JUDICIAL COUNTER AFFIDAVIT OF BERNARDITO

Ako si Bernardito, Filipino, hingkud na panuigon, minjo, ug residente sa Brgy. Mambajao, Maasin City,
Southern Leyte human manumpa subay sa balaod mag-asoy niining musunod.

(I, BERNARDITO, Filipino, of legal age, married, and a resident of Brgy. Mambajao, Maasin City,
Southern Leyte, after having sworn to an oath in accordance with the law hereby depose and state):

PRELIMINARY STATEMENT

Ang akong Judicial Affidavit gikuha sa bisaya na sinultian, sinultian na ahong nasinati, pinaagi ni Atty.
Kimberly Sheen Q. Tabada, Public Attorney sa Public Attorney’s Office. Ang ilang opisina nahimutang sa Bulwagan
ng Katarungan, Capitol Site, Brgy. Asuncion, siyudad sa Maasin. Ang akong asoy gikuha niadtong January 29, 2019.
Ang pangutana sa abogada ahong gitubag nga nga nakahibawo nga kining akong asoy gihimu subay sa akong
gipanumpaan ubos sa balaod ug ako pwede nga muatubang ug kasong criminal kung tingali muhatag ako ug
bakak na salaysay.

(My Judicial Affidavit was taken in the Bisayan dialect, the language I understand, taken by Atty.
Graziella D. Corollo, Public Attorney of the Public Attorney’s Office with an office address at the Hall of Justice,
Capitol Site, Brgy. Asuncion, Maasin City. My testimony is being taken this January 29, 2019 at their office. I am
answering the questions fully conscious that I do so under oath and I may face criminal liability in case I give
false testimony.)
1. Q: Mr. Witness, manumpa k aba nga mosulti ka lamang sa kamatuoran sa tanang kamatuoran ug way lain
kundi kamatuoran lamang?

(Mr. Witness, do you swear to tell the truth, the whole truth and nothing but the truth?)

A: Oo, ma’am

( Yes, ma’am.)

2. Q: Ikaw ba si Bernardito, ang akusado ani nga kaso?

(Are you the same Bernardito who is the accused in this case?)

A: Oo, ma’am.

(Yes, ma’am.)

3. Q: Kaila kaba ni Marino Baldera, ang kihanti ani na kaso?

(Do you know Marino Baldera, the private complainant of this case?)

A: Nakaila.

(I know him)

4. Q: Nganung nakaila man ka niya?

(What was the circumstance that led you to know him, if any?)

A: Nakaila rako niya pagkahibaw nako na iya ko gikihaan.

(I just know him after he filed a case against me.)

5. Q: Nakahibaw ka ba sa rasun nganung gikasuhan ka karun?

(Do you know the reason why you are sued in this case?)

A: Nakahibaw, kay ako isip us ka contractor, nagpasugo kos akong mga taw na ipaguba ang ijang tindahan)

(Yes, I know, because as a contractor, I ordered my workers to destroy the federation store of Mr. Marino)

6. Q: Unsa man diay kamatuoran niini?

(What is the truth of this allegation?)

A: Oo, tinood kana nga ako gisugo ako mga taw na ipaguba ilang tindahan pero gibuhat to nako na walay
intensyon na moguba kay gisugo rasad kos among Punong Barangay na si Hipolito)
 (Yes, although I ordered my men to destroy the federation store of Mr. Marino, but with no intent because
our Punong Barangay Mr. Hipolito ordered me to destroy their federation store.)

7. Q: Unsa man pod rasun nganu gisugo ka ni Hipolito na ipaguba ang tindahan ni Marino?

(What is the reason of Hipolito why he ordered you to destroy the federation store of Mr. Marino?)

A: Kay kuno gisugo sad among Punong Barangay na si Hipolito ni Orlando na ipaguba ang tindahan ni Marino)

(Because our Punong Barangay was ordered by Mr. Orlando to destroy the store of Marino.)

8. Q: Kinsa man pod ni si Orlando?

(Who is Mr. Orlando?)

A: Si Orlando, residente sa Brgy. Mantahan, Maasin City, Southern Leyte ug nagtrabaho isip usa ka Principal sa
National Higschool.

(Mr. Orlando, a resident from Brgy. Mantahan, Maasin City, Southern Leyte and worked as a Principal of
the National Higschool.)

9. Q: Nganug gisugo man ni Orlando si Hipolito na ipaguba ang tindahan ni Marino?

(Why did Orlando ordered Hipolito to destroy the store of Marino?

A: Kay si Orlando man kuno nakatag-ija atong juta kung asa nakatukod ang tindahan ni Marino.

(Because Mr. Orlando is the owner of the property where the store was built.)

10. Q: May idugang ka pa ba aning imung testimonya?

(Do you wish to add something to your testimony?)

A: Wala na ma’am, sa karun.

(None ma’am as of now.)

11. Q: Imu ba ning pirmahan subay sa imung gipanumpaan?

(Will you sign this according to what you have sworn to?)

A: Oo, ma’am.

(Yes, ma’am.)

Leyte, Public Attorney of Public Attorney’s Office. Maasin City, District Office, Maasin City, Southern Leyte
after having sworn to an oath in accordance with the law hereby depose and state:

1. That I was the one who conducted and supervised the examination of the accused BERNARDITO
DELA CRUZ with respect to the taking of her testimony;
2. That I faithfully recorded or caused to be recorded the questions I asked of him and the
corresponding answers he gave,
3. That neither I nor any person present or assisting her coached her regarding his answers,
4. That I further attest that the English translation was to the best of my knowledge the correct
translation of the testimony that she gave in the bisayan dialect.
