HIGHLIGHTS OF THE OBJECTIVES IN DRAFT NATIONAL IPR POLICY

(Submitted by IPR Think Tank)

OBJECTIVE No. 1: To create public awareness about the economic, social and
cultural benefits of IP among all sections of society for accelerating development,
promoting entrepreneurship, enhancing employment and increasing
competitiveness.

Steps to be taken for attaining the Objective:

(i) Adoption of national slogan “Creative India; Innovative India”;


(ii) Linking IPRs with other national initiatives such as “Make in India”, “Digital
India”, “Skill India” and “Smart Cities”;
(iii) Creation of systematic campaign by customizing programs for specific
needs of industries, MSMEs, R & D institutions, etc.
(iv) Create awareness programs specifically targeting industry and R&D
entities by providing scientists/researchers with a deeper level of
understanding about invention protection and IP registration, engaging
public funded research organizations and collaborating with MNCs / large
corporate.

OBJECTIVE NO. 2: To stimulate the creation and growth of intellectual property


through measures that encourage IP generation.

Steps to be taken for attaining the Objective:

(i) Suggests holding of comprehensive IP audit / base line survey for


assessing areas of strength, development of specific programs to address
inventor’s needs and providing resources for creating IP assets;
(ii) Include IP creation as a key performance metric for public funded R&D
entities as well as technology institutions.
(iii) Introduction of ‘first-time patent’ fee waiver and support systems for
MSMEs and reduce transaction costs in other ways (e.g. prior art search)
etc.

OBJECTIVE NO. 3: To have strong and effective laws with regard to IP rights that
are consistent with national priorities and international obligations and which
balance the interests of rights owners with public interest.

Steps to be taken for attaining the Objective:

(i) Review of existing IP laws, where necessary, to update and improve them
or to remove anomalies and inconsistencies, if any;
(ii) Enact laws to address national needs;

(iii) Engage actively in the negotiation of international treaties and agreements
in consultation with stakeholders;
(iv) Identify important areas of study and research for future policy
development etc.

OBJECTIVE NO. 4: To modernize and strengthen IP administration for efficient,


expeditious and cost effective grant and management of IP rights and user
oriented services.

Steps to be taken for attaining the Objective:

(i) Office of Controller General of Patents Designs and Trademarks (‘CGPDT’)


to fix and adhere to timelines for granting registrations / disposing
opposition matters and adopting best practices w. r. t. filing / docketing of
documents, maintaining records, digitizing it;
(ii) Office of Registrar of Copyrights to take measures for modernization of
Copyright Office, e-filing facility, digitizing copyright records and
introducing online search facility;
(iii) Proposes collaboration with various R&D institutions, universities, funding
agencies, chambers of industry and commerce in providing advisory
services;
(iv) Creation of common web portal for ease of access to statutes, regulations,
guidelines and databases;
(v) Promotion of cooperation with IP offices in other countries;

Objective No. 5: To augment commercialization of IP rights; valuation, licensing


and technology transfer.

Steps to be taken for attaining the Objective:

(i) Establish IP Promotion & Development Council (IPPDC) as nodal


organization and support its financial aspects;
(ii) Promote public sector initiatives, going-to-market activities by providing
seed funding;
(iii) Guidance and support to IPR owners about commercial opportunities of e-
commerce through Internet and mobile platforms etc.
Objective No. 6: To strengthen the enforcement and adjudicatory mechanisms for
combating IP violations, piracy and counterfeiting; to facilitate effective and
speedy adjudication of IP disputes; to promote awareness and respect for IP
rights among all sections of society.

Steps to be taken for attaining the Objective:

(i) Establishment of centralized `Multi-Agency Task Force’ for coordination


between various agencies and providing direction and guidance on

enforcement measures;
(ii) Creation of nation-wide database of known IP offenders;
(iii) Close working with state governments for establishment of IP cells and
inclusion of IP crimes under their special laws;
(iv) Recommends designation of specialized patent bench in High Courts of
metropolitan cities for speedy disposal of patent cases;
(v) Designation of one IP court at the district level;
(vi) Creation of regional benches of IPAB where IP Offices are located;
(vii) Increase powers of IPAB in its administration, which includes autonomy in
financial matters and selection/appointment of technical & judicial
members etc.

Objective No. 7: To strengthen and expand human resources, institutions and


capacities for teaching, training, research and skill building in IP.

Steps to be taken for attaining the Objective:

(i) Establishment of national level institute of Excellence to provide thought


leadership in IP;
(ii) Energize IP Chairs in educational institutes of higher learning to provide
high quality teaching and research;
(iii) Introduction of IP courses/modules in all major training institutes etc.
