The counsel for the defense manifested that that they have no
object evidence exhibit to be marked in today’s Pre-trial Conference.

The counsel for the Petitioner and the Public Prosecutor reserved
the right to mark additional documentary exhibits during the course of
the trial, subject to the showing of good cause.

POSSIBILITY OF SETTLEMENT

The parties explored the possibility of an amicable settlement but

could not come up with any agreement.
 STIPULATION OF FACTS

1. Accused Nilo Kho, Ben Telador, Boco Chalad, Mark

Sanchez and Pedro Dela Cruz are the same persons
mentioned in the information.
2. Jurisdiction of the court over the person of the accused
Nilo Kho, Ben Telador, Boco Chalad, Mark Sanchez and
Pedro Dela Cruz and over the nature of the offense
(violation of Section 261(dd)(1) under the Omnibus
Election Code)
3. SPO1 Kaye Quizon and SPO2 Kia Astive are the
arresting officers on the case and that they prepared the
following documents:
a. Police Blotter Report Certification
b. Photograph of 3 bottles of 500mL Red Horse Beer
c. Photograph of 1 Styrocup
d. Photograph of 1 Plastic
e. 1 Photograph of the accused drinking
4. The camera used in taking the pictures as well as the
printer used in printing it belongs to the precint.
5. That all the accused was brought to Tondo General
Hospital
6. That all the accused mentioned in the information was
arrested and stayed the night inside precint before they
were brought to the Prosecutors office.

It is understood that no evidence shall be allowed to be

presented and offered during the trial other than those identified
and marked during the trial except when allowed by the court for
good cause shown.
