Dear FOIA Officer:
This is a request under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552. I
represent Second Amendment journalist John Crump1 in this request.
In a February 17, 2021 article, Mr. Crump noted that some Industry Operations
Investigators (IOIs) have been temporarily assigned to assist with National Firearms Act document
processing. See https://www.ammoland.com/2021/02/atf-iois-temporarily-with-the-nfa-division-
are-not-hitting-target-metrics/. The article also references “target metrics”, presumably for official
NFA Division employees who process NFA Forms (including tax paid transfers Forms 1 and 4).
With that in mind, and because the information sought is believed to be with your agency, Mr.
Crump hereby requests the following information:
1) Records related to how a legal instrument examiner is evaluated related to “target
metrics” on the NFA Forms he/she processes, including how many NFA Forms an
examiner is expected to complete and/or process in a given time period (whether
weekly, monthly, etc.);
2) Records related to the time frame of how long an average Form 1 and Form 4 take to
be processed, including but not limited to expected timeframes versus actual time
frames over the last 4 (four) years;
3) Records related to Industry Operations Investigators’ (IOIs) requests to be assigned to
the NFA Division, requests to be reassigned out of the NFA Division, and instructions
to those IOIs assigned to the NFA Division related to not meeting “target metrics” for
the NFA Division; and

Mr. Crump requests a fee waiver as the requested materials are greatly in the public interest,
and because the requested records will be distributed free of charge on the internet and will increase
the public’s awareness on ATF processes and procedures surrounding the National Firearms Act.
Additionally, because Mr. Crump would be considered “media”, he is entitled to a fee waiver. See
Edmonds Inst. v. DOJ, 460 F. Supp.2d 63, 72 (D.D.C. 2006); Votehemp, Inc. v. DEA, 237 F. Supp.
2d 55, 58 (D.D.C. 2002). If our request for a fee waiver is denied, Mr. Crump is willing to pay up
to $100 for the processing of this request. If the amount for processing will exceed $100, we
request a written estimate of the costs.
Pursuant to FOIA, Mr. Crump anticipates your response within 20 (twenty) business days.
