1. What are the LEGAL SOURCES of firearms?

•The ownership of firearms in the Philippines is regulated by the Firearms and Explosives Division of the
Philippine National Police. In order to possess a firearm in the Philippines, a person must be at a
minimum age of 21 years and pass a background check to be issued a Possession License. They must also
take a firearms training and safety course. Any history of mental illnesses or domestic violence within
the individual or the family will cause an applicant to have his request rejected.

2. Is hunting permits allowed under the law? Who issue hunting permit?

•Hunting License Required A person may take a game animal only if that person has been issued a
hunting license authorizing the taking of that species of game animal. Hunting licenses may be obtained
from the local office of the Division of Fish and Wildlife, or from an authorized agent. License or
"Certificate of Origin" Letter to be in Possession A person must carry a valid CNMI hunting license while
hunting.

•All treasure-hunting licenses or permits, including those for treasure-hunting within the territorial
waters of the Philippines, shall forthwith be issued by the Office of the President.

3. State the liability of a juridical person under RA 10591. Explain.

•The penalty of prision mayor in its minimum to prision mayor in its medium period shall be imposed
upon the owner, president, manager, director or other responsible officer of/any public or private firm,
company, corporation or entity who shall willfully or knowingly allow any of the firearms owned by such
firm, company, corporation or entity to be used by any person or persons found guilty of violating the
provisions of the preceding section, or willfully or knowingly allow any of them to use unregistered
firearm or firearms without any legal authority to be carried outside of their residence in the course of
their employment.

4. When will the penalty of one degree higher be imposed upon any person who shall unlawfully
possessed firearm? What are the conditions?

•The penalty of one 1degree higher than that provided in paragraphs (a) to (c) in this section shall be
imposed upon any person who shall unlawfully possess any firearm under any or combination of the
following conditions:

1.Loaded with ammunition or inserted with a loaded magazine;

2. Fitted or mounted with laser or any gadget used to guide the shooter to hit the target such as thermal
weapon sight (TWS) and the like;

3. Fitted or mounted with sniper scopes, firearm muffler or firearm silencer;


4. Accompanied with an extra barrel; and

5. Converted to be capable of firing full automatic bursts.

5. What is the duration of the following penalty?


a. Arresto Menor - The duration of the penalty of arresto menor shall be from one day to thirty days.
Bond to keep the peace.
b. Arresto Mayor - The duration of the penalty or arresto mayor shall be from one month and one day
to six months.
c. Prision Correctional - suspension, and destierro- 6 months and 1 day to 6 years
d. Prision Mayor - Temporary Disqualification- 6 years and 1 day to 12 years
e. Reclusion Temporal - 12 years and 1 day to 20 years
f. Reclusion Perpetua - imprisonment for at least thirty [30] years after which the convict becomes
eligible for pardon. It also carries with it accessory penalties, namely: perpetual special disqualification,
etc.
