COMPROMISE AGREEMENT

This Agreement executed this 21st day of May, 2020 at Jaro, Iloilo City by and between

Mary Felijane Jacobe, Filipino, of legal age with address at ----. (herein after referred to
as the “the plaintiff”)
- and -
Joji Marcus and Louren Marcus, Filipino, both of legal age with address at ---. (herein after
referred to as the “the defendant”)
WITNESSETH: That –

WHEREAS, the plaintiff instituted the present action for ejectment and payment of rental
fees.

WHEREAS, the defendants are renting the house located at ---, where they are presently
residing, and plaintiff is the owner thereof;

WHEREAS, the plaintiff demanded for the defendants to vacate the premises of the
subject property for failure to pay the total monthly rentals of P60,000.00 for the period of six
months starting December 2019.

WHEREAS, the parties desire to settle the above captioned case between themselves
without resorting to further litigations and to that end are willing to enter into this compromise
agreement.

NOW THEREFORE, in consideration of the foregoing premises, and in full settlement of


their respective claims against each other as follows:

1. The plaintiff agreed to allow the Defendants to continue occupying the subject
property under the condition that the defendants should pay the first three months’ worth of
arrears amounting to Thirty Thousand Pesos (PHP 30,000.00) on the 20th of June.
2. The remaining arrears of P30,000.00 plus interest of P10,000.00, amounting to Forty
Thousand Pesos (PHP 40,000.00) shall be paid equally every 20th of the month, starting July.
3. Mediation fees and damages are waived.
4. In default of this agreement, the Defendants shall be automatically ejected from the
property and shall pay the total amount of Seventy Thousand Pesos (P70,000.00) in full.
5. The signatories to this Agreement hereby represent and warrant that they are duly
authorized to execute this Agreement.
6. The parties or their assigns hereby waive and renounce claims and interest against each
other and the same shall be the full and complete settlement of the above-mentioned case.
7. The foregoing covenants are not contrary to law, morals, or public policy and the
parties bind themselves to comply strictly with their undertakings.
