Terms and conditions of use

Please read these terms and conditions carefully before using SeleCalc. This is a legal agreement
between you (the end user) and Habasit AG (hereafter Habasit).

SeleCalc is provided by Habasit AG, Reinach, Switzerland. By using SeleCalc or downloading

additional material from the internet, you agree to abide by the terms and conditions set forth in this
notice. If you do not agree to abide by these terms and conditions do not use the SeleCalc or
download material to update SeleCalc.

1. Applicable Law and Jurisdiction

This agreement is governed by the laws of Switzerland. Any dispute arising out of or in
connection with this agreement shall be submitted to the exclusive jurisdiction of the courts of
Basel land (BL).

2. Copyright
SeleCalc and all copyright and other rights in it are owned by Habasit and are protected by
international treaty provisions and all other applicable national laws.

3. SeleCalc License Agreement

3.1 Object of License

This license agreement applies to one copy out of a family of proprietary software stored on a CD-
ROM (hereafter SeleCalc) and any other material provided to you in connection with SeleCalc,
including, but not limited to the installation guide.

3.2 Grant of License

3.2.1 Habasit grants you the right by a free license to personally use one copy of SeleCalc on a
single computer or terminal for the purposes specified in the installation guide provided to you with
SeleCalc.
3.2.2 You may not use, copy, modify, or transfer the right to use SeleCalc or any copy thereof
except as explicitly stated in this agreement.
3.2.3 You may either (a) make one copy of SeleCalc for archival purposes or (b) transfer SeleCalc
to a single hard disk, provided that you keep the original solely for archival purposes. All copyright
notices must be included on the archival copy.
3.2.4 You may not reverse engineer, decompile or disassemble SeleCalc, except to the extent such
acts may not be prohibited by law in the country or area of use.

3.3 Limited Warranty

3.3.1 Habasit warrants the CD-ROM of SeleCalc is furnished to be free from defects in materials
and workmanship under normal use for a period of ninety (90) days from the date of delivery to you.
This warranty is limited to the original receiver and is not transferable. This limited warranty is void if
failure of the software has resulted from accident, abuse or misapplication.
3.3.2 During the ninety (90) days' warranty period Habasit will replace the CD-ROM not meeting the
foregoing warranty and which is returned to Habasit.
3.3.3 HABASIT DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED,
INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS

FOR A PARTICULAR PURPOSE, WITH RESPECT TO SELECALC. THERE IS NO WARRANTY BY
HABASIT OR ANY OTHER PARTY OR PERSON THAT THE FUNCTIONS CONTAINED IN THE
SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE
SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ASSUME ALL RESPONSIBILITY
FOR THE SELECTION OF THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR
THE INSTALLATION, USE AND RESULTS OBTAINED FROM IT.

3.3.4 HABASIT SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING,
WITHOUT LIMITATION COSTS OF PROCUREMENT OF SUBSTITUTE GOODS, PROPERTY
DAMAGE, PERSONAL INJURY, LOSS OF PROFITS, INTERRUPTION OF BUSINESS, OR FOR
ANY OTHER SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES) ARISING OUT OF THE
USE OF OR INABILITY TO USE SELECALC, EVEN IF HABASIT OR ITS SUPPLIERS OR THE
OTHER PARTY OR PERSON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

3.4 Termination of License

3.4.1 You may terminate this agreement at any time by destroying the SeleCalc Software and any
copy of it.
3.4.2 Habasit may terminate this agreement with immediate effect, if you fail to comply with these
terms and conditions.
3.4.3 Habasit may also terminate this agreement by giving you 30 days notice.
3.4.4 In any event, you shall destroy the SeleCalc software and any copy of it upon termination.

3.5 Export Control Regulations

You agree to follow all export control regulations relating to the SeleCalc family of software.

4. Privacy
4.1 Privacy Statement

Habasit AG and its affiliated companies are committed to protecting any personal information that you
may provide to us. In particular, we believe it is important for you to know how we treat information
about you that we may receive from you using SeleCalc.

4.2 Security of Collected Information

We maintain strict physical, electronic, and administrative safeguards to protect your personal
information from unauthorized or inappropriate access. We restrict access to information about you to
those Habasit employees who need to know the information to respond to your inquiry or request.

4.3 Use of Collected Information

If you register SeleCalc, you will disclose some information about you that Habasit may use to provide
you with information about offerings in support of your business needs. By using SeleCalc, you agree
to such use of the information you have provided. If you do not wish Habasit to send you information
about offerings in support of your business needs, you should contact us at the address set out below.

5. Product liability, application consideration

If the proper selection and application of Habasit products are not recommended by an authorized
Habasit sales specialist, the selection and application of Habasit products, including the related area
of product safety, are the responsibility of the customer.
All indications / information are recommendations and believed to be reliable, but no representations,
guarantees, or warranties of any kind are made as to their accuracy or suitability for particular
applications. The data provided herein are based on laboratory work with small-scale test equipment,
running at standard conditions, and do not necessarily match product performance in industrial use.
New knowledge and experiences can lead to modifications and changes within a short time without
prior notice.

BECAUSE CONDITIONS OF USE ARE OUTSIDE OF HABASIT'S AND ITS AFFILIATED

COMPANIES CONTROL, WE CANNOT ASSUME ANY LIABILITY CONCERNING THE SUITABILITY
AND PROCESS ABILITY OF THE PRODUCTS MENTIONED HEREIN. THIS ALSO APPLIES TO
PROCESS RESULTS / OUTPUT / MANUFACTURING GOODS AS WELL AS TO POSSIBLE
DEFECTS, DAMAGES, CONSEQUENTIAL DAMAGES, AND FURTHER-REACHING
CONSEQUENCES.
