Before you can start commercial operation a mine needs an ”environmental compliance certificate”.
TERMS
Environment – refers to the physical factors of the total surroundings of human beings, including land, water,
atmosphere, climate, sound, odors, tastes, the biological factors of animals and plants and the social factors of
aesthetic. In broad sense, it shall include the total environment of human beings such as economic, social,
cultural, political and historical factors.
Environmental impacts
-refers to the probable effects or consequences of proposed projects or undertakings on the physical,
biological and socio economic environment that can be direct or indirect, cumulative and positive or negative.
Effluent
-any wastewater, partially or completely treated, or any waste liquid flowing out of mining operations,
wastewater treatment plans or tailings disposal system.
Carrying capacity
-capacity of natural and human environment to accommodate and absorb change without experiencing
conditions of instability and attendant degradation.
Pollution
Any alteration of the physical, chemical and/or biological properties of any water, air/or land resources of
the Philippines; or any discharge thereto of any liquid, gaseous or solid wastes; or any production of unnecessary
noise or any emission of objectable odor, as will or is likely to create or to tender such water, air and land
resources harmful, detrimental or injurious to public health, safety, commercial, industrial, agricultural,
recreational or other legitimate purposes.
Scoping
-define the range of actions, alternatives, and impacts that are to be examined.
MIDTERM

SUBJECT: Revised implementing Rules and regulations of Republic act No. 7942 otherwise known as the
“Philippine Mining Act of 1995”
e. The Permittee shall submit to the Bureau/concerned Regional Office within thirty(30) calendar days
from the end of six(6) months after the approval of the Environmental Work Program (EWP) and every six (6)
months thereafter a status report on its compliance with the said EWP.
e. Environmental Work Program Form No. 16-1 or MGB Form. 16-1A as provided for in Section 168 hereof; and
“Note: The exploration permit is good for 2 years and renewable for another 6 years”
4. Environmental Work Program(MGB Form No. 16-1 or MGB Form No. 16-1A) during the exploration
period as provided for in section 168 hereof or Environmental Compliance Certificate prior to development,
construction and/or utilization and Environmental Protection and Enhancement Program(MGB Form No. 16-2) as
provided for in section 169 thereof;
5. Proof of technical competence including, among others, curricula vitae and track records in mining
operations and Environmental Management of the technical personnel who shall undertake the activities in
accordance with the submitted Exploration/Development/Utilization Work programs and environmental
Work/Environmental Protection and Enhancement Program, as deemed applicable;
Consistent with the basic policy of the State to assure the availability, sustainability and equitable distribution of
the country’s natural resources, the Department adopts the policy that mining activities attendant to permits
agreements and leases shall be managed in a technically, financially, socially, culturally and environmentally
responsible manner to promote the general welfare of the country and the sustainable development objectives
and responsibilities as provided for in these implementing rules and regulations.
b. Establishment of a functional post-disturbance land use capability : Minesite decommissioning and rehabilitation
shall aim to establish a land use capability that is functional and proximate to the land use prior to the disturbance
of the mine area, unless other more beneficial land uses are predetermined and agreed in partnership with local
communities and Local Government Units;
c. Preservation of downstream freshwater quality; The quality of surface and ground water emanating from the
exploration or contract/lease areas shall be maintained at acceptable levels, as determined from the actual and/or
potential downstream water uses;
d. Preservation of sea water quality and natural habitats for marine life;
f. Respect for the traditional and/or sustainable management strategies concerning natural resources of
Indigenous Cultural Communities and other communities.
To implement measures for environmental protection and enhancements, in accordance with the
conditions prescribed under the Environmental Compliance Certificate and the plan for mining operations.
Allocation of at least 10% initial capital cost for the environment-related infrastructures during
development/pre-operation stage.
Allocation of at least 3-5% of the direct mining and milling cost for annual environmental protection thru
the approved EPEP
Establishment of the Mine Rehabilitation Fund to ensure availability of funds for implementation of
commitments/strategies under EPEP
Creation of the Multipartite Monitoring Team to monitor the implementation of EPEP and other
environmental activities.
Document prepared to effectively implement the approved EPEP and shall be implemented during the
year for which it is submitted.
Description of expected acceptable impacts and set out the environmental protection strategies based on
the best practices in mining relative to exploration works.
Adverse impacts
Significant
Required under P.D. 1586 or the Philippine EIS system and issued by DENR to certify that the project will
have a minimal environmental effects as long as the conditions of the ECC are strictly followed.
A proof of the company’s satisfactory relationship with the local communities and acceptable
environmental management in the past.
To implement the planned mine closure where environmental, social and economic considerations
associated with a mining project are integrated in to every stages of mining operations
Requires the ff:
Establishment of Fund(FMR/DP) exclusive for final mine closure/rehabilitation during the early
stage of mining operations.
Annual allocation of cash for the fund starting from the first year of the expected mine life.
These are fees collected semi-annually from each operating mining company based on the
amount of mine waste and tailing it generated for the said period to be used for payment of
compensation for damages caused by any mining operations.
Php. 0.05/MT of mine waste produced
Php. 0.10/MT of mill tailings generated.
