ORDER

As per the G.O read as 2nd paper above, approval has been given for the Feasibility
Report and Alignment thereof of 3rd and 4th Railway Line between Thiruvananthapuram
and Kasargod Semi High Speed Rail Project submitted by M/s SYSTRA, subject to the
condition that value capturing, financial mobilization,etc mentioned in the feasibility report
will be made only after getting formal approval for the project from Railway Board.

2. As per the letter read as 3rd paper above, "in principle approval (IPA)" for
taking up pre-investment activities for the construction of 3rd and 4th Railway Line
between Thiruvananthapuram and Kasargod (540 KM) - Semi High Speed Rail Corridor
Project has been conveyed by the Ministry of Railways.
3. The Manging Director, KRDCL as per the letter read as 4th paper above has
requested for the creation of Special Land Acquisition units exclusively for the acquisition
of Semi High Speed Railway Line (Silver Line) Project.
4. As per GO read as 5th paper above the Detailed Project Report (DPR) and
alignment thereof of "Silver Line" (Semi High Speed Rail Corridor) between
Thiruvananthapuram and Kasargod prepared by M/s SYSTRA has been approved and the
Managing Director, KRDCL was directed to approach financial institutions, nationalized
banks etc for the funding of the cost of Land Acquisition, Rehabilitation & Resettlement.
Permission was also granted to approach JICA, KfW, ADB & AIIB for meeting the debt
portion.
5. The Managing Director, KRDCL as per the letters read as 6th paper above has
requested to accord sanction for the acquisition of 955.13 Hectares of land of various
villages of Thiruvananthapuram, Kollam, Alappuzha, Pathanamthitta, Kottayam,
Ernakulam, Thrissur, Malappuram, Kozhikode, Kannur & Kasargod for Semi High Speed
Railway Line (Silver Line) Project as detailed below:

6. The Commissioner, Land Revenue in the letter read as 7th paper above has
informed that 11 Special Tahsildar LA Offices based at Thiruvananthapuram, Kollam,
Alappuzha, Pathanamthitta, Kottayam, Ernakulam, Thrissur, Malappuram, Kozhikode,
Kannur & Kasargod consisting of the following 18 staff needs to be created exclusively for
the acquisition of land for Semi High Speed Railway Line (Silver Line) Project from
Thiruvananthapuram to Kasargod. Further a Special Deputy Collector office consisting of
the following 8 staff may also be created for effective coordination. It has been informed
that an amount of Rs 13,49,47,730/- (Rs Thirteen Crores Forty Nine Lakhs Fourty Seven
Thousand Seven Hundred & Thirty Only) is required as establishment charges (ie the salary
& other expenses of the staff working in the LA units) for an year (12 months + 1 month
surrender + other allowances) for running the Special Deputy Collector Office & 11 Special
Tahsildar LA Offices.

7. As per the G.O read as 8th paper above, sanction was accorded by Transport
Department for the following preparatory works for land acquisition for the proposed Semi
High Speed Railway Line (Silver Line) Project by availing a loan of Rs 2100 Crores from
KIIFB.

“ 1. (a) Social Impact Assessment study as contemplated in the LARR Act, 2013 will be
conducted by issuance of 4(1) notification and an expert committee would be constituted to
evaluate the Social Impact Assessment (SIA) study report.

(b) Govt. order to proceed with the Land Acquisition as per sub-section (2) of
section (8) of LARR Act, 2013 will be issued only after getting final approval for the
project from the Railway board.

(2) Contingency charges as provided in Rule 4(3) of LARR Rules, 2015, r/w G.O(P)
17/2018/RD dated 12.04.2018 would be deposited by the Requisitioning Authority
(KRDCL) in the relevant head of account of LAO.

(3) Minimum Special LA units will be created by Govt. exclusively for the Land
Acquisition of Semi High Speed Railway Line (Silver Line). The establishment charges
(Salary and other expenses) for running the Special Units shall be met by KRDCL from the
funds provided by the State Govt. for the purpose, only after getting the project approved
by Govt. of India and Railway Board.

8. Govt. have examined the matter in detail and are pleased to accord sanction for
the following:

1. Sanction is accorded for the creation of a Special Deputy Collector office consisting
of 7 posts based at Ernakulam and 11 Special Tahsildar LA Offices based at
Thiruvananthapuram, Kollam, Alappuzha, Pathanamthitta, Kottayam, Ernakulam, Thrissur,
Malappuram, Kozhikode, Kannur & Kasargod consisting of 18 posts each as per the
following pattern exclusively for the acquisition of Semi High Speed Railway Line (Silver
Line) Project.

The above Special Deputy Collector Office & 11 Special Tahsildar Office s are created
subject to the following conditions:

a ) T h e 6 posts attached to Special Deputy Collector Office (other than the 1 post of
Computer Operator on contract) and 18 posts each attached to the 11 Special Tahsildar
Office are created temporarily for a period of one year and to make fresh appointment.

b ) One post of Compuer Operator attached to Special Deputy Collector Office may be
created on contract basis and KRDCL will take steps for the recruitment of the candidates
on contract.

c) The establishment charges to the tune of Rs 13,49,47,730/- for an year has to be borne by
the Requisitioning Authority, KRDCL

2. Sanction is accorded for the acquisition of 955.13 Hectares of land of various

villages of Thiruvananthapuram, Kollam, Alappuzha, Pathanamthitta, Kottayam,
Ernakulam, Thrissur, Malappuram, Kozhikode, Kannur & Kasargod districts as detailed
above for Semi High Speed Railway Line (Silver Line) Project by invoking the provisions
contained in LARR Act, 2013 subject to the following conditions:

(a) Social Impact Assessment study as contemplated in the LARR Act, 2013 will be
conducted by issuance of 4(1) notification from the State Level Social Impact Assessment
(SIA) agencies empaneled for the purpose and an expert committee would be constituted to
evaluate the Social Impact Assessment (SIA) study report.

(b) The decision of the Govt. to proceed with the Land Acquisition as per sub-section
 File No.REV-B1/322/2020-REV

(2) of section (8) of LARR Act, 2013 on receipt of the SIA report, Expert Committee
recommendation and the recommendation of the District Collector concerned will be issued
only after getting final approval for the project from the Railway board.

(c) The District Collector shall ensue that the requisitioning authority has
deposited 5% Contingency Charges of the cost of compensation or Rupees fifty lakhs
whichever is less as provided in Rule 4(3) of LARR Rules, 2015 r/w G.O(P) No.17/18/RD
dated 12.04.18, in the TSB account before proceeding with the acquisition. Before issuance
of 19(1) Declaration the District Collector should also ensure that the balance entire cost of
compensation as provided in Rule 4(6) of LARR Rules, 2015 has been deposited by the
requisitioning authority in the TSB account or else the acquisition proceedings may be
stopped atonce.
