Introduction
India has two kinds of people—citizens and aliens.
o Citizens are full members of the Indian State and owe allegiance to it. They enjoy all civil and
political rights.
o Aliens, on the other hand, are the citizens of some other state and hence, do not enjoy all the
civil and political rights.
They are of two categories—friendly aliens or enemy aliens.
o Friendly aliens are the subjects of those countries that have cordial relations with India.
o Enemy aliens, on the other hand, are the subjects of that country that is at war with India. They
enjoy lesser rights than the friendly aliens, e.g., they do not enjoy protection against arrest and
detention (Article 22).

Eligibility to hold certain public offices, that is, President of India, Vice-President of India, judges of
the Supreme Court and the high courts, governor of states, attorney general of India and advocate
general of states.
Note: In India both a citizen by birth as well as a naturalised citizen are eligible for the office of President
while in USA, only a citizen by birth and not a naturalised citizen is eligible for the office of President.
Constitutional Provisions
The Constitution deals with the citizenship from Articles 5 to 11 under Part II.
It only identifies the persons who became citizens of India at its commencement (i.e., on January
26, 1950). It does not deal with the problem of acquisition or loss of citizenship subsequent to its
commencement. It empowers the Parliament to enact a law to provide for such matters and any
other matter relating to citizenship.
Accordingly, following laws were brought about
Article 5 - A person who had his domicile in India and also fulfilled any one of the three conditions –
1. if he was born in India;
2. if either of his parents was born in India;
3. if he has been ordinarily resident in India for five years immediately before the
commencement of the Constitution, became a citizen of India.
Article 6 - A person who migrated to India from Pakistan became an Indian citizen if he or either of
his parents or any of his grandparents was born in undivided India and also fulfilled any one of the
two conditions –
1. in case he migrated to India before July 19, 1948, he had been ordinarily resident in India
since the date of his migration;
2. or in case he migrated to India on or after July 19, 1948, he had been registered as a citizen
of India. But, a person could be so registered only if he had been resident in India for six
months preceding the date of his application for registration

Article 7 - A person who migrated to Pakistan from India after March 1, 1947, but later returned to
India for resettlement could become an Indian citizen. For this, he had to be resident in India for six
months preceding the date of his application for registration.
Article 8 - A person who, or any of whose parents or grandparents, was born in undivided India but
who is ordinarily residing outside India shall become an Indian citizen if he has been registered as a
citizen of India by the diplomatic or consular representative of India in the country of his residence,
whether before or after the commencement of the Constitution. Thus, this provision covers the
overseas Indians who may want to acquire Indian citizenship.
The other constitutional provisions with respect to the citizenship are as follows:
Article 9 - No person shall be a citizen of India or be deemed to be a citizen of India, if he has
voluntarily acquired the citizenship of any foreign state.
Article 10 - Every person who is or is deemed to be a citizen of India shall continue to be such citizen,
subject to the provisions of any law made by Parliament.
Article 11 - Parliament shall have the power to make any provision with respect to the acquisition
and termination of citizenship and all other matters relating to citizenship.
1. By Birth
A person born in India between 26th January 1950 - 1st July 1987 is a citizen of India by birth
irrespective of the nationality of his parents.
A person born in India on or after 1st July 1987 is considered as a citizen of India only if either of his
parents is a citizen of India at the time of his birth.
Further, those born in India on or after 3rd December 2004 are considered citizens of India only if
both of their parents are citizens of India or one of whose parents is a citizen of India and the other is
not an illegal migrant at the time of their birth.
The children of foreign diplomats posted in India and enemy aliens cannot acquire Indian citizenship
by birth.
2. By Descent
A person born outside India, between 26/01/1950 – 10/12/1992 is a citizen of India by descent, if his
father was a citizen of India at the time of his birth.
A person born outside India on or after 10th December 1992 is considered as a citizen of India if
either of his parents is a citizen of India at the time of his birth.
From 3rd December 2004 onwards, a person born outside India shall not be a citizen of India by
descent, unless his birth is registered at an Indian consulate within one year of the date of birth or
with the permission of the Central Government, after the expiry of the said period.

An application, for registration of the birth of a minor child, to an Indian consulate shall be
accompanied by an undertaking in writing from the parents of such minor child that he or she does
not hold the passport of another country.
Further, a minor who is a citizen of India by virtue of descent and is also a citizen of any other country
shall cease to be a citizen of India if he does not renounce the citizenship or nationality of another
country within six months of his attaining full age.
3. By Registration
The Central Government may register as a citizen of India any person (not being an illegal migrant) if he
belongs to any of the following categories, namely:
a. a person of Indian origin who is ordinarily resident in India for 7 years before making an application
for registration;
b. a person of Indian origin who is ordinarily resident in any country or place outside undivided India
c. a person who is married to a citizen of India and is ordinarily resident in India for seven years before
making an application for registration
d. minor children of persons who are citizens of India
e. a person of full age and capacity whose parents are registered as citizens of India
f. a person of full age and capacity who, or either of his parents, was earlier citizen of independent
India, and is ordinarily resident in India for twelve months immediately before making an application
for registration
g. a person of full age and capacity who has been registered as an overseas citizen of India cardholder
for five years, and who is ordinarily resident in India for twelve months before making an application
for registration.
A person shall be deemed to be of Indian origin if he, or either of his parents, was born in undivided
India or in such other territory which became part of India after the 15th August, 1947. All the above
categories of persons must take an oath of allegiance before they are registered as citizens of India.
4. By Naturalisation
The Central Government may grant a certificate of naturalisation to any person:
a. that he is not a subject or citizen of any country where citizens of India are prevented from becoming
subjects or citizens of that country by naturalisation
b. that, if he is a citizen of any country, he undertakes to renounce the citizenship of that country in the
event of his application for Indian citizenship being accepted
c. that he has either resided in India or been in the service of a Government in India or partly the one
and partly the other, throughout the period of twelve months immediately preceding the date of the
application
d. that during the fourteen years immediately preceding the said period of twelve months, he has either
resided in India or been in the service of a Government in India, or partly the one and partly the
other, for periods amounting in the aggregate to not less than eleven years
e. that he is of good character
f. that he has an adequate knowledge of a language specified in the Eighth Schedule to the Constitution
g. that in the event of a certificate of naturalisation being granted to him, he intends to reside in India
However, the Government of India may waive all or any of the above conditions for naturalisation in
the case of a person who has rendered distinguished service to the science, philosophy, art,
literature, world peace or human progress.
Every naturalised citizen must take an oath of allegiance to the Constitution of India.

5. By Incorporation of Territory
If any foreign territory becomes a part of India, the Government of India specifies the persons who
among the people of the territory shall be the citizens of India.
Such persons become the citizens of India from the notified date.
For example, when Pondicherry became a part of India, the Government of India issued the
Citizenship (Pondicherry) Order, 1962, under the Citizenship Act, 1955.
2. Termination
When an Indian citizen voluntarily (consciously, knowingly and without duress, undue influence or
compulsion) acquires the citizenship of another country, his Indian citizenship automatically
terminates.
This provision, however, does not apply during a war in which India is engaged.
3. Deprivation
It is a compulsory termination of Indian citizenship by the Central government, if:
a. the citizen has obtained the citizenship by fraud:
b. the citizen has shown disloyalty to the Constitution of India
c. the citizen has unlawfully traded or communicated with the enemy during a war
d. the citizen has, within 5 years after registration or naturalisation, been imprisoned in any country for
two years
e. the citizen has been ordinarily resident out of India for seven years continuously.
SINGLE CITIZENSHIP
The Indian Constitution is federal and envisages a dual polity (Centre and states), it provides for only
a single citizenship, that is, the Indian citizenship.
The citizens in India owe allegiance only to the Union. There is no separate state citizenship.
The other federal states like USA and Switzerland, on the other hand, adopted the system of double
citizenship.
In USA, each person is not only a citizen of USA but also of the particular state to which he belongs.
Thus, he owes allegiance to both and enjoys dual sets of rights—one set conferred by the national
government and another by the state government.

This problem is avoided in the system of single citizenship prevalent in India. However, this general
rule of absence of discrimination is subject to some exceptions like –
o The Parliament (under Article 16) can prescribe residence within a state or union territory as a
condition for certain employments or appointments in that state or union territory, or local
authority or other authority within that state or union territory.
o The Constitution (under Article 15) prohibits discrimination against any citizen on grounds of
religion, race, caste, sex or place of birth and not on the ground of residence. This means that
the state can provide special benefits or give preference to its residents in matters that do not
come within the purview of the rights given by the Constitution to the Indian citizens. For
example, a state may offer concession in fees for education to its residents.
o The freedom of movement and residence (under Article 19) is subjected to the protection of
interests of any schedule tribe. This is done to protect the distinctive culture, language, customs
and manners of schedule tribes and to safeguard their traditional vocation and property against
exploitation.
o In the case of Jammu and Kashmir, the state legislature is empowered to define the persons
who are permanent residents of the state and confer any special rights and privileges in
o matters of employment under the state government,
o acquisition of immovable property in the state,
o settlement in the state and
o scholarships
o and such other forms of aid provided by the state government.

The Citizenship (Amendment) Act, 2015, has modified the provisions pertaining to the OCI in the
Principal Act.

It has introduced a new scheme called “Overseas Citizen of India Cardholder” by merging the PIO
card scheme and the OCI card scheme.

नागररक भारतीय राज् के पूणण सदस्य हैं और इसके प्रधत धनष्ठा रखते हैं । िे सभी नागररक और राजनीधतक
अधधकार प्राप्त ह ते है ।
दू सरी ओर, धिदे शी धकसी अन्य राज् के नागररक ह ते हैं इसधलए, सभी नागररक और राजनीधतक अधधकार ों
क प्राप्त नहीों करते है ।
इनकी द श्रेधणय ों ह ती हैं - धिदे शी धमत्र या धिदे शी शत्रु ।

धिदे शी धमत्र उन दे श ों के व्यक्ति हैं धजनके भारत के साथ सौहादण पूणण सोंबोंध हैं ।
दू सरी ओर, धिदे शी शत्रु , उस दे श के व्यक्ति हैं ज भारत के साथ युद्धरत्त है । िे धिदे शी धमत्र ों की तुलना में कम
अधधकार ों क प्राप्त करते है । उदाहरण के धलए, िे धगरफ्तारी और नज़रबोंदी के क्तखलाफ सुरधित नही ह ते ।

उच्च न्यायालय ,ों राज् ों के राज्पाल, भारत के महान्यायिादी और राज् ों के महाधधििा की य ग्यता रखने की
पात्रता।
नोट : भारत में नागररक जन्म लेने के साथ साथ प्राकृधतक रूप से भी राष्ट्रपधत के पद के धलए पात्र हैं , जबधक सोंयुि
राज् अमेररका में, केिल जन्म से एक नागररक राष्ट्रपधत के कायाण लय के धलए पात्र हैं , प्राकृधतक रूप से नहीों |
संवैधावनक प्रावधान
नागररक बने थे। इसमें न त इनकी नागररकता के अधधग्रहण एिों न ही नागररकता की समाक्तप्त की उल्लेख
धकया गया है ।

नागररकता अवधवनयम (1955)
प्रािधान नागररकता (सोंश धन) अधधधनयम, 2003 द्वारा धनरस्त कर धदया गया था।
सोंधिधान के अनुसार, धनम्नधलक्तखत चार श्रेधणय ों के व्यक्ति भारत के नागररक बन गए, अथाण त् 26 जनिरी, 1950
क:
स्थायी धनिासी
अनुच्छेद 5 - एक व्यक्ति धजसके पास भारत में अपना अधधिास था और तीन शतों में से धकसी एक क भी पूरा करता
है -
ह गा ।
अनुच्छेद 6 - एक व्यक्ति ज पाधकस्तान से भारत आया ह , िह भारतीय नागररक बन सकता है यधद िह या त उसके
माता-धपता या उसके दादा-दादी का जन्म अधिभाधजत भारत में हुआ ह और धनम्न द न ों में से धकसी एक शतण क पूरा
धकया ह -

1. यधद िह 19 जुलाई, 1948 से पहले भारत में आया था, त उसके प्रिास की तारीख के बाद से िह भारत में
सामान्य रूप से रहने लगा था;
2. या 19 जुलाई, 1948 क या उसके बाद भारत आने पर, उन्ें भारत के नागररक के रूप में पोंजीकृत धकया गया
था। लेधकन, क ई व्यक्ति केिल तभी पोंजीकृत ह सकता है जब िह पोंजीकरण के धलए अपने आिेदन की
अनुच्छेद 7 - एक व्यक्ति ज 1 माचण 1947 के बाद भारत से पाधकस्तान चला गया, लेधकन बाद में पुनिाण स के धलए
भारत लौट आया, ह िह भारतीय नागररक बन सकता है । इसके धलए, उन्ें पोंजीकरण के धलए अपने आिेदन की
तारीख से पूिण छह माह तक भारत में रहना ह गा।
अनुच्छेद 8 - एक व्यक्ति, धजनके माता-धपता या दादा-दादी, क ई भी अधिभाधजत भारत में पैदा हुये थे , लेधकन िह
भारत से बाहर रह रहा है , िह भारतीय नागररक बन जाएगा, यधद उसने भारत के नागररक के रूप में राजनधयक या
कौोंसुलर प्रधतधनधध द्वारा पोंजीकृत धकया गया ह | यह व्यिस्था भारत के बाहर रहने िाले भारतीय ों के धलए बनाई गयी है
अनुच्छेद 9 - िह व्यक्ति भारत का नागररक नहीों ह गा या उसे भारत का नागररक नहीों माना जाएगा, यधद उसने स्वेच्छा
से धकसी धिदे शी राज् की नागररकता ग्रहण कर ली है ।
अनुच्छेद 10 - प्रत्येक व्यक्ति ज भारत का नागररक है या माना जाता है , िह ऐसा नागररक बना रहे गा, ज सोंसद द्वारा
बनाए गए धकसी कानून के प्रािधान ों के अधीन ह गा।
अनुच्छेद 11 - सोंसद के पास नागररकता के अधधग्रहण और समाक्तप्त और नागररकता से सोंबोंधधत अन्य सभी मामल ों के

अधधधनयम, 1985 में असम समझौते द्वारा किर धकए गए व्यक्तिय ों की नागररकता के रूप में धिशेष प्रािधान
1. जन्म से
26 जनिरी 1950 से 1 जुलाई 1987 के बीच भारत में पैदा हुआ व्यक्ति अपने माता-धपता के जन्म की
जाता है , अगर उनके माता-धपता द न ों भारत के नागररक हैं या उसके माता-धपता उसके जन्म के समय
भारत के नागररक हैं या माता या धपता में से एक उस समय भारत का नागररक ह तथा दू सरा अिैध प्रिासी
नह ।
भारत में तैनात धिदे शी राजनधयक ों के बच्चे और शत्रु दे श के बच्चे भारतीय नागररकता प्राप्त नहीों कर
सकते हैं ।
2. वंश के आधार पर
26/01/1950 - 10/12/1992 के बीच भारत के बाहर पैदा हुआ व्यक्ति, िोंश से भारत का नागररक है , यधद
उसके धपता उसके जन्म के समय भारत के नागररक थे।
10 धदसोंबर 1992 क या उसके बाद भारत के बाहर पैदा हुए व्यक्ति क भारत का नागररक माना जाता है
यधद उसके जन्म के समय उसके माता-धपता में से क ई एक भारत का नागररक ह ।
3 धदसोंबर 2004 के बाद, भारत के बाहर जन्म लेने िाला व्यक्ति िोंश के आधार पर भारत का नागररक नहीों
ह गा, जब तक धक उसका जन्म, जन्म की तारीख के एक िषण के भीतर एक भारतीय िाधणज् दू तािास में
पोंजीकृत न करा धदया या केंद्र सरकार की सहमधत से उि अिधध की समाक्तप्त के बाद पोंजीकरण न हुआ
ह |
नाबाधलग बच्चे के जन्म के पोंजीकरण के धलए आिेदन कराते समय, एक भारतीय िाधणज् दू तािास क ऐसे
नाबाधलग बच्चे के माता-धपता से धलक्तखत रूप में एक शपथ पत्र दे ना ह गा धक िह धकसी दू सरे दे श का

इसके अलािा, एक नाबाधलग ज िोंश के आधार पर भारत का नागररक है और धकसी अन्य दे श का
नागररक भी है , यधद िह अपनी ियस्कता प्राक्तप्त के छह महीने के भीतर धकसी अन्य दे श की नागररकता या
3. पंजीकरण द्वारा
केंद्र सरकार भारत के नागररक के रूप में धकसी भी व्यक्ति (अिैध प्रिासी नहीों) क पोंजीकृत कर सकती है , यधद िह
(a) भारतीय मूल का एक व्यक्ति ज पोंजीकरण के धलए आिेदन करने से ठीक सात िषण पूिण भारत में सामान्य रूप
से धनिासी ह ;
(b) एक भारतीय मूल का व्यक्ति ज धकसी भी दे श में या अधिभाधजत भारत के बाहर रह रहा ह
(c) एक व्यक्ति ज भारत के नागररक से शादी करता है और पोंजीकरण के धलए आिेदन पत्र दे ने से पूिण सात िषण से
(e) क ई व्यक्ति, ज पूणण आयु ि िमता का ह तथा धजसके माता-धपता भारत के नागररक के रूप में पोंजीकृत हैं
(f) पूणण आयु और िमता का क ई एक व्यक्ति, या उसके माता-धपता में से क ई एक, ज सितोंत्रता से पूिण भारत का
नागररक थे या और पोंजीकरण के धलए आिेदन करने से तुरोंत पहले बारह महीने तक भारत में धनिास करता
ह ।
(g) पूणण आयु और िमता िाला व्यक्ति ज पाों च साल के धलए भारत के समुद्र पार के धिदे शी नागररक के रूप में
पोंजीकृत धकया गया है , और ज पोंजीकरण के धलए आिेदन करने से पहले बारह महीने तक भारत में सामान्य
रूप से धनिासी है ।
एक व्यक्ति क भारतीय मूल का माना जाएगा यधद िह, या उसके माता-धपता में से क ई भी अधिभाधजत
भारत में या ऐसे अन्य िेत्र में पैदा हुआ था, ज 15 अगस्त, 1947 के बाद भारत का धहस्सा बन गया।
उपर ि सभी श्रेधणय ों के व्यक्तिय ों क भारत के नागररक ों के रूप में पोंजीकृत ह ने से के बाद धनष्ठा की
4. प्राकृवतक तरीके से
केंद्र सरकार धकसी भी व्यक्ति क प्राकृधतक तरीके से अधजणत नागररकता का प्रमाण पत्र दे सकती है :

(a) िह धकसी भी ऐसे दे श का व्यक्ति या नागररक नहीों है , जहाों भारत के नागररक ों क प्राकृधतक रूप से उस दे श
का व्यक्ति या नागररक बनने से िोंधचत धकया जाता है ।
(b) यधद िह धकसी भी अन्य दे श का नागररक है , त िह भारतीय नागररकता के धलए अपने आिेदन की स्वीकृधत
पर उस दे श की नागररकता क त्याग दे गा।
(c) िह या त भारत में रहता है या भारत सरकार की सेिा में है या आों धशक रूप से एक और आों धशक रूप से
दू सरा क ई अन्य ह , त उसे नागररकता सम्बन्धी आिेदन दे ने के कम से कम बारह महीने पूिण से भारत में रह
रहा ह ना चाधहए |
(d) यधद बारह महीने की इस अिधध से चौदह साल पूिण से िह भारत में रहता है या भारत सरकार की सेिा में रहा
ह , या आों धशक रूप मे थ ड़ा एक में ह और थ ड़ा अन्य में ह , कुल धमलाकर इनकी अिधध ग्यारह साल से कम
नहीों ह ना चाधहए |
(g) धक उसे प्राकृधतक रूप से नागररकता का प्रमाण पत्र धदए जाने की क्तस्थधत में, िह भारत में धनिास करने के
इच्छु क ह
या, भारत सरकार सेिा या धकसी अों अोंतराण ष्ट्ीय सोंगठन में], धजसका भारत सदस्य ह या भारत में स्थाधपत
धकसी स साइटी, कोंपनी या व्यक्तिय ों का धनकाय ह में प्रिेश या उसे जारी रखे
प्रत्येक प्राकृधतक नागररक क भारत के सोंधिधान के प्रधत धनष्ठा की शपथ लेनी चाधहए।
यधद क ई धिदे शी िेत्र भारत का धहस्सा बन जाता है , त भारत सरकार उसे िेत्र से सम्बधधत धिशेष
उदाहरण के धलए, जब पाों धडचेरी भारत का एक धहस्सा बन गया, त भारत सरकार ने नागररकता
अधधधनयम, 1955 के तहत नागररकता (पाों धडचेरी) आदे श, 1962 जारी धकया।
1. स्वैप्तच्छक त्याग

जब क ई व्यक्ति अपनी भारतीय नागररकता का त्याग करता है , त उस व्यक्ति का प्रत्येक नाबाधलग बच्चा
भी भारतीय नागररकता ख दे ता है ।
हालाों धक, जब ऐसा बच्चा अठारह िषण की आयु प्राप्त करता है , त िह भारतीय नागररकता पुनः प्राप्त कर
सकता है । (िोंश अनुच्छेद द्वारा)
2. बर्ाास्तगी के द्वारा
जब क ई भारतीय नागररक स्वेच्छा से (धििेकसम्मत और धबना डर, अनुधचत प्रभाि या मजबूरी के) धकसी
अन्य दे श की नागररकता प्राप्त कर लेता है , त उसकी भारतीय नागररकता स्वतः ही समाप्त ह जाती है ।
यह प्रािधान, हालाों धक, तब लागू नहीों ह ग जब भारत धकसी युद्ध में व्यस्त ह ।
केंद्र सरकार द्वारा भारतीय नागररकता का अधनिायण रूप से बखाण स्त करना ह गा, यधद:
(d) नागररक क पोंजीकरण या प्राकृधतककरण के बाद 5 साल के भीतर, धकसी भी दे श में द साल तक कैद में रखा
गया है ह
एकल नागररकता
भारतीय सोंधिधान सोंघीय है और एक द हरी राजपद्धधत (केंद्र और राज् )ों की पररकल्पना करता है , लेधकन यह
केिल एक ही नागररकता, अथाण त् भारतीय नागररकता प्रदान करता है ।
भारत में नागररक ों क केिल सोंघ के प्रधत धनष्ठा का सम्मान करना चाधहए। क्य धक भारत में राज् की अलग
नागररकता नहीों है ।
दू सरी ओर सोंयुि राज् अमेररका और क्तस्वट् जरलैंड जैसे राज् ों ने द हरी नागररकता की प्रणाली क अपनाया।
सोंयुि राज् अमेररका में, प्रत्येक व्यक्ति न केिल सोंयुि राज् अमेररका का नागररक ह ता है , बक्ति उस

दोहरी नागररकता
यह प्रणाली भेदभाि की समस्या पैदा करती है , अथाण त राज् अपने नागररक ों के पि में भेदभाि कर सकता है
जैसे -
o ि ट का अधधकार,
o सािणजधनक पद ों
o व्यिसाय ों के अभ्यास का अधधकार। इत्याधद क लेकर भेदभाि ह सकता है ।
ऐसी समस्या से बचने हे तु भारत ने एकल नागररकता प्रणाली क अपनाया हालाों धक, भेदभाि की अनुपक्तस्थधत
का यह सामान्य धनयम कुछ अपिाद ों के अधीन है , जैसे -
o सोंसद (अनुच्छेद 16 के तहत) धकसी राज् या केंद्र शाधसत प्रदे श में कुछ धनय जन या धनयुक्तिय ों के धलए
उस राज् या केंद्र शाधसत प्रदे श के भीतर स्थानीय प्राधधकारी या अन्य प्राधधकरण के धलए एक शतण के रूप
में एक राज् या केंद्र शाधसत प्रदे श के भीतर आदे श दे सकता है ।
o सोंधिधान (अनुच्छेद 15 के तहत) धकसी भी नागररक के क्तखलाफ धमण, मूल िोंश, जाधत, धलोंग या जन्म स्थान
या धनिास के आधार पर भेदभाि का धनषेध करता है । इसका अधभप्राय यह है धक राज् ऐसे मामल ों में
अपने धनिाधसय ों क धिशेष लाभ प्रदान कर सकता है या उन्ें प्राथधमकता दे सकता है ज भारतीय
नागररक ों क सोंधिधान द्वारा धदए गए अधधकार ों के दायरे में नहीों आते हैं । उदाहरण के धलए, एक राज्
के अधीन है । यह अनुसूधचत जनजाधत की धिधशष्ट् सोंस्कृधत, भाषा, रीधत-ररिाज ों की रिा और उनकी सोंपधत
एिों परम्परा क बचाने एिों उनके श षण के धिरूद्ध सुरिा किच है ।
o जम्मू और कश्मीर के मामले में, राज् धिधाधयका क उन व्यक्तिय ों क पररभाधषत करने का अधधकार है
ज राज् के स्थायी धनिासी हैं और धकसी धिशेष अधधकार और सुधिधा क प्राप्त करते हैं ये सुधिधाए राज्
में सोंपधत्त अधधग्रहण राजय में धनिास और छात्रिृधत्त या अन्य सरकारी व्यिस्था के अनुसार ह सकती है
o राज् सरकार के तहत र जगार के मामले ,
o छात्रिृधत्त
o और राज् सरकार द्वारा प्रदान की जाने िाली सहायता के ऐसे अन्य रूप।

o नागररकता (सोंश धन) अधधधनयम, 2015 ने प्रमुख अधधधनयम में ओसीआई से सोंबोंधधत प्रािधान ों क
सोंश धधत धकया है ।
o इसने पीआईओ काडण य जना और ओसीआई काडण य जना का धिलय करके “ओिरसीज धसटीजन
ऑफ इों धडया काडण धारक” नामक एक नई य जना शुरू की है ।
I. ज दू सरे दे श का नागररक है , लेधकन सोंधिधान के लागू ह ने के बाद, या धकसी भी समय भारत का नागररक
रहा ह
II. ज दू सरे दे श का नागररक है , लेधकन सोंधिधान के प्रारों भ के समय भारत का नागररक बनने के य ग्य था
III. दू सरे दे श का नागररक है , लेधकन एक ऐसे िेत्र से सोंबोंधधत है ज 15 अगस्त, 1947 के बाद भारत का
धहस्सा बना
IV. उपर ि रूप से िधणणत व्यक्ति का बच्चा, प ता या परप ता है ;

(ग) एक व्यक्ति, ज एक नाबाधलग बच्चा है , और धजसके माता-धपता द न ों भारत के नागररक हैं या माता-धपता में से
क ई एक भारत का नागररक है
(घ) भारत के नागररक के धिदे शी मूल के पधत या पत्नी अथिा भारत के धिदे शी नागररक काडण धारक के धिदे शी मूल
के पधत या पत्नी और धजनकी शादी क पोंजीकृत धकया गया है और कम से कम 2 साल की अिधध से कम न
चला ह |
धिदे शी भारतीय नागररकता काडण धारक धनम्नधलक्तखत अधधकार ों का हकदार नहीों ह गा (ज धक भारत के
नागररक क धदया जाता है ) -
(क) िह सािणजधनक र जगार के मामल ों में अिसर की समानता के अधधकार का हकदार नहीों ह गा।
(घ) िह सिोच्च न्यायालय के न्यायाधीश के रूप में धनयुक्ति के धलए पात्र नहीों ह ग
ों े।
(ड़) िह उच्च न्यायालय के न्यायाधीश के रूप में धनयुक्ति के धलए य ग्य नहीों ह गा।
(ज) िह राज् धिधान सभा या राज् धिधान पररषद का सदस्य ह ने के य ग्य नहीों ह गा।
(झ) िह ऐसी सेिाओों और पद ों में धनयुक्ति के अलािा धकसी भी राज् या सोंघ के मामल ों के सोंबोंध में सािणजधनक
सेिाओों और पद ों पर धनयुक्ति के धलए पात्र नहीों ह ग
ों े , जैसा धक केंद्र सरकार धनधदण ष्ट् कर सकती है ।
