PART – III FLOW/CHAIN OF THE TITLE

1. RECORDED TENANT IN REVISIONAL RECORDS IN THE NAME OF SK AMIRUDDIN


That during the Cadestral Survey in respect of the said land larger portion of the land admeasuring 48
decimals was recorded in the name of Sk Amiruddin as Kaimi in R.S Khatiyan .
The said fact for recorded tenant in name of Sk Amiruddin as Kaimi has been observed while the
perusal of the Records of Rights (Khatiyan) available at the online portal at
ttps://jharbhoomi.nic.in/jhrlrmsmis/ of the department of Land Revenue and Registration , Govt of
Jharkhand .

2. PROPERTY DEVOLUTION IN THE NAME OF ELIZA KHATOON


That Sk Amiruddin transferred the aforesaid property to his sister Smt. Eliza Khatoon who came in
peaceful possession over the said land and was enjoying the rights over it.

3. PROPERTY INHERITED BY RABIYA KHATOON AND RAZIA SULTAN


After the demise of Smt Eliza Khatoon jointly inherited by their legal heirs and successors Rabiya
Khatoon and Razia Sultan
That died leaving behind his daughters who inherited the said property and enjoyed rights
and title over the aforesaid property. They also mutated the property in their names in the
circle office Ranchi.

4. PROPERTY DEVOLUTION IN THE NAME OF WADHWANI AND ASSOCIATES


Further Sarojani Devi W/o Sri R.N. Singh sold the property admeasuring 51 decimals under
Khata no. 11, Plot no. 1126, Sub Plot no. 1126/6 to Gita Devi W/o Sri Chitranjan Prasad Singh
by caste Bhumihar Brahmin vide registered deed of sale no 7047 dated 29.04.1974. She
remained in peaceful possession over the aforesaid property and got the property mutated in
her name in the Office of Circle Officer, Ranchi and was paying taxes to government of
Jharkhand
5. INHERITANCE OF PROPERTY IN THE NAME OF SHASHI RANJAN SINHA AND
SHISHIR SINHA
After the demise of Smt Gita Devi and her husband Sri Chitranjan Prasad Singh the
property was jointly inherited by their legal heirs and successors Shashi Ranjan Sinha
and Shishir Sinha both sons of Smt Gita Devi and Sri Chitranjan Sinha.

Later the property was partitioned between Shashi Ranjan Sinha and Shishir Sinha vide.
Memorandum of Oral Family Settlement dated 07.01.2013. According to the said
partition each of them got 25.50 decimals of land and came in peaceful possession of
their respective shares.

6. LAND REVENUE IN THE NAME OF SHASHI RANJAN SINHA AND SHISHIR SINHA

Furher Shashi Ranjan Sinha and Shishir Sinha got their name mutated in the office of
Circle Officer vide mutation case no. 5207 R-27/2012-13 and paying tax to government
of Jharkhand.
Also they mutated their name in the office Ranchi Municipal Corporation and paying
taxes in respect of Holding No. 142/C1, Ward no. 04.

The said fact has been verified on the online portal of Land & Revenue Department
Government of Jharkhand https://jharbhoomi.nic.in/

7. DEVELOPMENT AGREEMENT & POWER OF ATTORNEY

Shashi Ranjan Sinha being interested to develop the lands fully described in PART 1 –
approached the BUILDER/CONFIRMING PARTY and entered into Development Agreement
dated 19th Day of July , 2017 with M/s RIDHI SIDHI DEVELOPERS through its director Mr
Vikash Modi
It shall also be pertinent to mention herein that a separate Power of Attorney was also
executed by the land owner Pradip Kumar Narsari where he appointed and nominated Rahul
Modi S/o Ravindra Modi as his duly constituted Attorney vide registered POA no – IV 120
dated 19.02.2018 registered in the office of District Sub – Registrar Ranchi.

Later Shashi Ranjan Sinha and Shishir Sinha appointed Sri Kashi Nath Jha as their legal
attorney to fulfil

9. PROPERTY DEVOLUTION IN THE NAME OF FEBIAN JITENDRA ALEXANDER, RAJENDRA
ALEXANDER AND JAYDEEP ALEXANDER
Pankaj Choudhary entered in to agreement to sell dated 07.02.1978 with Robert Alexander in
respect of sale of above said land and the construction thereon but unfortunately Robert
Alexander died before the sale deed could be executed. His Sons Febian Jitendra Alexander,
Rajendra Alexander and Jaydeep Alexander being his heirs became entitled to get sale deed
executed in their favour.
Pankaj Choudhary executed and registered through his constituted Attorney Shri Cajetan Das
S/o Lt Elias Vincent vide Registered Power of Attorney IV 70 dated the 18 th March, 1999 five
sale deeds in the name of Febian Jitendra Alexander, Rajendra Alexander and Jaydeep
Alexander total 53 Kathas of land along with construction thereon vide sale deed no – 4154
dated 05.04.2002, Sale Deed No 4271 dated 09.04.2002, 4331 dated 10.04.2002, 4332
dated 10.04.2002 and 4333 dated 10.04.2002.

10. PROPERTY DEVOLUTION IN THE NAME OF SHRI RAM MULTICOM AGENCY


PRIVATE LTD.
That it shall be pertinent to mention herein that post purchase of the aforesaid property
Febian Jitendra Alexander, Rajendra Alexander and Jaydeep Alexander sold 21 kathas 15320
Sq Ft of land at khata No 43 in Plot No 941/1, 941/2 at village Morahabadi to Shri Ram
Multicom Agency Private Ltd through its director Shri Anup Kumar Sonthalia S/o Shri Ram
Swarup Sonthalia vide sale deed no 10316 dated 05.09.2002.
They sold another 12 kathas of land from khata no 43, Plot no 941/1, 941/2 (Area 5 kathas 4
chattaks 3780 sq ft) and from khata no 156, Plot no 949 (Area 6 kathas 12 Chataks 4860 Sq
ft) at village Morahabadi to Shri Ram Multicom Agency Private Ltd through its director Shri
Anup Kumar Sonthalia S/o Shri Ram Swarup Sonthalia vide sale deed no 10360 dated
06.09.2002.
The property (Total 33 Kathas) was mutated in the name of Shri Ram Multicom Agency
Private Ltd through its director Shri Anup Kumar Sonthalia S/o Shri Ram Swarup Sonthalia
vide rent fixation case no - 221/ 2002-2003 dated 25.02.2003 (Total 26 Katha 4 Chattak of
Land in Khata 43 Plot no 941) and rent fixation case no - 348/ 02-03 dated 20.05.2003 (Total
6 Kathas 12 Chattak) and the same has been updated in register II
The said fact has been verified on the online portal of Land & Revenue Department

11. DEVELOPMENT AGREEMENT &POWER OF ATTORNEY


That it shall be pertinent to mention herein that SHRI RAM MULTICOM AGENCY PRIVATE
LTD through its director Shri Anup Kumar Sonthalia S/o Shri Ram Swarup Sonthalia decided
to develop the aforesaid land in form of constructing multistoried residential building
consisting of residential flats dwellings and parking space on the Ground Floor of the
building and sale of the undivided proportionate share of the schedule property and in this
connection entered into a development agreement with the builder namely R.J
INFRAREALITY PVT LTD through its director Sri Nikhil Tikmania S/o Sri Narendra Kumar
Tikmania.
It shall also be pertinent to mention herein that a separate Power of Attorney was also
executed by the land owners i.e SHRI RAM MULTICOM AGENCY PRIVATE LTD through its
director Sanjay Kumar Sharda S/o Lt Kameshwar Prasad Sharda appointed and nominated
Sri Nikhil Tikmania S/o Sri Narendra Kumar Tikmania vide duly registered POA Deed no – IV
1850 dated 01.11.2012 in the office of District Sub – Registrar Ranchi
12. APPROVED BUILDING PLAN& CONSTRCUTION OF ALNEJAM PALACE

Further an approved plan bearing B.C Case number – 2012/1142 dated 18.11.2013 was
sanctioned from Ranchi Municipal Corporation and thereby a multistorey building namely
“SAI ENCLAVE” was constructed thereby, in which FLAT / UNIT NO. 406 on Fourth Floor
along with a Car Parking space in the basement came into the allocation of the Owners I.e.
SHRI RAM MULTICOM AGENCY PRIVATE LTD

That it is also pertinent to mention herein that as per the Development Agreement dated
01.11.2012 and supplementary Agreement 20.06.2014 out of the total area, the Owner has
been allocated 30 % i.e total 13,467 Sq Ft and 12 car parking area in the basement.

8. SALE AGREEMENT IN NAME OF ABHILASHA KUMARI (Loan Applicant)


That later on SHRI RAM MULTICOM AGENCY PRIVATE LTD through its director Sanjay
Kumar Sharda S/o Lt Kameshwar Prasad Sharda after some time decided to sell out the
FLAT / UNIT NO. 406 on Fourth Floor along with a Car Parking space in the basement
having super built up area of 934Sq ft at the multistorey building namely “SAI ENCLAVE TO
Abhilasha Kumari and accordingly a Sale Agreement has been executed in Favour of
Abhilasha Kumari (Loan Applicant) on dated 14.02.2018 for a Sale consideration of Rs 38,
00,000/- (Thirty Eight Lakhs Only).
That post purchase of the property vide Registered Deed of Sale, would devolve in the
exclusive title of the loan Applicant I.e. Abhilasha Kumari

PART – IX FINAL OPINION

The present owner and seller SHRI RAM MULTICOM AGENCY PRIVATE LTD through its director Sanjay
Kumar Sharda S/o Lt Kameshwar Prasad Sharda is having a valid title and possession upon the aforesaid
property and the property is fit for equitable mortgage post purchase and execution of title deed in favour
of loan Applicant namely Abhilasha Kumari (Loan Applicant)

PART – X CERTIFICATE

In view of the foregoing, I certify that the title deeds intended to be deposited, relating to the property
and offered as security by way of equitable mortgage and the documents of title referred to above are
perfect evidence of the title and that if the said equitable mortgage is created in the manner required by
law, it would satisfy the requirements of creation of equitable mortgage.
The mortgage if created post purchase of the property by the applicant namely Abhilasha Kumari (Loan
Applicant) and deposition of title deed , will be available to HHFL for the liability of the intending
borrower Abhilasha Kumari .
Remarks, if any: -

 The required documents as per PART-VII of this report must be present at the time of
disbursement.
 No Original Documents are perused and opinion is given on copies of Deed and Online
records. and the property has not been physically verified in any manner.
 Since this is a New Purchase case so Pay-Order should only be delivered to the Seller (SHRI
RAM MULTICOM AGENCY PRIVATE LTD) or Applicant (Abhilasha Kumari) post execution of the
title deed in favourof applicant Abhilasha Kumari and due verification thereof.
 That Agreement to Sale in between Seller SHRI RAM MULTICOM AGENCY PRIVATE LTD And
Abhilasha Kumari is not Registered or Notarized. The same should be obtained Registered or
either Notarized before disbursement
 Post execution of Title Deed the applicant Abhilasha Kumari must apply for holding mutation
in the Office of Ranchi Municipal Office and submit municipal tax receipt to HHF.
