CITY OF DAYTON
EMERGENCY ORDER No. 2021-1
Dayton, Ohio August 9, 2021
WHEREAS, on July 27, 2021, The Centers for Disease Control and Prevention (CDC) advised that
the highly transmissible Delta variant of the Covid-19 virus has contributed to a nationwide quadrupling of
coronavirus infections during the month of July; and
WHEREAS, the CDC issued revised Guidance, effective July 27, 2021, advising that people who
are in an area of substantial or high transmission wear masks in indoor public spaces, even if vaccinated; and
WHEREAS, on July 30, 2021, Public Health — Dayton & Montgomery County provided notice that
it supports the CDC guidance recommending the use of face masks while indoors, regardless of vaccination
status, and
WHEREAS, on August 2, 2021, the CDC moved Montgomery County, Ohio from a substantial
transmission community to a high-iransmission community, and
WHEREAS, the City is experiencing a rise in cases amongst employees and staff within the
organization; and
WHEREAS, the City Manager believes that it is necessary to put measures in place to protect the
well-being of City employees, staff, and the public they serve from the dangerous effects of the recent surge
in COVID-19 cases; and
WHEREAS, on March 14, 2020, the Mayor and City Manager declared a state of emergency in the
City of Dayton, providing additional powers to the City Manager during the pendency of the emergency; and
WHEREAS, the City Manager is hereby exercising these powers for the protection of lives and
property and the continuation of local government with a minimum of disruption.
Now, therefore, the City Manager hereby orders as follows:
1. During the remaining term of the City emergency, facial coverings are required for ALL people
while in public spaces of City buildings.
2. During the remaining term of the City emergency, facial coverings are required for ALL
employees while riding in a vehicle where there is more than one occupant.
3. Effective September 20, 2021, any City employee who has not been fully vaccinated against
Covid-19, pursuant to CDC guidelines, will be required to submit to weekly Covid-19 testing, in
accordance with City of Dayton Personnel Policy 13.04,
