USER POLICY TO RECEIVE ELECTRONIC MESSAGES FROM MAGNUM

MANAGEMENT CORPORATION SELECTED APPLICATIONS


 
Background and Context
 
A. The Apps and Their Functionality

MAGNUM MANAGEMENT CORPORATION and its subsidiaries and affiliates (collectively, “MAGNUM”) is offering its
Users (as defined below) a new way to communicate with MAGNUM regarding certain employment or engagement
information (e.g., scheduling, compensation, emergency, password reset, benefits, etc.) and other similar information
related to your employment relationship with MAGNUM. To access and utilize this functionality (the
“Functionality”), Users must download the relevant applications (each, an “App” and collectively, the “Apps”) from either
the iOS iTunes Store, the Android Play Store or other device store (as available) to a User’s personal device (e.g.
tablet, smartphone, wearable or computer) (the “Devices”).

As an associate, everything you need is at your fingertips – from checking your schedule to approving your timecard to
swapping a shift if something unexpected comes up. As a manager, access all the data and workforce information you
need to stay productive – from approving timecards to analyzing real-time data views and KPIs to be able to flex
schedules to accommodate associate requests.

B. Privacy Policy and Terms of Use

Please note, MAGNUM is contracting with third party vendors (the “Vendors”) to provide Users with the Apps and the
Functionality. Meaning, these Vendors’ privacy policies and terms of use will govern the User’s use and interaction with
the App and the Functionality. In addition, the Vendors will have access to the User’s Contact Information. The Vendors’
privacy policy and terms of use are available for your review before your download and install each Vendor’s app and
before you provide your Contact Information. The privacy policy and terms of use remain available via the App.
 
C. Agreement to Receive Automated Electronic Messages

Some Functionality may permit Users to receive emails, text messages, SMS messages and/or other electronic messages, any of
which may be sent by automated means, on Users’ Devices (collectively, the “Messages”). If additional charges occur for a User to
receive or respond to any Message, such charges are the sole responsibility of the User (as permitted by law). MAGNUM requires
a signature on the last page of this Policy, confirming that the User has read, comprehends, and agrees to the terms and conditions
detailed in this Policy.
 
D. Use of Apps and Functionality Is Voluntary

Use of the App, the Functionality, the receipt of Messages, and the provision of Contact Information is completely
voluntary and is not a required condition or expectation of the User’s employment or retention as an independent
contractor, as applicable. If at any time, a User does not wish to download or utilize any App or any Functionality,
traditional forms of reviewing and tracking such employment or engagement information remain available and accessible
to such Users. If the User has already downloaded and installed the App, the User may uninstall any App at any time.

E. Creation of Accounts
 
Additionally, Users will be required to create an account on the downloaded App (“Account”). After creating an Account,
Users will have the ability to handle and address resetting their MAGNUM password(s) while at work or while accessing
MAGNUM provided hardware. If a User desires to provide personal Contact Information within his/her Account, then
each User will be able to reset his/her MAGNUM password(s), including password(s) for the Apps, from the Devices or
from other non- MAGNUM provided hardware. Please remember, the provision of personal Contact Information within a
User’s Account is completely voluntary and is not a required condition or expectation of the User’s employment or
engagement.  

Scope
 
This Policy applies to all “Users”, meaning MAGNUM associates, contractors, consultants, suppliers, customers, and all
personnel affiliated with third parties, worldwide who are permitted to access and/or use the App and the Functionality
from their personal Devices (i.e., devices that are not owned or issued by MAGNUM).

User Roles and Responsibilities
 
User Responsibilities
 
By downloading an App you, the User, assume certain responsibilities for your Device and your use of the App and the
Functionality, which may access certain confidential or propriety MAGNUM information, (i.e. scheduling,
compensation, emergency, password reset, benefits, etc.) and other similar information related to your employment
relationship with MAGNUM) or that may connect to MAGNUM’s internal, technology resources (not including the
publicly available ecommerce or social media sites). You, as a User, must ensure that you comply with all provisions of
this Policy, and all applicable Terms of Use, Privacy, Security and Confidentiality policies.

Condition
 
Keep your Device in good and working order. This includes installing the latest provided/supported carrier update or
latest version provided from the O/S vendor within 60 days of release. Your Device must have functioning software
(e.g., email program, SMS text program, etc.) that can receive the Messages sent by the Vendors.

Updated Contact Information


 
Immediately update each App and your Manager and/or Supervisor (in written form) with any Contact Information
changes. Such change may not be fully reflected until the next schedule period.
 
Safety
 
You are prohibited from using the Device, either hands on or hands free, for purposes related in any way to MAGNUM
while driving or engaging in similar in-motion activities, including, but not limited to, reviewing and/or responding to
Messages. If a time-sensitive response is necessary, you shall wait to respond until you are fully stopped at a safe and
parked location where you can safely use your Device.
 
Security
 
In order to prevent unauthorized access to information accessible through the Apps, Devices and each element
within the Functionally that you have provided Contact Information must be password protected using the features
of the Device and/or the App or the Functionality. You are responsible for any unauthorized activities in your accounts,
so please take precautions to properly secure your Device and access to the App and all Functionality.
 

Loss, Damage or Theft


 
Each User must immediately (no later than 24 hours) report the temporary or permanent loss, damage or theft of any
Device containing the App to the App provider or to his/her: (a) Supervisor and/or (b) Manager relating to changes
in contact information and access to the Apps, without exception. Reporting lost, damaged, or stolen Devices is
critical to maintaining security due to the risks of unauthorized use and information loss. Additionally, it is very important
that You delete the App and each element of Functionality fully from your Device before service is transferred and/or
terminated, or you switch, return, or sell your Device.
 
Laws and Regulations
 
You must use the Apps and the Functionality in accordance with all relevant Company policies and the relevant privacy
policy and terms of use.
 
Data and Message Rates
 
All Messages you receive on your Device are subject to your carrier’s standard data and message charges, rates, and
fees. MAGNUM does not reimburse you for any of these charges, rates, or fees, which are your responsibility (as
permitted by law).
 
Modification or Termination
 
MAGNUM may, at its discretion, at any time and effective immediately upon notice to You, (i) add, remove or modify any
Functionality available via the App, and/or (ii) terminate Your use of the App and/or any or all Functionality
available via the App.

Software Updates
 
From time to time, MAGNUM, through its Vendors, may, but is not required to, update the App and/or the Functionality.
These updates would be designed to (i) fix a problem, (ii) enhance the performance, safety, stability, or security of the
software and/or our network; or (iii) enhance, change, alter, remove, delete, supplement, extend or delete features,
Functionality or services of the App. Updates may take the form of bug fixes, enhanced versions, modifications,
upgrades, new modules, or new versions (including replacing out-of-date versions).
 
User Agreement
 
I acknowledge that I have read this Policy in full, and that I fully understand the terms of use and my responsibilities as a
designated User. I agree to the terms of this Policy in their entirety and agree to fully comply at all times with the
responsibilities of Users contained herein. I agree that, since the App and the Functionality are provided by Vendors: (a) I
may willingly and under no obligation from MAGNUM provide my Contact Information to the Vendors; and (b) unless
prohibited by applicable law, MAGNUM i s under no obligation to protect any personal data or information including
the Contact Information. I understand that violations of this Policy may subject me to potential disciplinary actions, up to
and including termination of employment.
 
I expressly acknowledge that downloading and utilizing the App and the Functionality available through the App is
completely voluntary and not a required condition or expectation of employment or engagement with MAGNUM. I further
agree that the downloading and use of the App and the Functionality does not constitute actual or implicit approval from
MAGNUM for me to perform work or services outside of my designated workplace or location or in violation of MAGNUM
p o l i c i e s and procedures. If special permission or approval is required for me to perform work other than in my designated
workplace or location and during designated work times, I will comply with all applicable policies and procedures to
obtain such permission or approval before using my Device for work or otherwise performing work.
 
Your Consent To The User Agreement 
 
I expressly acknowledge that by downloading and utilizing the App and the Functionality available through the App I agree
to the terms and conditions detailed in this Policy, including downloading the App and any future Software Updates on my
Device, utilizing the Functionality, receiving Messages (including messages sent by automated means) on my Device, and
providing of my Contact Information and that I further acknowledge that I am fully responsible for all of my actions and waive
any and all claims against MAGNUM that may arise from or relate to my actions.

How You May Opt Out

I understand that I may opt out of accessing or using App and the Functionality at any time. To opt out, I must: (a) delete
the A p p f r o m m y D e v i c e ; a n d ( b) p r o v i d e w r i t t e n n o t i f i c a t i o n to m y S u p e r v i s o r a n d / o r M a n a g e r . I
understand that it may take a reasonable amount of time to make any requested changes.
 
MAGNUM may, at any time and at its discretion, modify this Policy, including the User
Agreement.

behalf and on behalf of the Vendors who have provided access to the downloaded App and the related Functionality.
