2017 Judgments

1.) Justice K.S,Puttaswamy (Rtd) and another Vs. UOI


M.P Sharma Vs. Satish Chandra, Karak Singh Vs State of Uttar
Pradesh decided Privacy is not a fundamental right stands
overruled.

2.) Muslim women’s quest for equality Vs Jamit Ulam-I-hind,


Shayara Bano Vs UOI and others. Gound that it goes against
Shariat. Article 14 upheld. Triple Talaq not valid.

3.) Krishna Kumar Singh Vs State of Bihar. Placing ordinance


before legislature is mandatory. Re-Promulgation fraud on the
constitution. Satisfaction of President U/A 123 and Governor
U/A 214 while issuing ordinance is not immune from judicial
review.

4.) Independent Thought Vs Union of India and another.


Sec 198 (6) of CrPC will apply to cases of rape of wives below
18 years and cognizance can be taken only in accordance with the
provisions of Sec 198 (6) CrPC exception 2 to Sec 375 of IPC.
2013 Amendment still allowed. The age of consent has been
made 18 from 15 in these cases.

Seeking vote in the name of Religion/Caste is corrupt practice.

6.) Mukesh and another Vs. State of NCT of Delhi and others
(Nirbaya Rape Case). SC upheld the death penalty of convicts in
Nirbaya rape and death case. The attitude of the offenders
amounted to bestial proclivity and that the incident sounds like a
story from a different world where humanity is treated with
irreverence.

7.) Calcutta HC Judge C.S. Karnan jailed for 6 months for contempt.
He was convicted for making scandalous corruption against the
Apex court’s sitting and retired judges.

8.) M.S. Indira Jaising Vs SC of India through Secretary General and


others. Guidelines on senior designation. In a major effort to
bring transperancy into the process of designating advocates as
“Seniors”. Henceforth all the matters relating to it will be dealt
primarily by a committee headed by Chief Justice, the 2 senior
most judges and the Attorney General will be part of the
committee while will choose a Fifth member from the ban.

9.) State through Central Bureau of Investigation Vs. Shri Kalyan


Singh (former CM of Up and others). u/s 153A, 295, 332, 338,
395, 397, 153B, 505. 1992 Babri Masjid Comoolition Case.
Restored criminal conspiracy charges against senior BJP leaders

10.) Rajive Raturi Vs. UOI and others. Deadlines to make public
place accessible to visually disabled. Proper and adequate access
for such persons to public places. Directed that 50% of all
government buildings of the National Capital and all state capital
be made fully accessible by December 2018.

11.) Santhini Vs. Vijaya Venketesh (Transfer Petition). SC overruled


Krishna Veni Nagam Vs. Harish Nagar that if the proceedings are
directed to be conducted through video conferencing, the spirit of
1984 Act will be in peril and further the cause of justice would be
defeated.

12.) Rajesh Sharma and others Vs. State of UP and others. SC issued
new set of directions to prevent the misuse of Sec 498A of IPC.

13.) Hussain and others Vs. UOI. SC directed courts to dispose of


Bail pleas within 1 week. Also issued directions to tackle
prudency of criminal cases reiterating that speedy trial is a part of
reasonable, fair and just procedure as guaranteed u/A 21 of
Indian Constitution.

14.) M/S. Meters and Instruments Private Limited and another Vs.
Kanchan Mehta. Cheque Bouncing Case u/s 138 of Negotiable
Instruments Act can be discharged even without the consent of
the complainant if the court is satisfied that the complaint has
been duly compensated. Power u/s 258 CrPC to stop trial and
discharge the accused was available to the Magistrate.

15.) Pawan Kumar Vs. State of MP. Women’s Right to love and
reject. Conviction for abetment of suicide of a girl because of his
continuous harassment and eve teasing. None can compel and
woman to love, she has absolute right to reject.

16.) Rakesh Kumar Paul Vs. State of Assam. Accused is entitled to


default bail after 60 days for offences punishable with
imprisonment up to 10 years. An accused is entitled to statutory
bail (default bail) u/s 167 (2) (a) (2) CrPC if the police failed to
file the charge sheet within 60 days of his arrest for the offences
punishable with imprisonment up to 10 years.

17.) Writ Peittion (Civil) No. 406/2013. Re-inhuman conditions in


1382 prisons. Directions for prison reforms. Took into account
the number of unnatural deaths in prisons.
