Uponarrivalatapproximately 8:20pm, asecureperimeter hadbeenestablished. Therewere (3)other
lawenforcement vehicleswithinthescenewhichhadresponded andwerenotinvolved. One
vehicleparkedonthesouthbound shouldernorthofthescenecontained Officer #10.Anothervehicle
parkedinthenorthbound lane,justnorthofOfficer #1'svehiclecontained Officer #6andOfficer
8.Thethirduninvolved vehiclewasjustsouthofOfficer #1'svehicleandcontained Officer #5.I
requested all 3

sceneon (US)Highway395.DCSO1hadnewinformation onwheretolookforspentammunition
casings.
Wearrivedonsceneatapproximately 3:05pmandIassistedhimwithrecordingadrivingscenariointo
thescene. (RefertoDCSOreportandrecording). Wewereassistedbypatrolunitsfortrafficcontrol.
IassistedDCSO1whilehesearchedthescenewithametaldetector. Helocatedaspent .223casing
andalso, whatappearedtobeabulletfragment. Hephotographed andpackaged bothforevidence.
Duringthecourseofthissearch, DCSO1tookseveralphotographs. Hiscameramalfunctioned. He
removedtheSDCardandIplaceditinmycameraforhisuse.Attimes, Itookphotosofothernon-
essentialitemsthathadbeenlocated. Oncecomplete, IgavetheSDCardbacktoDCSO1.
Weclearedthesceneatapproximately 4:50pm.

Officer12.Priortotheinterview, wewereinformed thatOfficer12hadnotdischarged hisweaponand
wasjustawitnessofficer. Wewerealsoinformedthatofficers hadleftthescene.
Officer12waspartofthecombined arrestteammadeupoftheFBIandOSP.
Officer12madethefollowinginsubstancestatements:
HewasinanFBIvehicleassignedtotheroadblockteamthatwassetupnorthoftheprimaryarrest
spot.
Theroadblockteamwasassignedtopreventthesuspectsfromevadingtheprimaryarrestteam. The
roadblockteam’svehiclesallhadtheiremergency lightson.
Officer12wasmonitoring theradioandheardtheinitialtrafficstopoccur. Acoupleminutesintothe

trafficstop, itwasbroadcast thatthewhiteDodgeRamwaseluding. Duringoneoftheradio
broadcast’s,heoverheard someoneyellingthatthepoliceweregoingtohavetokillthispersonandthe
policewerenotgoingtostophim.
Officer12witnessed theDodgecomingaroundthecorneratahighrateofspeed, Officer12
immediately knewthevehiclewasnotgoingtostop. Officer12heardthevehicleaccelerate. The
vehicletriedtoevadethespikestripsbydrivingintothewestshoulderandthenbecamestuckinthe
snow. Officer12statedhesawoneoftheFBIagentsalmostgetstruckbythevehicle. Theagentthat
wasalmosthit,gotcoveredinsnowthatwasthrownonhimfromthevehicle.
LaVoyexitedthevehicle; hishandswereraisedbutwasnotbeingcompliant withorders. LaVoywas
yellingthatthepoliceweregoingtohavetokillhim,theywerenotgoingtotakehimaliveandthe
policeweregoingtohavetoshoothim.
Officer12statedLaVoywasaggressively approaching theTrooper. Officer12heardtheTroopergiving
orderstoLaVoytoputhishandsintheair,stop, anddon'tmove. Similarcommandswerealsobeing
giventoLaVoybyotherLawEnforcement Officers.
Officer12witnessed LaVoy'shandscomedown, Officer12turnedhisattentionbacktothesafetyof
theagentwhowasalmosthitandcoveredinsnow, asthatagentwasincloseproximitytotheFord
andwastryingtogetbacktocover.Duringthistime,Officer12heardgunshots, helookedbackat
LaVoyandLaVoyhadbeenshot.
Officer12didnotstatehefiredanyshots.
IinquiredofOfficer12ofwhatknowledge hehadoftheindividuals whowereintheDodgeandJeep.
Officer12statedthearrestteamwastoldtoexpectallindividualsinbothvehiclestobearmedand

OnJanuary 26,2016,atapproximately 11:15pm,myselfandInvestigating OfficerS

interviewed Officer13. Priortotheinterview, wewereinformedthatOfficer13hadnotdischarged his
weaponandwasjustawitnessofficer. Wewerealsoinformed thatofficershadleftthescene.
Officer13wasinanOSPvehiclewithtwoTroopers. Thatvehiclewastheleadvehiclethatwas
assignedtoinitiatethetrafficstopandbepartofmakingthearrests.
TheDodgeRamwastheleadvehiclewhiletheJeepwasfollowing theDodge.
Thearrestteamvehiclesinitiated atrafficstop, theJeepstoppedimmediately buttheDodgecontinued
todriveforashortdistance. Officer13statedthevehiclehewasin,alongwiththearrestvehicle
directlybehindhimbrokeofffromtheJeepandfollowedtheDodge. Officer13statedthatthisdecision
tobreakoffwaspreplanned, ifoneofthesuspectvehiclesdidnotstop.
Eventually theDodgestopped, andLawEnforcement Officersweregivingcommands totheoccupants
oftheDodgetofollow. ThedriveroftheDodge, lateridentifiedasLaVoy, wasyellingouthiswindow
thatLawEnforcement wasgoingtohavetoshoothim.
RyanPayneeventually exitedthevehicleandwascompliant withorders, hewastakenintocustody.
Theotherindividuals intheDodgewerenotcompliant.
TheDodgethenaccelerated andbegantoelude.
AstheywerefollowingtheDodge, theDodgecamearoundthecornerandsawtheroadblock. The
DodgethenacceleratedandOfficer13believedtheDodgewasgoingtoramtheroadblockandatthe
lastsecondtheDodgeswervedtotheleftandwentintothewestshoulder.
LaVoyexitedhisvehicleandwasyelling, atthistimethevehicleOfficer13wasin,arrivedattheroad
block. LaVoystartedtoturnandhishandwenttohiswaistarea. Officer13believedthatLaVoywas
reachingforaweapon. Officer13thenheardacoupleofshotsandsawLaVoyfall.
Officer13statedthatLawEnforcement Officersweregivingcommands toLaVoypriortotheshots, but
hedidnotobeythem. Thosecommands weresimilartoputyourhandsupandstop.
Officer13didnotstatehedischarged hisfirearm.
Officer13statedthearrestteamwastoldtoexpectallindividualsinbothvehiclestoarmedand
dangerous. IndividualswithintheDodgehadtalkedaboutdefending themselves fromLaw
Enforcement Officers.

Officer11statedthatheheardovertheradiothatthesuspectvehicleshadinitiallystopped. Itwasthen
broadcasted thattheDodgewaseludingandtravelingtowardthem. Officer11tookhispostbehindthe
vehiclethatwasparkedinthesouthbound lane. AstheDodgecamearoundthecorner, itaccelerated
towardtheroadblockteam. TheDodgecontinued toaccelerate andbasedonhowtheDodgewas
traveling heheardsomeoneyellthatitwasgoingtoramtheroadblock.
Theplanwasforallroadblockteammemberstomovetotheeastboundshoulder, ifthevehicledid
notstopfortheroadblock, butOfficer11believedhewasnotgoingtohavetime,sohemovedtothe

Ashewastryingtodighiswayoutofthesnow, Officer11heardtheTroopertothesouthgivingsome
sortofcommands. Officer11didnotknowwhatthosecommands were, ashewasextremely closeto
thepassenger sideoftheDodgeandwasfocusingonthat,whiletryingtogetbacktocover.
Asheunburiedhimselfandstartedtoheadforcover,heheardsomeoneyellingthatthepolicewere
goingtohavetoshoothim.Officer11hadgottenbacktocoverandthensawLaVoyfall.
Theotherindividuals inthevehiclewerenotcompliant andTroopers weretryingtouselesslethalforce
togetcompliance fromthoseindividuals.

Officer9saidheheard, viaradio, thattheDodgetruckhadfledthetrafficstopandwasheading

OnJanuary 26, 2016, atapproximately 6:10pm, myself andInvestigating Officer D,Officer
H,and Officer Sresponded totheHarney County District Hospital tophotograph andcollect
evidence from Ryan Bundy when hearrived viaambulance.
Iwasassigned tophotograph Ryan Bundy andsupport theefforts oftheother detectives as
needed.
Ryan Bundy arrived atapproximately 7:00pm. When Ryan Bundy gotinto theEmergency
Department, Ibegan taking overall photographs ofhim. Investigating Officers DandS
collected evidence asnurses removed clothing andother items from Ryan Bundy.
Inoted thatwhen thenurses were removing clothing, two .38special caliber bullets fellfrom
thegurney onto thefloor. They were collected byoneofthedetectives.
Iwasable totake several close-upphotographs ofRyan Bundy’swound. Inoted thatsmall
right shoulder wound wastheonly visible injury onRyan Bundy. The physician originally
thought theinjury was caused byapiece ofglass, butlater discovered asmall amount ofmetal
shrapnel inhisouter-right arm, approximately twoinches below thelaceration which was on
thetopofhisrightshoulder. Refer totheincluded CDofphotographs fordetails.
Iheard physicians saythatRyan Bundy’sinjury was superficial andhedid notrequire any
additional medical treatment.
Ryan waslater transported totheMultnomah County Jailwhere hewaslodged.

TheMedicalExaminerInquiredaboutexaminingthebodypriortothemajorcrimesteamarriving. IexplainedI

Examineradvisedthatwouldbefine.
Ireceivedtwohandgunsthatweresecuredduringtheincident. Ireceivedthefirstoneatapproximately
7:35PMfromInvestigatingOfficerV.
ThefirsthandgunwasaFNPistolwithamagazinetakenfromPayne, thepassengerofthewhite
truck. Whentheweaponwasmadesafeitwasreportedtherewasnotaroundinthechamberanda
magazineinthegun. InvestigatingOfficerValsoprovidedmewithPayne’shat,wallet,2xinkpensand
ablackfoldingknife.
Asmallbrasscylindricalobjectwasalsoprovidedthatwasreportedlytakenfromoneofthe
Bundy’s.
Atapproximately7:40PM, IreceivedthesecondpistolfromOfficer #6.
ThesecondhandgunwasaSigSauerwithananchorEmblemonitsecuredfromthedriveroftheJeep
nofurtherinformation. Thehandgunhadalightonitandthereweretwomagazineswithit. When
theweaponwasmadesafeitwasreportedtherewasaroundinthechamberandamagazineinthe
gun.
Theevidencewassecuredinthebackof InvestigatingOfficerL'sSUV,thatwewerebothridingin.
Atapproximately8:03pm,IspokewithDCSO7. Iwasadvisedhewasgoingtobeinchargeofthecrimescene.
IaskedhimifhewouldliketheMedicalExaminertoproceedwithherprocessorwaituntiltheywereonscene
andprotecttheintegrityofthescene. Herequestedthescenebesecureduntiltheircrimeteamarrival.

OnJanuary 26, 2016atapproximately 5:00pm Iwasnotified ofanofficer involved shooting

onHwy395nearMP51.Myself andInvestigating Officer "I"responded tothescene fromthe
JohnDayPatrolOffice, inthesame vehicle, atapproximately 5:20pm. Myself and
Investigating Officer "I"arrived atthescene atapproximately 6:50pm andsigned intothe
Oregon State Police crimescene logshortly after.
Employee AAandEmployee BBarrived along withthelead Deschutes County Detective, I

assisted them attheirdirection. During thecourse oftheirinvestigation Iassisted inasearch
forevidence onthehighway andonboth sides ofHighway 395. Evidence was labeled with
yellow markers either bynumber orbyletter. Ialsoassisted Investigating Officer T,anda
separate Deschutes County Sheriff'sOffice Deputy withthemarking ofevidence near
thebody ofRobert "LaVoy" Finicum, withtheuseofthetotalstation reconstruction system.
After allpotential evidence surrounding Finicum wasphotographed, documented and

collected byOSP forensics, Employee AAasked metomove thebodyofFinicum tobeableto
photograph anypotential evidence located between Finicum'sbodyandthesnow. I
proceeded torollFinicum’sbody ontohisrightsideformorephotographs. AsIrolled Finicum
ontohisrightsideInoticed ablack incolor, pistolgripwithin aninside pocket ofFinicum’s
jeanjacket. Thepistol gripbecame visible when theleftside ofFinicum'sjeanjacket opened,
while rolling himontohisside. Finicum’sjeanjacket was hisoutermost layerofclothing.
Ileftthepistol inplace while itwasphotographed byOSP Forensics. After being

photographed anddocumented, Iremoved theRuger hand gunfromFinicum'sjacket pocket.
Ithenremoved themagazine fromthehand gun. Ipulled theslideonthefirearm totherear
ofthegunandnoticed theweapon hadachambered round. Iremoved thechambered round
fromtheweapon rendering theweapon safe forcollection bytheOSPForensics. Ialso
removed Finicum'swallet fromtherearpocket ofhisblue jeans. Theinterior contents of
Finicum'swallet wasphotographed, documented, andcollected byOSPForensics.

OnFebruary 6,2016atapproximately 10:30AM,myselfandInvestigating OfficerKre-interviewed
Officer9,Officer11,andOfficer12. Theinterviews wereconducted atthecommand postinBurns. All
mentioned officersareemployed withtheFederalBureauofInvestigation (FBI)asSpecialAgentson
theHostageRescueTeam (HRT). Allmentionedofficerswereinvolved withtheroadblockonUS395
nearmilepost51,whichresultedinthedeathofRobertLaVoyFinicum. Allmentioned officershad
previously beeninterviewed.
Beforetheinterviews wereconducted, allmentioned officersstatedthattheywantedtobeinterviewed
asagroup. Theytoldmetheywantedtheirattorney presentonspeakerphone, andtheydidnotwant
tobeaskedanyquestionsthattheyhadpreviously beenaskedwithoutbeingabletoreference
statements fromtheirpriorinterviews.
Theinterviews werenotrecorded, andtheirattorneywaspresent duringtheinterviews.

Officer12sawonespentbulletcasingonthegroundaftertheshooting. Hecouldnotremember
whatcaliberorexactlywherethecasingwaslocated.
Noneoftheotherofficerssawanyspentbulletcasingsatthescene.
Theystatedthetruckswereimmediately movedfromthesceneduetothefactthattheywere
putbackintoservicetoprotectthesouthernroadblockduetoinformation thatitwasbeing
overrunbymilitia. Theywerelaterdispatched tothenorthcheckpointforthesamereason, and
onetruckwassenttoescortanODOTtrucktothesceneduetomilitiainterference.
IshowedtheofficersastillframeoftheincidentvideoatthepointthewhiteDodgeRam, driven
byFinicum, enteredthesnowbank. Theofficerscouldnotrecalltheirlocationsatthattime,with
theexception ofOfficer11,whowasalmoststruckbyFinicum'struck.

OnTuesday January 26,2016 atapproximately 3:30PM, Iwascalled infordutyand
initially reported totheCommand Post intheLincoln Junior High building inBurns. At
about 4:35PM, Myself andInvestigating Officer "II"were instructed togotoabout
milepost 52CUS-395. Arriving atabout 4:48PM, Iobserved athenunidentified male
laying inthesnow offthesouthbound shoulder being attended tobyonscene
personnel andthesuspect's white Dodge Pickup buried inthesnow. Iwasinstructed
byOfficer #3toestablish anorthern roadblock above thescene. Iobserved theroad
wasblocked byasilver pickup inthesouthbound laneandadarker colored pickup in
thenorthbound laneaswellasasetofspike strips. Iremoved thespike strip and
loose spikes from it's location across thenorthbound lane ofUS-395andplaced iton
theedgeoftheroadway whileaSWAT Team member moved thepickup blocking the
northbound lane. Myself and Investigating Officer "II"then drove north and
established aroadblock atabout milepost 49ConUS-395.
Atabout 10:00PM, Iwascalled tomeasure thescene oftheOfficer Involved
Shooting. Atabout 1:17AMtheInvestigation Team fromDeschutes County arrived
onscene. Icoordinated withtheDeschutes County Reconstructionist whorequested
thatImeasure thescene using myTotal Measuring Station. Imeasured thescene,
documenting allevidence asdirected bytheDeschutes County Investigators. I

milepost51onU.S.Highway395inHarneyCounty, Oregon.
Withthisinformationathand, Iwastaskedwithrespondingtothecrimesceneandassistingwhile
theyworkedwithDeschutesCountySheriff’s Officetotaketheleadontheinvestigation.
Duetothelocation oftheofficerinvolvedshootingandthefactthatitwasalreadystartingtogetdark,
IdrovetoFrontierRentalInc.inMountVernonandrentedatowablelighttowertohelplightupthe
crimescene. AfterIobtainedthelighttowerIrespondedtothecrimesceneandarrivedat
approximately 8:15pm.
Uponarrival, InoticedseveralunmarkedSWATandFBIHRTvehiclesblockingtheroadwayand
surrounding theOfficer1’s pickupaswellastherestofthecrimescene. Whileonscene, Icontacted
Officer6andhe/shetoldmethatthepickupbelongingtoOfficer1wasnotmovedsincetheincident
tookplace. He/shetoldmethathis/herunderstanding thirdhandwasthatOfficer1firedintothe
vehicleasitwascomingattheroadblock. He/shealsostatedthattheinformation he/shereceived
thirdhandwasthatOfficer2shotLevoyFinicum. Officer6thenshowedmethegeneralareatothe
southofOfficer1’s vehiclewherehe/shebelievedOfficer2waswhenhe/sheshot. Officer6then
wentontotellmeallthevehiclesexceptforOfficer1’s vehiclehadbeenmovedimmediatelyafterthe
shootingforsafetyduetothefactthattherewerestilloccupantsinsideofFinicum’s truckwhichwere
notcomplyingwithcommands.
Next, IspokewithOfficer4. Officer4toldmethathe/shewaspartoftheinitialtrafficstopteamthat
wastryingtoaffectthearrestofthesuspectsfrombothvehiclesjustsouthofthislocation. Officer4
toldmethathe/shewasthedriverofanOregonStatePolicevehiclebelongingtoOfficer2whowas
thepassenger. Officer4toldmethatafterFinicumleftthetrafficstoplocationtheyfollowedintheir
SWATvehicleandarrivedonsceneimmediatelyafterFinicumdroveintotheditch. Officer4toldme
thathe/shewasonsceneduringtheshootingincidentandthathe/shebelievedOfficer2firedat
Finicumfromsomewhere betweentheirstoppedvehicle’s passenger sideandOfficer1’s vehicle.

Atthistime, Ipulledforwardtothesouthsideofthecrimescenetothesouthofthespikestrip
locationandIsetuptheworklightsonthetrailertoproperlyilluminatethescene. Ithenworkedwith
Investigating OfficerAtomaintainscenesecuritywhilewewaitedformembersoftheDeschutes
CountySheriff’s Officewhoweretobetheleadinvestigating agencyfortheshootinginvestigation.
Intheearlymorninghours, Investigating OfficerDCSO1withtheDeschutesCountySheriff’s Office
arrivedonscene. UponspeakingwithDCSO1,hestatedthathewasassignedastheleadDetective.
IexplainedtoDCSO1thatmyselfandInvestigating OfficerAhadseveralinvestigators onsceneand
wewouldprovidewhateverassistancethatheneeded. InvestigatingOfficerDCSO1 wasthenbriefed
bymyselfandwalkedthroughthescene. Duringourwalkthrough Irelayedtheinformation Ireceived
fromOfficer4andOfficer6.
Whileonscene, IassistedDCSO1andtheOSPCrimeLabstaffastheysearched, tookevidenceand
processedthescene.

drivenbyLaVoyFinicumdroveaway. Officer #15advisedmetonotifydispatch oftheoccurring
situation, whichIdid. Ashorttimelater, Iwastoldtorespondtothesceneandthattherewaspossibly
anofficerinvolvedshooting.

WhenIarrivedonscene, westoppedbrieflyattheoriginalstoplocationwherethesuspectsinthe
Jeepweredetained. Wethenwentaroundthatstopandbegantoheadtothesecondscenewhere
theshootinghadoccurred. Justpriortothescene (south), Iwastoldtogobacktothesouthandassist
withtrafficcontrol. Iwentsouthofwherethejeepwasstoppedandassistedwithgettingvehicles
turnedaroundknowingtherewouldbeanextendedclosurefortheinvestigation. Ialsomadesurethat
areporter whohadarrivedonscene, stayedoutofthecrimesceneandkepttheroadwayclearfor
responding medicalpersonnel.
Iremainedatthatlocation until (US)Hwy395Cwasclosedat (US)Hwy20bylawenforcement and
OregonDept.ofTransportation peronnel andtraffichadstoppedarriving. At18:34,Ileftthesceneand
responded tobacktothecommand post. Iwasbehindthetransportvanthatwascarrying suspects

approximately 10:45pm. Icontacted theAgentinchargeoftheTOCandrequested thatanagentmeet
meatthejailtoprocessthesuspect.
OnFebruary11,2016myself, Investigating OfficersOO,PPandQQ,wererequested totransportfour
FBIcustodies totheMultnomahCountyJail.Investigating OfficerPPtransported two
