MARIO’S BAD DAY

BizOps Steel has a full set of WHS policies and procedures, which quote lengthy parts of the
Act, regulations and codes of practice in legal terms. Workplace hazards are communicated
to staff but often only in writing, via notice-boards and the company intranet. Managing
Director, Dave Donga, instructed his supervisors to consult with workers to enable their
participation in managing hazards, but they don’t all bother to do so.

Every worker is meant to be given general induction training about WHS and issued with
appropriate PPE, but they don’t always wear them. It is an industry code of practice that
workers should not start work on a site if they are alone, and another says they should never
attempt to remove heavy loads without a colleague to check safety precautions.

Like many of his workmates, new employee Mario Lanza does not have English as his first
language and is not very literate, so he found it difficult to understand his training. One day,
Mario and Kim are told to remove a large cabinet from the second floor of an unused
building. Kim is Mario’s mentor but, when Kim feels sick and goes to the toilet, Mario
begins the task by himself. No-one is supervising him.

Mario uses a crane with a steel chain to lift the cabinet (he has not yet received training on
using the crane because no-one checked whether he needed it). When the cabinet is a
meter off the ground, the chain catches on a steel bar. Workers have previously reported
that this bar is a problem but nothing has been done about it.

With the cabinet suspended above the ground, Mario removes the steel bar with an oxy cutter.
Because the cabinet is suspended unevenly, the steel bar is bearing some of the weight of
the cabinet. As the bar is cut, the cabinet slips sideways and traps his arm, inflicting severe
injuries. Mario is working alone on the site, so the alarm is not raised until another crew
arrives at the site twenty minutes after later. Emergency Services staff free Mario’s arm
and take him to hospital for surgery.

After the accident, management talks to the parties involved and reviews the WHS policies
and procedures, especially by identifying inadequacies in existing controls, checking that WHS
training needs are properly addressed, creating better processes for auctioning hazards, and

Brett Bloggs is the supervisor of the team that Mario belonged to. He must now take action to
prevent a recurrence in the future. Brett’s team has received WHS training for their roles as
per the policies of the organization, but this incident shows that not everyone is complying
