COUNTER – AFFIDAVIT

That I, PCpl PHILIP MEDALLION BAWALAN, Filipino, of

legal age, member of the Philippine National Police after having
been duly sworn to in accordance with law hereby depose and
state:

That I am the respondent in this case. That the allegation

against me is of no factual basis. The truth of the matter being
the following:

That I was subpoenaed as Prosecution witness in relation to

violation of RA 9165 before Regional Trial Court, Branch 153,
Binan, Laguna on September 14, 2020.

That I was charged for Grave Neglect of Duty for failure to

attend hearing on September 14, 2020 before Regional Trial
Court, Branch 153, Binan, Laguna in relation to Criminal Case
number 1212-B-2019 to 1205-B-2019 and 1206-B-2019 to
1213-B-2019 violation of RA 9165.

That I received a radio message from Higher Office on

September 11, 2020 directing me as participant of Special
Weapon and Tactics Course (SWAT) to report on September 14,
2020 for Neuro-psychiatric examination same day as the
scheduled court hearing. Attached is the radio message as annex
‘”1” -- 3 pages.

That upon receiving the said radio message I went to

Prosecution Office of City of Binan to inform them that I could
not attend the scheduled hearing on September 14, 2020
because it would be conflict on the scheduled Neuro-psychiatric
exam by which the designated Trial Prosecutor accepted the
reason I have given for the sake of career advancement.

 That through the concurrence of the designated Trial
Prosecutor I prioritized the reporting to Police Regional Office to
undergo Neuro-psychiatric examination and pursue Specialized
Training for career advancement as proof thereof I secured a
Certification from Prosecution Office of City of Binan stating that
I made a prior notification of my unavailability as annex “2”.

Hence, I did not deliberately absent from hearing as I had a

prior valid excused made before the Trial Prosecutor and thereby
acted upon the directive from Higher Office.

That I execute this counter-affidavit to attest to the truth of

the foregoing fact and to request this Honorable Office to dismiss
this case filed against me for being without basis in fact and in
law.

That in truth whereof I hereby affixed my signature this

27th day of April, 2021 in City of Binan, Laguna.
