CARLITO M, TUBALLA, REGIONAL EXECUTIVE DIRECTOR AND THE PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICE (PENRO) LA UNION TO DONATE THE LOGS/FLITCHES OF ACACIA TREE CONFISCATED BY PERSONNEL OF THE BALAOAN POLICE STATION ON SEPTEMBER 7, 2019 TO THE LOCAL GOVERNMENT UNIT (LGU) OF BALAOAN. WHEREAS, personnel of the Balaoan Police Station intercepted and confiscated a FUSO ten-wheeler truck loaded with logs/flitches of Acacia Tree in Brgy. Camilo Osias, Balaoan, La Union on September 7, 2019, at about 1:30AM on presumptive violation of PD 705 (Revised Forestry Code of the Philippines); WHEREAS, the said logs/flitches of Acacia Tree and the FUSO ten-wheeler truck are still under the custody of the Balaoan Police Station and are awaiting transfer to PENRO custody; WHEREAS, Memorandum Order No. 162, s. 1993 issued by then President Fidel V. Ramos, provides that confiscated logs, lumbers and other forest products may be disposed through donation if these are: (1) not subject of a pending case in court or with other appropriate office; (2) without claimants or offenders pcr pW ad Hole cg Peaticey ; BASO = lof 4 ® aoe e against whom the case could be filed; (3) found abandoned within forest areas, the ownership of which could not be ascertained and without claimants; WHEREAS, Section 4[i) of the same order provides that Local Government Units (LGUs) which have jurisdiction over the place where the logs, lumber and other forest products were gathered and/or confiscated are qualified beneficiaries of a donation; WHEREAS, the Municipal Government of Balaoan intends to use these confiscated logs/flitches of Acacia Tree for building the Municipal Children’s Park and other purposes that may benefit our townspeople; NOW THEREFORE, on motion duly seconded, be it: RESOLVED, to request the Department of Environment and Natural Resources (DENR-RO1) thru Dir. Carlito M. Tuballa, Regional Executive Director and the Provincial Environment and Natural Resources Office (PENRO) La Union to donate the logs/flitches of Acacia Tree confiscated by personnel of the Balaoan Police Station on September 7, 2019 fo the Municipal Government of Balaoan. RESOLVED FURTHER, to forward a copy of this Resolution to Dir. Cariito M. Tuballa, Regional Executive Director of the Department of Environment, Provincial Environment and Natural Resources Office (PENRO) La Union, and to ‘the Balaoan Police Station thru Police Major Jeoffrey Sanchez for their information and appropriate action.
