WATER SERVICE CONTRACT
This WATER SERVICE CONTRACT is made and entered into by and between the MALAYBALAY CITY
WATER DISTRICT, represented by its General Manager, Glenrose T. Ledesma, hereinafter referred to as
the “ District ”, and, ________________________________________________________________ of legal age,
Filipino, married to__________________________________________________________________ with residence
and postal address at _________________________________________ City of Malaybalay hereinafter
referred to as the “ Customer ”.

WITNESSETH
That the “ District ” and the “ Customer ”, in consideration of the Mutual Covenants and
Agreements made herein by these presents, enter into a Contract of Water Service effective
_________________________________ with the following conditions;

A. INSTALLATION
1. The District shall install a water service connection to the property of the Customer
as described in the accomplished Assessment Form.
2. The Water meter shall be installed only at the designated Water Service
Pads/Tapping Points by the District’s authorized plumbers. Any request for transfer
of water meter maybe granted provided the Customer uses G.I. pipes or other
standard pipes approved by the District to minimize leakages. All expenses relative
to labor and materials shall be at the Customers’ expense.
2.1 Pipe lines after the water meter shall be maintained by the Customer and
any wastage, damage or leakage not caused by the District shall be
shouldered by the Customer.
2.2 The Customer whose pipe line passes through private properties must first
secure a written permission from the rightful owner of such property.
B. CHANGE OF NAME
Request for change of registered name of customer, applicant should show
authority from the original owner or if he bought or leased, subject property,
proper documents should be attached.
C. DISCONNECTION
1. The District shall discontinue its water services to a Customer in any of the following
grounds:
1.1 Failure to pay on due date. Disconnection will be undertaken 72 hours after
notice of disconnection has been duly served.
1.2 Any violation of RA 8041 otherwise known as the Water Crisis Act of 1995 as
provided in rule 5, section 3, or any fraudulent practice in relation to the use of
the water system.
1.3 Non-compliance to the District’s policies and Board Resolutions pertaining
water services.
D. RE-CONNECTION
1. Disconnected services due to delinquency can be re-connected upon full
payment of arrears and the re-connection fees of P200.00 for Residential/Domestic,
P210.00 for Semi-Commercial A; B & C and P220.00 for Full Commercial. However,
reconnection of services discontinued beyond six (6) months maybe held pending
in cases of water shortage or similar situation.
2. Request for re-connection of disconnected services by another person to replace
the name of the original registered Customer may not be approved except upon
settlement of all previous accounts of the registered Customer. A duly approved
application for water service connection to assume the water service installation of
another should be first be approved.
3. The water meter is a property of the District and has an approximate life span of five
(5) years to be considered fully depreciated. After full depreciation, the district may
remove said water meter and replace it with another one.
E. RATES and FEES
Installation Fees for New Connection

1.1 - Residential/Government --------------------------------------- 3,620.00


1.2 - Semi-Commercial A --------------------------------------- 3,800.00
1.3 - Semi-Commercial B --------------------------------------- 3,740.00
1.4 - Semi-Commercial C --------------------------------------- 3,680.00
1.5 - Full Commercial --------------------------------------- 3,860.00

Note: Rates & fees shall be based on the current approved schedules and is subject to change with prior notice
and upon approval of the MCWD Board of Directors.

F. GENERAL POLICIES

1. All unpaid bills after due date shall be considered as arrears and shall subject to
10% penalty charge.
2. Partial payment in a given month is considered no payment and can subject the
customer to disconnection.
3. The District shall provide a water meter to the Customer and in turn the Customer
shall protect it from any damage and shall be required to pay the equivalent
amount in case of its loss or damage while in his possession.
4. The customer is not allowed to remove, tamper or transfer the water meter assigned
to his service connection.
5. Should an issued water meter be destroyed or becomes unserviceable for any
reason or another, the Customer should immediately report it to the District for
appropriate action.
6. In case of uncertainty of consumption computation, the average consumption for
three (3) consecutive months immediately preceding the reported date of
unserviceability shall be the basis for subsequent bill computation.
7. Authorized representative of the District shall be given by the Customer full access
to his premises/property for the purpose of inspection, repairs and disconnection.
8. All other policies, rules & regulations that may hereinafter be formulated by
competent authorities like Local Water Utilities Administration (LWUA), National
Water Resources Board (NWRB) and resolution of the Board of Directors of the
district, shall form part of this policy upon proper public notification.
9. Should the Customer fail to comply with any of these agreement and policy, the
District may terminate this contract with prior notification.
