Section – 1 Application
The Payment of Gratuity Act 1972 applies to the whole of India and so
far, as it relates to ports and plantations it does not apply to the State
of Jammu and Kashmir. It applies to:
Nomination (Sec 6)
• Each employee who has completed one year of service is
required to make a nomination for the purposes of gratuity in
case of his death. There can be more than one nominee. (Form
F).
• Nominees may be changed at any time by the employee, by
giving a written notice to the employer. (Form H).
• If no nomination has been made, it shall be paid to the legal
heirs of the deceased employee or if the heirs are minor, the
share of such minor shall be deposited by the controlling
authority with a bank till he attains maturity.
Section 7: Determination of the amount of
gratuity
• A person who is eligible for payment of gratuity under this Act
or any person authorized, in writing, to act on his behalf shall
send a written application to the employer, within such time
and in such form, as may be prescribed, for payment of such
gratuity.
• As soon as gratuity becomes payable, the employer shall,
whether an application referred to in sub-section (1) has been
made or not, determine the amount of gratuity and give notice
in writing to the person to whom the gratuity is payable and
also to the controlling authority specifying the amount of
gratuity so determined
• The employer shall arrange to pay the amount of gratuity
within thirty days from the date it becomes payable to the
person to whom the gratuity is payable.
• If the amount of gratuity is not paid within the said period of
time, then the employer shall pay interest along with that
provided that such delay is due to the fault of employee
