WAIVER AND RELINQUISHMENT OF RIGHTS

I, CELEDONIO P. ESPIRITU, of legal age, Filipino and presently residing at Quirino,

Cordon, Isabela, after having duly sworn to in accordance with the law, hereby
depose and state:

1. That I am the actual tiller and cultivator of that certain parcel of land identified as
Lot No. 2367-B-1, Csd-2-02-003979-D, being a portion of Lot No. 2367-B, Psd-20111-
D, situated in Taringsing, Cordon, Isabela, containing an area of 14, 195 square
meters, more or less;
2. That I acquired my tillage and cultivation rights over the above-said parcel of land
possession through the Deed of Quitclaim executed in my favor by Atty. Pacifico
Rosete (now deceased) of which the said instrument was considered as simulated
one because I know for a fact that the true and lawful owner over the said parcel of
land is ATTY. CESAR C. DACANAY, of legal age, Filipino and presently residing at 18-J,
Brgy. Bungad, Miller Compound, SFDM, Quezon City;
3. That said ATTY. CESAR C. DACANAY is now intending to sell the above-said parcel
of land and that I am very much willing to surrender my tillage, possession,
cultivation and rights over the said parcel of land unto and in favor of ATTY. CESAR
C. DACANAY, the true and lawful owner thereof;
4. That I am properly compensated and received such amount to my full and entire
satisfaction, I hereby waive, relinquish and voluntarily surrender all my rights,
possession, cultivation and tillage over the above-said parcel of land unto and in
favor of ATTY. CESAR C. DACANAY;
5. That I execute this instrument with my own freewill and volition and that no force,
threat or intimidation was employed against my person;
6. That I execute this affidavit to attest to the truth of the foregoing allegations and
declare to the veracity thereof in support for whatever legal purpose and intent this
may serve.
