DEED OF UNDERTAKING

KNOW ALL MEN BY THESE PRESENTS:

That this Deed of Undertaking made and executed by:

CASES COLLECTION MANAGEMENT, INC. , a


corporation duly organized and existing under and by
virtue of the Philippine laws, with principal office at 10 th
Floor, Rufino Pacific Tower, 6784 Ayala Avenue cor.
Rufino Street, Legaspi Village, Makati City, represented in
this act by its President, PAULINO E. CASES JR.,
hereinafter referred to as the “COLLECTION AGENCY”.

The Pag-IBIG FUND, a government financial institution


organized and existing under and by virtue of Republic Act
No. 9679, with principal office at the Petron MegaPlaza,
No. 358 Sen. Gil Puyat Avenue, Makati City, represented
in this act by its Chief Executive Officer, MR. ACMAD
RIZALDY P. MOTI, hereinafter referred to as the “Pag-
IBIG Fund”;

WITNESSETH:

WHEREAS, the Pag-IBIG Fund has engaged the services of the


COLLECTION AGENCY to perform extra-judicial foreclosure on Real Estate
Mortgage (REM) accounts pursuant to the Supplemental Memorandum of
Agreement on Collection Services (Supplemental MOA) executed on March 15,
2019 and docketed and docketed as Doc. No. 40, Page No. 09, Book No. VIII,
Series of 2020, on Notarial Register of Atty. Deborah R. Capili, Notary Public for
and in Makati City.

WHEREAS, the COLLECTION AGENCY, is obligated, under the said


Supplemental MOA to cause the annotation of the Certificate of Sale (COS) on the
Transfer Certificate of Title (TCT)/Condominium Certificate of Title (CCT) of the
foreclosed property.

WHEREAS, to effect the annotation of the COS, the duplicate original


TCT/CCT shall be released to the COLLECTION AGENCY upon availability of the
COS in accordance with the Supplemental MOA.

NOW, THEREFORE, for and in consideration of the foregoing premises and the
agreements and stipulations contained hereunder, the COLLECTION AGENCY
and its authorized representative hereby undertake and bind themselves, as
follows:

1. To hold in trust the duplicate original copy/ies of the following TCTs/CCTs


received from Pag-IBIG Fund:

2. To cause the annotation of the COS on the above-mentioned TCTs/CCTs


of the foreclosed property/ies.

3. To return the following documents to Pag-IBIG Fund within ninety (90)


days from the receipt of the TCTs/CCTs bearing the COS annotation
pursuant to Section 5(c) of the Supplemental Memorandum of Agreement
on Collection Services:

a. The TCTs/CCTs under the name of the individual buyer/borrower with


annotation of the COS in favor of Pag-IBIG Fund at the back thereof.

In the event of delay of submission of the annotated TCTs/CCTs due to


whatever reason except when due to force majeure as defined under
Sec. 30.5 of the Principal Agreement, shall be considered as a major
offense subject to the sanctions provided in Section 21.3. thereof. In
case of anticipated delay, the COLLECTION AGENCY may file a
request for extension of time of at least fifteen (15) days from the
deadline.

b. Foreclosure folder together with the original copies of all home financing
documents used during the foreclosure process.

4. That in the event of loss or damage to the TCT/CCT, the COLLECTION


AGENCY shall secure a new TCT/CCT with the COS annotation at its own
expense.

The liability for a new TCT/CCT is extant once it is released to the collection
agency and is lost or damaged prior to its return to Pag-IBIG Fund, not just
during the annotation process.

5. This undertaking is an implementing document of the Supplemental MOA


mentioned herein, with respect to the registration of the COS on the
TCT/CCT, and shall form an integral part thereof.
