AFFIDAVIT

I, TERESA KIMAYONG – ADCHAO, of legal age, Filipino citizen and

resident of Bocos, Banaue, Ifugao, after having been duly sworn to in accordance with
law, depose and state THAT:

1. The rice field located at Ipayyaya, Poblacion, Banaue, Ifugao owned by my parent
Kimmayong Yogyog was given to me by virtue of the Ifugao custom called
“baddang”;

2. The said rice field was later registered under the name of my daughter, Dominga
Adchao through an Extra Judicial Settlement of Estate with Waiver of Rights on
September 30, 2004;

3. Since time immemorial, our family has been cultivating the above – mentioned
land and planting it with rice crops;

4. Sometime in the year of 1990s’, my sister, Mrs. Teresa Puddunan, and Mrs. Teresa
Diagan came to our house and asked me that the said rice field will be used as a
collateral for the loan of my sister;

5. The said loan was not paid by my sister. They (my sister and Terese Diagan) later
asked permission that Mrs. Diagan will be erecting a concrete house so that the
interest of the above – mentioned loan will stop. Later, if my family will pay the
expenses of the concrete house, said building will be owned by our family;

6. At first, I was hesitant because it is my lot but my sister and Mrs. Diagan
persuaded me to agree with their proposals. Because of the assurance of my sister
and Mrs. Diagan, I later agreed to their proposal with the understanding that they
will vacate the premises whenever my family will use the land upon payment of
the expenses of the building to which they also readily agreed;

7. Sometime in 2015, without our knowledge, Mrs. Judith Bulayungan returned the
expenses used to build the concrete house including the loan of my sister in favor
of Teresa Diagan;

8. I and my daughter, Dominga Adchao, told my sister, Mrs. Teresa Puddunan, that
we will return the money of Mrs. Judith Bulayngan which was used to pay the
loan and the building. Unknowingly, without our knowledge and with intent to
defraud me, the daughter of my sister returned the money of Judith Bulayungan;

9. I then told my daughter, Dominga Adchao, to reimburse the money paid by my

sister so that we can now use the land for our family;

10. Sometime in February 2021, my daughter, Dominga Adchao decided to return the
money to Teresa Puddunan. She also told Mrs. Teresa Puddunan to stop improving
the area because they keep on improving it despite our opposition;

 11. We were shocked that my sister deliberately refused to turn over possession of our
lot. My daughter then brought the matter before the Office of the Punong
Barangay of Poblacion, Banaue, Ifugao. Despite the agreement in the barangay
that Mrs. Teresa Puddunan will stop improving the building, she continues her
illegal acts on improving the area;

12. During the hearing, an agreement was finalized but my sister deliberately refused
to sign it;

13. I am executing this Affidavit to attest the truth of the foregoing and in support of
the claim of Dominga Adchao and for all legal intents and purposes it may serve.
