Used to designate anyone in the legal profession or learned in law including a solicitor , barrister and
attorney .
In India , to practice in the court of law , they need to be enrolled in a state bar council and clear the All
India Bar Examination .Thus lawyers are not eligible to stand in court of law .
They can give legal advice to their clients but they can’t represent them in the court of law.
ADVOCATES
After clearing the bar exam and enrolling in a state bar council , a person can refer himself as an
advocate and can represent clients in the court.
According to section 29 of the advocates Act, advocates are the only class allowed to practice the
profession of law in India,
Barrister
He is a legal practitioner whose main function is to practice advocacy in court(prevalent in England and
Wales).
A barrister is anyone who has passed in his law degree and completed one year of juniorship and
completed the Bar Professional Training Course(BPTC).
Barrister is just as their Indian counterpart advocates, In India completing law degree and clearing bar
exam you have the right for trial works in the court of law but in England and wales , one year of strict
pupilage and passing BPTC is mandatory to start advocacy.
ATTORNEY
This word has its origin with French meaning “one appointed or constituted “.
Because the office of legal advisor to the crown and the parliament is known as the Attorney general
,similarly in India the legal advisor to the president and the union government is known as the AG
(Article 76). The US legal advisor of every state is called AGs so to avoid repetition of the same term in
India , we have used Advocate – General (Article 165).
SOLICITORS
Solicitors generally are the artists that work backstage , prepare the cases ,do all the hefty works related
to filling, drafting and advising , barristers are engaged when one needs to represent their cause in the
court of law.
In India , Bombay is the only state where solicitors can get themselves registered with Bombay
incorporated law society .
Eligibility- completed either his law degree or 1styear of law degree course,
PLEADERS
A person who drafts pleadings in the court of law , on behalf of his client.
In Section 2(7) of the cpc government pleader is defined ,appointed by the state government
