Instrument Act read with section 420 IPC for
dishonor of cheque.

I, under the instruction of my client Billu
Singh son of Suba Singh resident of # 37, Phus
Mandi, Post office Jassi Pau Wali Tehsil and
District Bathinda, do hereby serve you with the
following legal notice of demand under section
138 of Negotiable Instrument Act read with
section 420 IPC for dishonor of cheque.

1. That my client knows you, the notice from many


years and on that account you had gained the
faith and confidence my client. That you
demanded a friendly loan from my client to the
tune Rs. 1,50,000/- ( One Lac Fifty Thousand
Rupees Only). My client obliged you by provided
the said amount.
2. That you issued a Cheque No. 586708 Dated
22.03.2021 for Rs. 1,50,000/- ( One Lac Fifty
Thousand Rupees Only)drawn on the State Bank
of India, Branch Bathinda in order to discharge
your partial liability. At the time of issuing
the cheque, you assured my client that the same
is good for value and will be horned as and
when presented.
3. That my client deposited the above mentioned
cheque in his account duly maintained by him in
Canara Bank, Phus Mandi Branch, District
Bathinda, on dated 04.06.2021 but to utter
surprise my client received the cheque back
along with memo of the bank dated 05.06.2021
with remarks " Drawers Signature Differs ".My
client informed you about it through telephone.
4. That after dishonoring of above said cheque my
client again contacted you and informed you
regarding the dishonor of the said cheque and
asked you to make the payment of the said
cheque but you kept on lingering the matter on
one pretext or the other.
5. That you have intentionally and willfully made
not kept Drawers Signature Differs in your bank
account while issuing the cheque to my client
as such your intention from the very beginning
was to cheat and defraud my client and as
such you had issued the cheque and as such
you have committed fraud and cheating with my
client you have made yourself liable under
section 138 of Negotiable Instrument Act 1881
read with section 420 of IPC according to which
beside this criminal liability is also liable
to be burdened with the double of the cheque
amount as penalty.
6. That my client approached you several
times and requested you to make the
payment of cheque amount but all in vain.

I, therefore, call upon you


through this legal Notice upon to
make the payment of the cheque amount to
the tune of Rs. 1,50,000/- ( One Lac
Fifty Thousand Rupees Only) to my client
within the period of 15 days from the
date of receipt of this notice, failing
which my client shall file complaint
under section 138 of Negotiable Instrument
Act read with section 420 IPC against
you and you will be responsible/ liable
for all the expenses and legally my
client is entitled to receive the double
amount of the cheque from you as damages
and compensation.
A carbon copy of this has been retailed
in my office for record and necessary
action.
