1.2 NBCC, the consultant for the Jaipur building and Training Institute building,
Noida has claimed payment of `27.60 lakh and `17.04 lakh for the work at the
buildings, respectively. However, physical verification of the work done by the
contractor(s) is not yet completed, as some corrective actions are yet to be
taken by NBCC, and the settlement of accounts with them is under progress.
As the amount payable is subject to physical verification as per the contract,
these payments have not been taken as Addition to Assets and Liabilities as on
31 March 2018. It has been decided by BIS that no payment shall be released to
NBCC against these two projects till settlement of the issues in the new central
AC plant at the HQ.
1.3 Suit No. 3016 of 2010 in Hon’ble Bombay High Court: Contingent Liability of
`73,82.90 lakh alongwith interest may arise due to damages claimed by
M/s. National Food Products (India) Pvt. Ltd. from BIS, for the alleged loss suffered
by it for delay in renewal of its licence for Packaged Drinking Water.
1.4 Bank Guarantee: Bank Guarantee of `5 lakh valid up to 5 January 2020 was
issued by Syndicate Bank in favour of Director General of Disasters, Response &
Fire Services, Hyderabad.

2.2.1 According to the Actuarial Valuation Report submitted by M/s. Nalin Kapadia,
Consultant & Actuaries, registered with SEBI by following the guidelines given
in AS-15 of I.C.A.I. and the guidelines of the Actuaries Society of India, the total

`122,55,77,523 (gross payment of `1,22,89,19,153 minus receipts from
deputationists, etc., of `33,41,630). This has been debited to Pension &
Gratuity Liability Fund Account (Schedule 2, column 7).
iv) hortfall in the fund provided from Income & Expenditure Account: As a

result of the transactions given in Sl. No. (ii) and (iii) above, the balance in the
Pension & Gratuity Liability Fund A/C as on 31 March 2018 worked out to be
`16,24,36,44,569. Since there was a shortfall of `51,57,72,094 in the Pension
& Gratuity Liability Fund Account (i.e. accrued liability of `16,75,94,16,663
LESS `16,24,36,44,569), therefore, it has been charged to the Income &
Expenditure Account as contribution towards shortfall in Pension & Gratuity
Liability Fund Account and credited to Pension & Gratuity Liability Fund
Account (Schedule 2, column 7) in consonance with the decision of the
Executive Committee.
v) Closing balance in the fund: Therefore, after providing for the shortfall from
Income & Expenditure Account, the Pension & Gratuity Liability Fund, thus,
amounts to `16,75,94,16,663 as on 31 March 2018 (Schedule 2, column 7) as
per the valuation given in the Actuarial Valuation Report.
2.3 NPS applicable to recruits from 1 April 2004 onwards: The National Pension
Scheme is applicable to all employees who joined BIS after 1 January 2004.
The employees’ contribution and BIS contribution in respect of those who
are enrolled with the regulator are remitted to PFDRA on a monthly basis.
However, the employees' contribution and BIS contribution in respect of
employees who are yet to be enrolled with the regulator is kept with BIS
under NPS Fund account and is invested by BIS. The interest calculated at the
rate equivalent to the interest rate of GPF is credited to their accounts. The
balance in the NPS Fund with BIS as on 31 March 2018 amounted to `17,21,671
(Schedule 2, column 6).
2.4.1 The total investments of BIS Funds: The total investments of BIS as on 31 March
2018 amounted to `20,41,36.49 lakh which represents various funds as under:

2.4.2 BIS had made investment of `200 lakh in the bonds of U. P. Cooperative and
Spinning Mills Federation Ltd. (UPCSMFL), an undertaking of Uttar Pradesh
Government, on 17 December 1998 @ 16% per annum. UPCSMFL had defaulted
in the payment of interest and principal on maturity dates. The maturity of
principal was due on 30 April 2003 (33%), 30 October 2003 (33%) and 30 April
2004 (34%). The interest is under default since 1 May 2000, which amounts
to `128 lakh till date of maturity at coupon rate. BIS had filed a case through
Petition No. 451/2002 before the Hon’ble National Consumer Disputes Redressal
Commission (NCDRC). The Hon’ble NCDRC pronounced its judgement on 1
February 2016 and ordered the opposite party No. 1 (UPCSMFL) and opposite
party No. 2 (Government of Uttar Pradesh, the guarantor) to pay a sum of `200
lakh jointly and severally to BIS alongwith the interest @9% only from 1 May
2000 till the date of realisation. A Caveat Petition has also been filed by BIS in
the Hon’ble Supreme Court on 3 March 2016.
The UPCSMFL has also filed the Review Petitions No. 48/2017 and 138/2017
praying the Hon’ble NCDRC to (i) allow this Review Petition and recall order dated
1 February 2016 passed by this Hon’ble Court in Original Petition No. 451/2002,
and (ii) set aside order 1 February 2016 passed by this Hon’ble Court in Original
Petition No. 451/2002 and hear this case afresh. The Execution Petition and
Review Petitions are pending before the Hon’ble NCDRC.
2.5 Financial assistance from Consumer Welfare Fund of Government for the
infrastructure facilities for the Training Institute building at Noida (Schedule 2,
Column 3): The net unspent balance in Consumer Welfare Fund Account as on
31 March 2018 amounted to `1,26,944 (i.e., `4,59,204 as per Schedule 2 less
`3,32,260 of advances to NBCC yet to be adjusted [Schedule 7(B), Item 2(a)(v)].
2.7 Plan schemes of Government of India: National System for Standardisation (NSS)

The expenditure on NRO building project at Sl. (i) has been capitalised except
for the amount given above. The buildings at Sl. (ii) to (iv) have already been
occupied by BIS, however, the expenditure incurred on these buildings has not
been capitalised as on 31 March 2018 as the category-wise and item-wise
inventory statements have not been provided by CPWD. Therefore, depreciation
on these buildings could not be provided. The expenditure on these buildings will
be capitalised and depreciation will be charged after the detailed statements are
received from CPWD. The other projects at Sl. (v) to (viii) are in progress.
2.10 Surplus in General Provident Fund Accounts: There was a surplus (i.e. excess of
income over expenditure) of `1,24,38,335 in BIS Employees General Provident
Fund Accounts during 2017-18. This surplus is due to higher yield on investments
as compared to the interest credited to subscribers. This has been treated as
income of the Bureau as per the Accounting Policy [Schedule 13 Item (g)].
2.11.1 Central Board of Direct Taxes (CBDT), Department of Revenue, Ministry of Finance,
Government of India, vide its Notification No. 88/2014 dated 23 December 2014
had notified BIS under Section 10 (46) of Income Tax Act, 1961 for the Assessment
Years 2012-13 to 2016-17. The CBDT has further notified BIS under this section for
the Assessment Years 2017-18 to 2021-22 vide Notification No. 111/2016 dated 1
December 2016. As a result of this notification, the income of BIS is not taxable
till Assessment Year 2021-22.
2.11.2 Income Tax Exemption granted to BIS under section 10(23)(c)(iv), which was
withdrawn by DG:IT(E) vide order dated 24 February 2012 from Assessment Year
2009-10 and onwards was restored by it vide order dated 4 December 2012
in compliance with the order of Hon’ble High Court of Delhi. Therefore, the tax
exemption of BIS under section 10(23)(c)(iv) of Income Tax Act is also available.
The DG IT(E) had filed SLP in Hon’ble Supreme Court under Article 136 of the
Constitution of India against allowing the Writ Petition of BIS by the Hon’ble High
Court of Delhi. The SLP filed by DG:IT(E) has been converted into Civil Appeal
which is pending in the Hon’ble Supreme Court.
2.12 The Annual Accounts have been prepared in the Uniform Formats of Accounts
prescribed by the Ministry of Finance.
2.13 Figures in Final Accounts have been rounded off to the nearest rupee.

SEPARATE AUDIT REPORT OF THE COMPTROLLER & AUDITOR
GENERAL OF INDIA ON THE ACCOUNTS OF BUREAU OF INDIAN
STANDARDS FOR THE YEAR ENDED 31 MARCH 2018
We have audited the attached Balance Sheet of the Bureau of Indian Standards
(BIS), New Delhi as at 31 March 2018, Income & Expenditure Account and Receipts
& Payments Account for the year ended on that date under Section 19 (2) of the
Comptroller & Auditor General’s (Duties, Powers & Conditions of Service) Act, 1971
read with Section 24(2) of the Bureau of Indian Standards Act 2016. These financial
statements include the accounts of twenty four Branch Offices, four Regional
Offices, Central Laboratory at Sahibabad and the National Institute for Training on
Standardisation (NITS) at Noida. These financial statements are the responsibility of
the BIS’s management. Our responsibility is to express an opinion on these financial
statements based on our audit.
2. This Separate Audit Report (SAR) contains the comments of the Comptroller &
Auditor General of India (CAG) on the accounting treatment only with regard to
classification, conformity with the best accounting practices, accounting standards
and disclosure norms, etc. Audit observations on financial transactions with regard
to compliance with the Laws, Rules & Regulations (Propriety and Regularity) and
efficiency-cum-performance aspects, etc., if any, are reported through Inspection
Reports/CAG’s Audit Reports separately.
3. We have conducted our audit in accordance with auditing standards generally
accepted in India. These standards require that we plan and perform the audit to
obtain reasonable assurance about whether the financial statements are free from
material misstatements. An audit includes examining, on a test basis, evidences
supporting the amounts and disclosures in the financial statements. An audit
also includes assessing the accounting principles used and significant estimates
made by management, as well as evaluating the overall presentation of financial
statements. We believe that our audit provides a reasonable basis for our opinion.
4. Based on our audit, we report that:
i) We have obtained all the information and explanations, which to the best of our
knowledge and belief were necessary for the purpose of our audit.
ii) The Balance Sheet, Income & Expenditure/Receipts & Payments Account dealt
with by this report have been drawn up in the Uniform Format of Accounts as
prescribed by the Ministry of Finance.
iii) In our opinion, proper books of accounts and other relevant records have been
maintained, under section 24(1) of The Bureau of Indian Standards Act 2016, in so
far as it appears from our examination of such books.
iv) We further report that:
A. Balance Sheet
A.1 Assets
Institute in its Schedule 16 of accounting policy stated that they are following depreciation
as prescribed in the Income Tax Act. However, audit observed that the institute has not
provided the depreciation on as per the depreciation rates prescribed in Income tax Act BIS
charged the deprecation in excess of the prescribed rates as detailed below:

B. General:
B.1 As per Schedule 8 (Fixed Assets) of Uniform Format of Accounts, Furniture and
fixtures, Office equipment and Computer/peripherals were to be shown separately
and these items have different rates of depreciation. However, in the Schedule of
Fixed Assets, these items were clubbed and were not shown separately.
B.2 In NITS, accounts receivables (others) includes `54.13 lakh relating to the period
March 2007 to March 2017. Sundry debtors relating to training fees amounting
to `2.97 lakh were relating to the period 2009-10 to 2013-14. Similarly in
Branch Office, Faridabad, debtors amounting to `1.48 lakh were relating to the
period 1984-85 to 2002-03. These long pending debtors need to be reviewed
and provision to be made in accounts for doubtful debts. If the amounts are not
recoverable, the same may be written off with the approval of the competent
authority.
B.3 In NITS, the stock of stationery as on 31.3.2018 was `4.23 lakh whereas in the trial
balance, it was depicted as `6.27 lakh. The difference of `2.04 lakh needs to be
reconciled.
B.4 In Central Laboratory Sahibabad, an amount of `2.78 lakh (advances to employees
outstanding prior to 2012-13, TA advance of `0.46 lakh were outstanding prior
to 2015-16 and cash imprest of `0.03 lakh as cash imprest to officers prior to
2016-17) was outstanding since long and need to be adjusted/recovered from the
concerned.
B.5 In Central Laboratory Sahibabad, an amount of `1.69 lakh was depicted as ‘prior
period items’ under sundry creditors ‘not traceable’. These unclaimed liabilities need
C. Grants-in-aid
During 2017-18, BIS received Grants-in-aid of `2.00 crore for setting up of Hallmarking
Centres and for quality infrastructure for consumer protection from the Ministry of
Consumer Affairs, Food & Public Distribution. It had `0.05 crore as interest income and
unspent balance of `7.39 crore of the previous year. Out of total available amount of
`9.44 crore, a sum of `2.47 crore was utilised during the year leaving a balance of `6.97
crore ( including `6.43 crore advance to CPWD) at the end of the year.
D. Management Letter: Deficiencies which have not been included in the Audit
Report have been brought to the notice of the Director General, Bureau of Indian
Standards (BIS) through a management letter issued separately for remedial/
corrective action.
v. Subject to our observations in the preceding paragraphs, we report that the
Balance Sheet, Income & Expenditure Account and Receipts & Payments Account
dealt with by this report are in agreement with the books of accounts.
vi. In our opinion and to the best of our information and according to the explanations
given to us, the said financial statements read together with Notes on Accounts,
and subject to the significant matters stated above and other matters mentioned
in Annexure to this Audit Report give a true and fair view in conformity with
accounting principles generally accepted in India;
a. In so far as it relates to the Balance Sheet, of the state of affairs of the Bureau
of Indian Standards as at 31 March 2018; and
b. In so far as it relates to Income and Expenditure Account of the ‘Surplus’ for
the year ended on that date.
