S. 10 of Punjab Shops and Commercial Establishments Act, 19581 provides for a
mandatory close day. Exceptions to this are mentioned in Section 4 of the Act
(Section 4 gives an exhaustive list of all establishments that do not have to
mandatorily adhere to the ‘close day’)

Tamil Nadu (not needed)


A government Notification in 20192 exempted all shops and commercial
establishments, employing 10 or more persons, from S. 7(1) and S. 13(1) (these 2
provisions deal with opening and closing hours) and permits to keep open for 24x7 on
all days of the year, for a period of 3 years from the date of publication of this
notification.

Maharashtra
As per the Maharashtra shops and establishments (regulation of employment and
conditions of service) Act 20173 (S. 16b) all shops and establishments with 10 ore
more employees can remain open 24x7.4
In furtherance to the enforcement of the Act, the Government of Maharashtra vide
notification dated March 23rd, 2018 has released the Maharashtra Shops and
Establishments (Regulation of Employment and Conditions of Service) Rules, 2018
(“Rules”).

West Bengal
The Government of West Bengal, Department of Labour, vide Notification No.
Labr./816/LC-IR)/IR/7S-09/105 has exempted all classes of shops and establishments
in West Bengal from being closed on one day, every week, as provided u/s 5.(1)(a)6 of
the WB S& E Act, 1963.

Rajasthan
The Rajasthan Government by notification published in the Official Gazette dated
19th May 2017 has exempted all shops and commercial establishments employing

five or more employees from the provision of Section 12 (1) 7"Weekly Holiday" for a
period of three years from 19th May 2017.

Uttar Pradesh
Section 8 of U.P Dookan Aur Vanijya Adhishthan Adhiniyam, 1962 calls for weekly
holiday. Schedule II gives the exceptions for the same.8
Convinience stores, Multiplexes and Shopping Complexes have been added to
Schedule-II of the of said Act vide official notification number -1538/36-3-04 (du. va.
)/99. dated 01-06-2004 and official notification number -1539/36-3-04 (du. va. ) /99,
dated 01-06-2004; thereby the shops and Commercial establishments has
automatically got exemption from section-5 (daily closure time) and section-8
(weekly closure).

Delhi
Schedule I of the act provides the exceptions to S. 16 (close day).9

Goa
Section 8 – weekly holiday.10

Kerala
Section 11 of the act mandates 1 day closure of shops every week.11

Andhra Pradesh/ Telangana


The State Government of Telangana on July 24, 2019, has permitted all the Shops and
Establishments to keep open on all 365 days of the year in Telangana State for a
further period of three years with effect from June 16, 2019.

Model shops and Establishments Act 2016


S. 10(2) provides for the exception.12
It does not automatically become a law as the onus will be on the state governments to
adopt the central government’s proposed model Act for retailing. The act will also not
go to the Parliament as it is just a model legislation and is not binding on states.
