ELECTRICAL FACILITIES

KNOW ALL MEN BY THESE PRESENT:

This DEED OF TURNOVER AND ACCEPTANCE OF ELECTRICAL FACILITIES
MADE and entered into at Balud, Masbate Philippines this Day of
2021, by and between:

The LOCAL GOVERNMENT UNIT - BALUD, a government entity

with principal office at Poblacion, Balud, Masbate, represented in this Act
by its Municipal Mayor HON. RUBEN JUDE D. LIM and hereinafter
referred to as the “LGU-BALUD”;
-and -
The MASBATE ELECTRICAL COOPERATIVE duly organized
electrical cooperative, with principal office at Brgy. Pinamarbuhan, Mobo,
Masbate, herein represented by its acting General Manager, ENGR.

Municipal Mayor WHEREAS, in Actingorder General Manager
to accommodate families affected Witness
by the
Witness infrastructure projects of the National / local Government and those
underprivileged families who are ejected from their dwellings by virtue of court
order including families living in danger areas as well as other informal settler
families qualified for relocation and resettlement assistance under republic act
7279 (UDHA) , the NHA implemented the Land Development And Core Housing
Construction for Balud Resettlement Project, herein after referred to as the
“Project” located at Brgy. Tonga, Balud, Masbate.

WHEREAS, in accordance with the plans and specifications, physical

development was undertaken which includes the provision of electrical facilities
and its appurtenances;

WHEREAS, in order to complete the power supply installation and

electrification works in the Project, the LGU-BALUD has engaged the services
and resources of the Hi-Tri Development Corporation under a Contract of
Agreement covering the installation of electrical distribution system in the
Project;

WHEREAS, there is a need to transfer the completed electrical facilities of

said Project to MASELCO to enable said agency to administer said facilities and
to utilize, maintain and/or to improve the same in accordance with its function
and responsibilities pertaining such facilities;
 WHEREAS, pursuant to NHA Board Resolution No. 4415 dated 27 May
1999 NHA General Manager was authorized to turnover/donate the completed
project components falling under the operation/ maintenance of other agencies;
WHEREAS, the MASELCO has accepted the turnover of the said electrical
facilities and its appurtenances.
NOW, THEREFORE, for and in consideration of the premises and
conditions hereinafter set forth, the NHA by these presents, hereby conveys,
cedes, and transfers by way of turnover in favor of the MASELCO the above
mentioned electrical facilities in the aggregate amount of Seven Hundred Eight
Thousand Pesos (P 708,000.00) as per final Quantification duly approved by the
NHA General Manager hereto attached as Annex “A” and as reflected in the As-
Built Plan hereto attached as Annex “B” and made integral parts of this
document.
This turnover shall be subjected to the following terms and conditions:
1. That the electrical facilities hereby being turned over shall be exclusively
utilized by the MASELCO for the production and/or provision of electrical power
supply to residents and beneficiaries of the project and not for any other
purposes;
2. That the MASELCO shall not alter or modify the use of the electrical facilities
nor shall it cede, sell, transfer or lease or in any manner encumber or dispose of,
in whole or in part, the electrical facilities without prior written approval of the
NHA Board of Directors;
3. That all expenses relative to the administration, operation, maintenance and
rehabilitation of said facilities shall be for the account of the MASELCO;
4. That the MASELCO does hereby accept without qualification whatsoever this
transfer made in its favor by the LGU-BALUD under the afore-cited terms and
conditions.
IN WITNESS WHEREOF, the parties hereto have caused this Deed to be
signed in the place and on the date herein above written.
