EXPLANATION RE FAILURE TO ATTEND COURT HEARING

That I, PCpl Ros Nathaniel Tabo, Filipino, of legal age,

member of the Philippine National Police after having been duly
sworn to in accordance with law hereby depose and state:

That I was subject for explanation re failure to attend court

hearing PIDMU Laguna Police Provincial Offfice. The truth of the
matter being the following:

That I was subpoenaed as Prosecution witness in relation to

violation of RA 10591 before Regional Trial Court, Branch 93,
San Pedro, Laguna on July 24, 2019.

That I was directed by the Higher Office to participate in a

5-day seminar of Basic Intelligence Collecting Analysis System
(BICAS) and during such period from July 22 to 26, 2019 by
which within such period I was subpoenaed to attend the said
court hearing --July 24, 2019. Attached is the Certificate of
Completion.

That when I noticed that there was a conflict on my

schedule on the very 1st day of my seminar, I contacted the
Prosecution Office of City of San Pedro to ask them if the
scheduled hearing will be held on July 24, 2019 but the Duty
Prosecutor who was also designated at the said branch replied
that I could be excused because the Initial trial would not require
my presence and I could testify on another set of hearing and
permitted me to zealously attend the seminar for the sake of
career advancement.

That upon having knowledge that the hearing will be reset

on another day I prioritized to attend the BICAS seminar because
It would be inconvenience as the distance of Laguna Police
Provincial Office where the seminar was being held and RTC of

San Pedro is too far just to secure the Certificate of Court
appearance thus, I was not able to secure the Certificate.
However, the main prosecution witness (searcher) attended the
initial trial but then he was not called to testify and instead the
Court reset the trial on another day. Please see attached minutes
of the meeting.

Furthermore, the said initial trial was only continued on

April 28, 2021 and the continuation will be held on another day.

Hence, I did not deliberately absent from hearing as I had a

prior excused made before the Trial Prosecutor and the
proceeding was only initial where prosecution witnesses were not
called and thereby did not neglected a court duty as the trial is
continuously holding before RTC San Pedro Branch 93.

That I execute this counter-affidavit to attest to the truth of

the foregoing fact and to request this Honorable Office to
consider my explanation for being justifiable and reasonable.

That in truth whereof I hereby affixed my signature this
