Uponarrivalatapproximately 8:20pm, asecureperimeter hadbeenestablished. Therewere (3)other
lawenforcement vehicleswithinthescenewhichhadresponded andwerenotinvolved. One
vehicleparkedonthesouthbound shouldernorthofthescenecontained Officer #10.Anothervehicle
parkedinthenorthbound lane,justnorthofOfficer #1'svehiclecontained Officer #6andOfficer
8.Thethirduninvolved vehiclewasjustsouthofOfficer #1'svehicleandcontained Officer #5.I
requested all 3

itemsintohisdepartment vehicle. Weleftthereatapproximately 2:40pmandwentbacktotheroadway
sceneon (US)Highway395.DCSO1hadnewinformation onwheretolookforspentammunition
casings.
Wearrivedonsceneatapproximately 3:05pmandIassistedhimwithrecordingadrivingscenariointo
thescene. (RefertoDCSOreportandrecording). Wewereassistedbypatrolunitsfortrafficcontrol.
IassistedDCSO1whilehesearchedthescenewithametaldetector. Helocatedaspent .223casing
andalso, whatappearedtobeabulletfragment. Hephotographed andpackaged bothforevidence.
Duringthecourseofthissearch, DCSO1tookseveralphotographs. Hiscameramalfunctioned. He
removedtheSDCardandIplaceditinmycameraforhisuse.Attimes, Itookphotosofothernon-
essentialitemsthathadbeenlocated. Oncecomplete, IgavetheSDCardbacktoDCSO1.
Weclearedthesceneatapproximately 4:50pm.

Officer11statedthatheheardovertheradiothatthesuspectvehicleshadinitiallystopped. Itwasthen
broadcasted thattheDodgewaseludingandtravelingtowardthem. Officer11tookhispostbehindthe
vehiclethatwasparkedinthesouthbound lane. AstheDodgecamearoundthecorner, itaccelerated
towardtheroadblockteam. TheDodgecontinued toaccelerate andbasedonhowtheDodgewas
traveling heheardsomeoneyellthatitwasgoingtoramtheroadblock.
Theplanwasforallroadblockteammemberstomovetotheeastboundshoulder, ifthevehicledid
notstopfortheroadblock, butOfficer11believedhewasnotgoingtohavetime,sohemovedtothe
westboundshoulder. Ashedidso,theDodgeswervedtothewestandwentintothewestside
shoulder. Officer11believedhewasgoingtobestruckbytheDodgesohedecidedtotuckandroll
hopingtolimittheimpact. Ashedid,hebecame buriedunderthesnowthatwasshotoverhimfrom
theDodge. Officer11believedtheoperatoroftheDodgedidnotcareaboutthelivesoftheLaw
Enforcement Officers.
Ashewastryingtodighiswayoutofthesnow, Officer11heardtheTroopertothesouthgivingsome
sortofcommands. Officer11didnotknowwhatthosecommands were, ashewasextremely closeto
thepassenger sideoftheDodgeandwasfocusingonthat,whiletryingtogetbacktocover.
Asheunburiedhimselfandstartedtoheadforcover,heheardsomeoneyellingthatthepolicewere
goingtohavetoshoothim.Officer11hadgottenbacktocoverandthensawLaVoyfall.
Theotherindividuals inthevehiclewerenotcompliant andTroopers weretryingtouselesslethalforce
togetcompliance fromthoseindividuals.
IinquiredofOfficer11ofwhatknowledge hehadoftheindividuals whowereintheDodgeandJeep.
Officer11statedthearrestteamwastoldtoexpectallindividualsinbothvehiclestoarmedand
dangerous. Hehadheardtheywerewillingtokillandbekilled.

OnJanuary 26,2016, atapproximately 6:10PM, myself andInvestigating
Officers D,G,andHmetatHarney County District Hospital inBurns,
Oregon andwereassigned todocument andcollect evidence froma
suspect involved inanofficer involved shooting incident onUS395, in
Harney County. Wewereinitially toldthatoneinjured suspect wasbeing
transported viaground ambulance toHarney District Hospital. Wemetwith
hospital staffandmembers fromtheFBIwho wereperforming security at
thehospital anddetermined thatthesuspect was goingtobearriving atthe
Emergency Room.
Webriefed andassigned tasks. Myself andInvestigating Officer Dwere to
conduct theactual collection anddocumentation ofphysical
evidence. Investigating Officer Gwastophotograph thesuspect and
available evidence. Investigating Officer Hwastoperform oversight and
organization oftheevidence collection process.
Wethensetupourevidence kitatExam Room #3intheemergency room
ofthehospital andwaited forthesuspect'sarrival.
Atapproximately 7PM, thesuspect arrived viaambulance, andwasbrought
intotheemergency room. Thesuspect wasthenidentified asRyan Bundy.
IsawRyan Bundy lyingdown ontherolling gurney astheybrought himinto

theemergency room andtreatment area. Icould seeBundy wasawake,
withhiseyes open.
IthensawanEMS member intheemergency room entrance areawith
whatappeared tobetwobagsofBundy's personal items. Heidentified
himself asJeffery Scerine withdateofbirth andprovided his
contact information. Mr. Scerine stated hewastheEMSManager andthat
hehadreceived thebagsofpersonal items fromtheEMSstaffing the
ambulance inwhich Bundy wastransported. Mr. Scerine identified the
ambulance staffas "Greta Emang" (Paramedic), "KimHill" E ( MT), andHerb
Vloedman (EMT-Ambulance driver). Atapproximately 7:04PM, Itook
control ofthebagsfromMr.Scerine. Isawoneofthebagswasaplastic
shopping bagtiedshut, withthename "Ryan Bundy" written onit. Ilater
sawwhatappeared tobe "Contents onPerson andJacket" wasalsowritten
inmarker onthatbag. Theother bagappeared toonlycontain acowboy
hat. Myself andInvestigating Officer Dsecured those items intoExam
Room #3.
Ithenwalked overtowhere Bundy wasbeing treated andwashanded
various clothing items frommedical staffastheyremoved itfromBundy. I
immediately then handed theitems toInvestigating Officer Dwhoplaced
theitems intoevidence bags (Icould seethatInvestigating Officer Gwas
actively taking photographs ofBundy andclothing items andInvestigating
Officer Happeared tobetaking video withacellular phone). Asafemale
medical staffwasremoving Bundy's pants (dark jeans), items felloutofthe
pocket andontothegurney andE.R.floor. Isawthatthose items weretwo
rounds of 3. 8Special ammunition. Investigating Officer Gtookphotographs
ofthemandInvestigating Officer Dplaced them intoanevidence bag. I
thenremoved anyremaining contents fromBundy's jeans, before Officer
Dplaced thejeans intoanevidence bag. Those items consisted ofaplastic
comb, candy wrapper, dime, penny, nickel, andpieces ofdarkcolored
broken glass (thatappeared consistent withvehicle window
glass). Investigating Officer Dthenplaced those items intoanevidence
bag. Icontinued tocollect clothing items astheywereremoved fromBundy
bymedical staff andthen Investigating Officer Dplaced those items into
evidence bags. Evidence items E1,E2, E3, E4,E5, E6, E7, E9,andE10
wereallitems collected directly from Bundy's person intheemergency
room (refertoOregon StatePolice Property Report FormPage 1).
Myself andInvestigating Officer Dthencontinued todocument andlog
evidence items inExam Room #3. Itookphotographs ofBundy's personal

Myself andInvestigating Officer Dfinished logging anditemizing the
evidence atapproximately 9:30PM. Wethen secured theevidence items
inInvestigating Officer D's vehicle anddrove them totheOregon State
Police Burns Patrol Office. Wesealed alloftheevidence bags andlocked
them intothetemporary evidence lockers attheOregon State Police

Officer9toldmehewasthoroughlybriefedpriortotheincidentandwaswellawareofthethreats
presentintheDodgetruckandtheJeep. Heknewallsuspectswerearmed, withthepotentialof
additional gunsbeingpresent. Hetoldmeheknewthesuspects, whotheybelievedtobeinthe
vehicles, carryfirearmsontheirperson. Hetoldmehehadseenthosesuspectswearingfirearmsin
numerous onlinevideoswhichhehadviewedinthepast. HeknewthatLaVoyFinicumhadmade
numerous statements indicating thathewouldratherdiethangotojail. HehadseenFinicumcarrya
varietyoffirearmsinthevideos. Officer9saidheknewtherewasahighlikelihoodthatFinicumwould
beintheDodgetruck. Officer9knewthattheDodgetruckbelongedtoFinicum. Heknewthatthe
majorplayers” involvedinthetakeoverofthewildliferefugewouldbeintheDodgetruckandtheJeep.
Officer9saidheheard, viaradio, thattheDodgetruckhadfledthetrafficstopandwasheading
towardsthemwithofficer’sinpursuit.
Officer9statedhecouldheartheDodgetruckcomearoundthecornertowardstheroadblock. He
saidhecouldheartheengineaccelerating, andcouldseethetruckaccelerating towardsthem. Hefelt
thattheDodgetruckwasgoingtocrashthroughtheroadblock. HecouldseetheDodgewasnot
stoppingsohequicklytraversedtohisleft (east)andoffoftheroadway.
Officer9estimated theDodgetruck’sspeedat70-80milesperhour.
Officer9toldmetheyhaddiscussed thecontingencies, andhadallplannedtomoveofftheleft (east)
shoulderifthevehicleintendedtocrashthroughtheroadblock.
Officer9toldmehethoughtthedrivermayhaveseenthespikestrips, whichwerepositioned infrontof
theroadblock, andabruptlyswervedtothewestandoffoftheroadwayintoasnowbank.
Officer9statedaftertheimpactoftheDodgetruckintothesnowbank, hewitnesses hispartner,
Officer11,benearlystruckbytheDodgetruck. Hesaidinitially, hethoughthispartner, Officer11,was
hitbytheDodgetruck,andhemovedintoapositiontorescuethedownedHRTagent.
Officer9toldmethathewasveryconcerned forthesafetyofhisteammate, whowasonhisbackand
exposed tothesuspectsinthevehicle.

Whenaskedwherehewasduringtheevent,Officer9statedthathemovedaroundalot,andwas
unsureofhispositionsduringtheevent. Officer9reiterated thatheheardlotsofcommands being
giventothesuspects, andthatthesuspectswerenotcomplying.
Officer9statedthathesawthedriver’s dooropenandFinicum exit. HestatedhesawFinicum
approaching officers. Hesaidheheardseveralcommands beinggiventoFinicumincluding, “Dropit.”
HesaidheheardFinicumsay, “Yourgonnahavetokillme,”alongwithexplicitlanguage.
HesaidhesawFinicumdisobey commands andcontinuewalkingtowards officers. Hesaidheheard
shotsandsawFinicumfalltotheground.
Officer9indicateditwasdifficulttohearduringtheeventasthetruckenginewasstillrunningand
revving. Hestateditwasdifficulttoseeinsidethewindowsofthetruckbecausetheyweretinted,
whichwasasafetyconcern forhim.
Whenasked, Officer9toldmehewasunsurewhichofficershotandunsureiftherewereothershots
thatwerefired. Hestatedthatthesituationunfoldedveryfastandofficershadlittletimetorespond.
Duringtheevent,Officer9alsoexpresses concernsthathewasunawareofthestatusoftheJeep, and
wasworriedthattheremightbemorethreatspresentiftheJeeparrivedonscene.
Officer9saidtheyfocusedtheirattention ontheoccupants intheDodgetruck. Hesaidotherofficers
weregivingcontinualcommands tothesuspectswhowerestillinthetruck.
Officer9toldmethateventually, twofemalesandonemaleexitedtheDodgetruckandweretakeninto
custody.
Officer9toldmethatFinicumhadclearintentions torunoverOfficer11,clearintentions torunthrough
thebarricade, clearintentionsthathewasnotgoingtoconsent toarrest, andnotedthatFinicumwas
uncooperative andverbally combative toofficers.

involvedshootingandsecurethescene. ThescenewaslocatedonHighway395approximatelymilepost51C. I
wasadvisedthattheDeschutesCountyMajorCrimeTeamhadbeenactivatedandwouldbeenroute.
MyselfandInvestigatingOfficerLarrivedonsceneatapproximately6:45pm. Whiledrivingtothescenewe
observedajeepparkedonthenorthboundshoulderoftheroad. ItookpicturesoftheJeepbearingArizona
registrationplate:AZA7828. Nothingwastouchedinthejeep,anditwasleftasitwasfound.
Wedrovenorthbound ontheroadforapproximatelyonemoremileuntilwereachedthesiteoftheofficer
involvedshooting. MyselfandInvestigatingOfficerLparkedatthesouthendofthecrimescenetosecureit.
IhadcontactwiththeHarneyCountyMedicalExaminer. TheMedicalExamineradvisedanarrivaltimeof
approximately 6:31pm.
Itookphotosofthescenethatwerelaterenteredintoevidenceas I(nvestigatingOfficerCinitials)E-1.
TheMedicalExaminerInquiredaboutexaminingthebodypriortothemajorcrimesteamarriving. IexplainedI
wouldratherwaituntilthemajorcrimesteamwasonscenetoprotecttheintegrityofthescene. TheMedical
Examineradvisedthatwouldbefine.
Ireceivedtwohandgunsthatweresecuredduringtheincident. Ireceivedthefirstoneatapproximately
7:35PMfromInvestigatingOfficerV.
ThefirsthandgunwasaFNPistolwithamagazinetakenfromPayne, thepassengerofthewhite
truck. Whentheweaponwasmadesafeitwasreportedtherewasnotaroundinthechamberanda
magazineinthegun. InvestigatingOfficerValsoprovidedmewithPayne’shat,wallet,2xinkpensand
ablackfoldingknife.
Asmallbrasscylindricalobjectwasalsoprovidedthatwasreportedlytakenfromoneofthe
Bundy’s.
Atapproximately7:40PM, IreceivedthesecondpistolfromOfficer #6.
ThesecondhandgunwasaSigSauerwithananchorEmblemonitsecuredfromthedriveroftheJeep
nofurtherinformation. Thehandgunhadalightonitandthereweretwomagazineswithit. When
theweaponwasmadesafeitwasreportedtherewasaroundinthechamberandamagazineinthe
gun.
Theevidencewassecuredinthebackof InvestigatingOfficerL'sSUV,thatwewerebothridingin.
Atapproximately8:03pm,IspokewithDCSO7. Iwasadvisedhewasgoingtobeinchargeofthecrimescene.
IaskedhimifhewouldliketheMedicalExaminertoproceedwithherprocessorwaituntiltheywereonscene
andprotecttheintegrityofthescene. Herequestedthescenebesecureduntiltheircrimeteamarrival.

ACTIONTAKEN
OnTuesday January 26,2016 atapproximately 3:30PM, Iwascalled infordutyand
initially reported totheCommand Post intheLincoln Junior High building inBurns. At
about 4:35PM, Myself andInvestigating Officer "II"were instructed togotoabout
milepost 52CUS-395. Arriving atabout 4:48PM, Iobserved athenunidentified male
laying inthesnow offthesouthbound shoulder being attended tobyonscene
personnel andthesuspect's white Dodge Pickup buried inthesnow. Iwasinstructed
byOfficer #3toestablish anorthern roadblock above thescene. Iobserved theroad
wasblocked byasilver pickup inthesouthbound laneandadarker colored pickup in
thenorthbound laneaswellasasetofspike strips. Iremoved thespike strip and
loose spikes from it's location across thenorthbound lane ofUS-395andplaced iton
theedgeoftheroadway whileaSWAT Team member moved thepickup blocking the
northbound lane. Myself and Investigating Officer "II"then drove north and
established aroadblock atabout milepost 49ConUS-395.
Atabout 10:00PM, Iwascalled tomeasure thescene oftheOfficer Involved
Shooting. Atabout 1:17AMtheInvestigation Team fromDeschutes County arrived
onscene. Icoordinated withtheDeschutes County Reconstructionist whorequested
thatImeasure thescene using myTotal Measuring Station. Imeasured thescene,
documenting allevidence asdirected bytheDeschutes County Investigators. I
provided allmeasured data toInvestigating Officer DCSO 17,andcleared thescene
atabout 6:48AM.

SUMMARY:
OnJanuary26,2016, membersoftheOregonStatePolicerespondedtoanOfficerinvolvedshooting
whichtookplaceonapublicroadwayonHighway395nearmilepost51inHarneyCounty, Oregon. A
majorcrimeteamcalloutwasinitiated andtheDeschutesCountySheriff’s Officemaintained thelead
asmembersoftheOregonStatePolicewereinvolvedintheshootingincident.
ACTIONTAKEN:
OnJanuary26,2016atapproximately 5:02pm,IwasnotifiedbyInvestigating OfficerGthatmembers
oftheOregonStatePoliceandtheFBIHRTTeamwereinvolvedinanOfficerInvolvedshootingnear
milepost51onU.S.Highway395inHarneyCounty, Oregon.
Withthisinformationathand, Iwastaskedwithrespondingtothecrimesceneandassistingwhile
theyworkedwithDeschutesCountySheriff’s Officetotaketheleadontheinvestigation.
Duetothelocation oftheofficerinvolvedshootingandthefactthatitwasalreadystartingtogetdark,
IdrovetoFrontierRentalInc.inMountVernonandrentedatowablelighttowertohelplightupthe
crimescene. AfterIobtainedthelighttowerIrespondedtothecrimesceneandarrivedat
approximately 8:15pm.
Uponarrival, InoticedseveralunmarkedSWATandFBIHRTvehiclesblockingtheroadwayand
surrounding theOfficer1’s pickupaswellastherestofthecrimescene. Whileonscene, Icontacted
Officer6andhe/shetoldmethatthepickupbelongingtoOfficer1wasnotmovedsincetheincident
tookplace. He/shetoldmethathis/herunderstanding thirdhandwasthatOfficer1firedintothe
vehicleasitwascomingattheroadblock. He/shealsostatedthattheinformation he/shereceived
thirdhandwasthatOfficer2shotLevoyFinicum. Officer6thenshowedmethegeneralareatothe
southofOfficer1’s vehiclewherehe/shebelievedOfficer2waswhenhe/sheshot. Officer6then
wentontotellmeallthevehiclesexceptforOfficer1’s vehiclehadbeenmovedimmediatelyafterthe
shootingforsafetyduetothefactthattherewerestilloccupantsinsideofFinicum’s truckwhichwere
notcomplyingwithcommands.
Next, IspokewithOfficer4. Officer4toldmethathe/shewaspartoftheinitialtrafficstopteamthat
wastryingtoaffectthearrestofthesuspectsfrombothvehiclesjustsouthofthislocation. Officer4
toldmethathe/shewasthedriverofanOregonStatePolicevehiclebelongingtoOfficer2whowas
thepassenger. Officer4toldmethatafterFinicumleftthetrafficstoplocationtheyfollowedintheir
SWATvehicleandarrivedonsceneimmediatelyafterFinicumdroveintotheditch. Officer4toldme
thathe/shewasonsceneduringtheshootingincidentandthathe/shebelievedOfficer2firedat
Finicumfromsomewhere betweentheirstoppedvehicle’s passenger sideandOfficer1’s vehicle.

Officer4toldmethathe/shethoughttheysawapieceofbrassontheroadwayaftertheshooting.
Officer4alsoshowedmeanapproximate areawherehe/shebelievedtheirvehiclecametorestprior
totheshooting.
FromspeakingwithOfficer4andOfficer6,theystatedthattheywereremainingonsceneuntil
anotherFBIteamarrivedtotakeoversecurityofthescenefordetectives. Withtheaboveinformation
athand, itwasdecidedthattheremainingSWATandFBIHRTteammemberswerepushedoutofthe
crimescenetotheperimeterandanofficialcrimescenelogwasstarted.
Atthistime, Ipulledforwardtothesouthsideofthecrimescenetothesouthofthespikestrip
locationandIsetuptheworklightsonthetrailertoproperlyilluminatethescene. Ithenworkedwith
Investigating OfficerAtomaintainscenesecuritywhilewewaitedformembersoftheDeschutes
CountySheriff’s Officewhoweretobetheleadinvestigating agencyfortheshootinginvestigation.
Intheearlymorninghours, Investigating OfficerDCSO1withtheDeschutesCountySheriff’s Office
arrivedonscene. UponspeakingwithDCSO1,hestatedthathewasassignedastheleadDetective.
IexplainedtoDCSO1thatmyselfandInvestigating OfficerAhadseveralinvestigators onsceneand
wewouldprovidewhateverassistancethatheneeded. InvestigatingOfficerDCSO1 wasthenbriefed
bymyselfandwalkedthroughthescene. Duringourwalkthrough Irelayedtheinformation Ireceived
fromOfficer4andOfficer6.
Whileonscene, IassistedDCSO1andtheOSPCrimeLabstaffastheysearched, tookevidenceand
processedthescene.
OnJanuary27,2016at10:00am, Iclearedfromthecrimescenewithareport.

Investigating OfficerC. Atapproximately 6:14pm,weweredispatched tosecurethesceneofan
officerinvolvedshooting, locatedonHighway395atapproximately milepost51C. Weweretold
Deschutes CountyMajorCrimeTeamhadbeenactivatedandwouldbeenroute.
Wearrivedonsceneatapproximately 6:45pm. F

Uponourinitialarrivalandsceneassessment, IspokebrieflywithtwoFBIHRTMembers (NFI). Iwas
told (insubstance) thatapparently twoOSPSWATandtwoFBIHRTmembershadfiredatthe
suspects. Thiswasunconfirmed.
Ashorttimelater, thesametwoHRTMemebers recontacted meandstatedthatnoFBIHRThad
fired; apparently, onlythetwoOSPSWATMembershadfired.

On1-26-16IrespondedtotheJeffersonCountyJailtoassistwithprisonersbeingtransported. When
theprisonersarrivedatthejail,myselfandInvestigating OfficerLLhelpedtheprisonersusethe
restrooms ifneededorgetwater. Aftereachprisonerhadbeengivenachancetousetherestroom, I
tookMr.Santilli, whohadbeenridingwithInvestigating OfficerKKandplacedhimintherearofmy
patrolvehicleatapproximately 11:35pm. Iinformed Mr.Santillihewasbeingrecorded. Ithen
transported Mr.SantillitoGovernment Camp, wherehewastransferred toInvestigating OfficerMM's
patrolvehiclefortheremainder ofthetransport.
OnFebruary18,2016, Imadecopiesofthetransportaudio/videoforFBIAgent andDCSO
1. ThesecopieswereplacedintotheclericalboxattheBendPatrolOfficetobetakentotheir
respective locations.
