Dear Mr. Keng,

This is to formalize my explanation about why I cannot reimburse the portion of my commission
to LESSEE Miao Leon Yu. In this regard please take note of the following:

1. I’ve done my part – as a real estate broker between Sapphire Condominium and
LESSEE Yu I believe that I’ve performed my job successfully. I was able to help
LESSEE Yu and the LESSOR (the management of Sapphire Condominium that you’re
representing) to close the transaction. Accordingly, I gave my advice and opinion about
the price, market outlook and other pertinent information that will benefit both Sapphire
Condominium and their client Yu. As real estate broker technically speaking my job ends
when the transaction is closed. Hence, why should I reimburse the portion of what I
earned to the claimant when in fact I’ve done my part; I’ve delivered the goods so to
speak.

2. No contract – as we both know my only participation in the Contract of Lease document


that was mutually signed and agreed by the management of Sapphire Condominium and
LESSEE Yu is to act as Witness so as make that written agreement binding and legal.
There is no single provision, article or a stipulation that binds me with the LESSEE; in
short legally speaking I am not obliged to the LESSEE in whatever manner. Just like
what I’ve said my in the preceding paragraph my obligation with the LESSEE ceased to
exist after the closing of the transaction.

3. I am a freelancer – I am not part of the Sapphire Condominium management hence


whatever grievance, cause of distress, injustice, unhappy experience, discomfort or any
form of unfairness that LESSEE Yu live through during his/her stay in your condominium
I am not definitely part of it. Whereas, LESSEE should resolve the issue that he/she has
against Sapphire Condominium within the parameter of the Contract Lease Agreement
that was mutually agreed by the LESSOR and the LESSEE. Assuming the LESSEE
goes through any of these inconveniences.

In view of the foregoing, I hope that you understand my reason why I cannot yield to the
demand of the LESSEE. Please understand that it is unfair for me what the LESSEE is
demanding from me.
