this Hon’ble Court

deems just and proper in the ends of justice and in the

circumstances of this case.

AND FOR THIS ACT OF KINDNESS AND JUSTICE, THE APPLICANT(S),


AS IN DUTY BOUND, SHALL EVER PRAY.
