What is a ‘WRIT’?
A writ is a formal written order issued by a body with administrative or judicial jurisdiction.
In India,
o the Supreme Court (under Article 32) and
o the High Courts (under Article 226)
o can issue the writs of habeas corpus, mandamus, prohibition, certiorari and quo-
warranto.
These writs are borrowed from English law where they are known as ‘prerogative writs.’ They are so
called in England as they were issued in the exercise of the prerogative of the King who was, and is
still, described as the ‘fountain of justice’.
The writ jurisdiction of the Supreme Court differs from that of a high court in three respects:

The Supreme Court is constituted as a defender and guarantor of the fundamental rights.
Habeas Corpus
It is a Latin term which literally means ‘to have the body of’.
It is an order issued by the court to a person who has detained another person, to produce the body
of the latter before it.
The writ of habeas corpus can be issued against both public authorities as well as private individuals.
The writ, on the other hand, is not issued where the
o detention is lawful,
o the proceeding is for contempt of a legislature or a court,
o detention is by a competent court, and
o detention is outside the jurisdiction of the court.
Mandamus
It literally means ‘we command’.
It is a command issued by the court to a public official asking him to perform his official duties that
he has failed or refused to perform.
It can also be issued against any public body, a corporation, an inferior court, a tribunal or
government for the same purpose.
The writ of mandamus cannot be issued
o against a private individual or body;
o to enforce departmental instruction that does not possess statutory force;
o when the duty is discretionary and not mandatory;
o to enforce a contractual obligation;
o against the president of India or the state governors; and
o against the chief justice of a high court acting in judicial capacity.
Prohibition
Literally, it means ‘to forbid’.
It is issued by a higher court to a lower court or tribunal to prevent the latter from exceeding its
jurisdiction or usurping a jurisdiction that it does not possess.
Thus, unlike mandamus that directs activity, the prohibition directs inactivity.
The writ of prohibition can be issued only against judicial and quasi-judicial authorities.
It is not available against administrative authorities, legislative bodies, and private individuals or
bodies.

Certiorari
In the literal sense, it means ‘to be certified’ or ‘to be informed’.
It is issued by a higher court to a lower court or tribunal either to transfer a case pending with the
latter to itself or to squash the order of the latter in a case.
It is issued on the grounds of excess of jurisdiction or lack of jurisdiction or error of law.
Thus, unlike prohibition, which is only preventive, certiorari is both preventive as well as curative.
Previously, the writ of certiorari could be issued only against judicial and quasi-judicial authorities
and not against administrative authorities.
However, in 1991, the Supreme Court ruled that the certiorari can be issued even against
administrative authorities affecting rights of individuals.
Like prohibition, certiorari is also not available against legislative bodies and private individuals or
bodies.
Quo-Warranto
In the literal sense, it means ‘by what authority or warrant’.
It is issued by the court to enquire into the legality of claim of a person to a public office. Hence, it
prevents illegal usurpation of public office by a person.
The writ can be issued only in case of a substantive public office of a permanent character created
by a statute or by the Constitution.
It cannot be issued in cases of ministerial office or private office.
Unlike the other four writs, this can be sought by any interested person and not necessarily by the
aggrieved person.
Accordingly, the Parliament has enacted the Army Act (1950), the Navy Act
(1950), the Air Force Act (1950), the Police Forces (Restriction of Rights) Act, 1966, the Border
Security Force Act and so on.
These impose restrictions on their:
o freedom of speech,
o right to form associations,
o right to be members of trade unions or political associations, right to communicate with the
press,
o right to attend public meetings or demonstrations, etc.

The expression 'members of the armed forces’ also covers such employees of the armed forces as
barbers, carpenters, mechanics, cooks, chowkidars, bootmakers, tailors who are non-combatants.
Article 34
Article 34 provides for the restrictions on fundamental rights while martial law is in force in any area
within the territory of India.
It empowers the Parliament to indemnify any government servant or any other person for any act
done by him in connection with the maintenance or restoration of order in any area where martial
law was in force.
The Parliament can also validate any sentence passed, punishment inflicted, forfeiture ordered or
other act done under martial law in such area.
ARTICLE 35
Article 35 lays down that the power to make laws, to give effect to certain specified fundamental
rights shall vest only in the Parliament and not in the state legislatures.
This provision ensures that there is uniformity throughout India with regard to the nature of those
fundamental rights and punishment for their infringement.

Right to Property
Originally, the right to property was one of the seven fundamental rights under Part III of the
Constitution.
Article 19(1)(f) guaranteed to every citizen the right to acquire, hold and dispose of property.
Article 31, on the other hand, guaranteed to every person, whether citizen or non-citizen, right
against deprivation of his property.
It provided that no person shall be deprived of his property except by authority of law.
It empowered the State to acquire or requisition the property of a person on two conditions:
o it should be for public purpose, and
o it should provide for payment of compensation (amount) to the owner.
This right caused confrontations between the Supreme Court and the Parliament.
It has led to a number of Constitutional amendments, that is, 1st, 4th, 7th, 25th, 39th, 40th and 42nd
Amendments.
Through these amendments, Articles 31A, 31B and 31C have been added and modified from time to
time to nullify the effect of Supreme Court judgements and to protect certain laws from being
challenged on the grounds of contravention of Fundamental Rights.
Most of the litigation centred around the obligation of the state to pay compensation for acquisition
or requisition of private property.
Therefore, the 44th Amendment Act of 1978 abolished the right to property as a Fundamental
Right by repealing Article 19(1)(f) and Article 31
Instead, the Act inserted a new Article 300A in Part XII under the heading ‘Right to Property’.
It provides that no person shall be deprived of his property except by authority of law.
Thus, the right to property still remains a legal right or a constitutional right, though no longer a
fundamental right. (it can be changed/modified by law now)
It is not a part of the basic structure of the Constitution.

CRITICAL APPRAISAL OF FUNDAMENTAL RIGHTS
1. Excessive Limitations
They are subjected to innumerable exceptions, restrictions, qualifications and explanations. Hence,
the critics remarked that the Constitution grants Fundamental Rights with one hand and takes them
away with the other.
2. No Social and Economic Rights
The list is not comprehensive as it mainly consists of political rights. It makes no provision for
important social and economic rights like right to social security, right to work, right to
employment, right to rest and leisure and so on.
3. No Clarity
They are stated in a vague, indefinite and ambiguous manner. The various phrases and words used
in the chapter like ‘public order’, ‘minorities’,
‘reasonable restriction’, ‘public interest’ and so on are not clearly defined. The language “used to
describe them is very complicated and beyond the comprehension of the common man.
4. No Permanency
They are not sacrosanct or immutable as the Parliament can curtail or abolish them, as for example,
the abolition of the fundamental right to property in 1978.
Hence, they can become a play tool in the hands of politicians having majority support in the
Parliament.
5. Suspension During Emergency
The suspension of their enforcement during the operation of National Emergency (except Articles
20 and 21) is another blot on the efficacy of these rights. This provision cuts at the roots of
democratic system in the country by placing the rights of the millions of innocent people in
continuous jeopardy.
6. Expensive Remedy
The judiciary has been made responsible for defending and protecting these rights against the
interference of the legislatures and executives. “However, the judicial process is too expensive and
hinders the common man from getting his rights enforced through the courts.
7. No Consistent Philosophy
According to some critics, the chapter on fundamental rights is not the product of any philosophical
principle.
Sir Ivor Jennings expressed this view when he said that the Fundamental Rights proclaimed by the
Indian Constitution are based on no consistent philosophy.
This creates difficulty for the Supreme Court and the high courts in interpreting the fundamental
rights.

मौनलक अनधकार क्यं महत्वपूर्श हैं ?
मौनलक अनधकारयं की संवैधाननक घयषर्ा तब तक अर्शहीन, तकशहीन एवं शक्तिहीन है जब तक की कयई प्रभावी
है ।
मौनलक अनधकारयं कय संरनित करने का अनधकार अपने आप में एक मौनलक अनधकार है । यह मौनलक
नजसके नबना यह संनवधान "अर्शनवहीन "है । यह संनवधान की आत्मा और इसका ह्रदय है । '
सवोच्च न्यायालय ने व्यवस्र्ा दी है । नक अनुच्छेद 32 संनवधान की एक मूल नवशेषता है ।
अनधकार की गारं टी है ।
(b) सवोच्च न्यायालय के पास नकसी भी मौनलक अनधकार के प्रवतशन के नलए ननदे श या आदे श या ररट जारी
करने की शक्ति हयगी। जारी नकए गए ररटयं में बंदी प्रत्यिीकरर्, परमादे श, प्रनतषेध, उत्प्रेषर् और
अनधकार पृच्छा शानमल हय सकते हैं ।
(c) संसद नकसी भी अन्य अदालत कय सभी प्रकार के ननदे श, आदे श और ररट जारी करने के नलए शक्ति प्रदान
कर सकती है ।

(d) सवोच्च न्यायालय में जाने का अनधकार संनवधान द्वारा अन्यर्ा उपबंनधत के अलावा ननलंनबत नहीं नकया
जाएगा। (राष्ट्रीय आपातकाल अनुच्छेद 359)
ररट एक औपचाररक नलक्तित आदे श है जय प्रशासननक या न्यानयक िेत्रानधकार वाले ननकाय द्वारा जारी नकया
जाता है ।
भारत में,
o सुप्रीम कयटश (अनुच्छेद 32 के तहत) और
ये ररट अंग्रेजी कानून से ली गयी है , जहां इन्हे नवशेषानधकार ररट् स ’के रूप में जाना जाता है । क्यंनक इन्हे राजा
के द्वारा जारी नकया जाता र्ा इन्हे इं ग्लैंड में आज भी ‚न्याय का झरना" कहा जाता है ।
सवोच्च न्यायालय का अनधकार िेत्र तीन मामलयं में उच्च न्यायालय से नभन्न हयता है :
सवोच्च न्यायालय केवल मौनलक अनधकारयं के जबनक उच्च न्यायालय इनके अलावा नकसी और उद्दे श्य
नियान्रयन कय लेकर ररट जारी कर सकता है कय लेकर भी इससे जारी कर सकते है
सवोच्च न्यायालय समस्त भारत में ररट जारी कर सकता लेनकन उच्च न्यायलय केवल कुछ अपवादयं के सार्
सवोच्च न्यायालय अपने अनधकार िेत्र का प्रययग करने से अनुच्छेद 226 के तहत उपचार नववेकाधीन है और
इं कार नहीं कर सकता| इसनलए, एक उच्च न्यायालय अपने ररट िेत्रानधकार के
सुप्रीम कयटश (उच्चतम न्यायालय) कय मौनलक अनधकारयं के रिक और गारं टर के रूप में गनित नकया गया है ।
बन्दी प्रत्यिीकरर्

यह अदालत द्वारा उस व्यक्ति के सम्बन्ध में जारी नकया गया एक आदे श है नजसे नकसी अन्य व्यक्ति ने नहरासत
में रिा हुआ है , उसे इसके सामने प्रस्तुत नकया जाये |
बंदी प्रत्यिीकरर् की ररट सावशजननक प्रनधकरर् और व्यक्तिगत दयनयं के क्तिलाफ जारी की जा सकती है ।
दू सरी ओर, ररट जारी नहीं की जाती है , जहां
परमादे श
कतशव्ययं कय पूरा करने के नलए कहता है नक वह नवफल रहा है या कतशव्य करने से इनकार कर नदया है ।
यह नकसी भी सावशजननक ननकाय, ननगम, अधीनस्र् न्यायालय, अनधकरर् या सरकार के क्तिलाफ समान उद्दे श्य
प्रलिषेध
यह एक उच्च न्यायालय द्वारा एक अधीनस्र् न्यायालययं या न्यायानधकरर् कय अपने न्यायिेत्र से उच्च न्यानयक
कायों कय करने से रयकने के नलए जारी नकया जाता है ।
नजस प्रकार, परमादे श सीधे सनिय रहता है प्रनतषेध सीधे सनिय नहीं रहता |

प्रनतषेध सम्बन्धी ररट कय केवल न्यानयक और अर्द्श -न्यानयक अनधकाररययं के क्तिलाफ जारी नकया जा सकता
है ।
यह प्रशासननक प्रानधकरर्, नवधायी ननकाययं और ननजी व्यक्तिययं या ननकाययं के क्तिलाफ उपलब्ध नहीं है ।
उत्प्रेषण-िेख
इसे उच्च न्यायालय द्वारा अधीनस्र् न्यायालय या अनधकरर् कय या लंनबत मामलयं के स्र्ानां तरर् कय सीधे या
पत्र जारी कर नकया जाता है |
यह अनतररि न्यानयक िेत्र या न्यानयक िेत्र की कमी या कानून की त्रुनट के आधार पर जारी नकया जाता है ।
इस प्रकार, प्रनतषेध के नवपरीत, जय केवल ननवारक है , उत्प्रेषर् ननवारक के सार्-सार् उपचारात्मक दयनयं
प्रकार का है ।
पहले, उत्प्रेषर् की ररट केवल न्यानयक और अर्द्श -न्यानयक अनधकाररययं के क्तिलाफ जारी की जा सकती र्ी, न
यह अदालत द्वारा एक सावशजननक कायाश लय में नकसी व्यक्ति के दावे की वैधता की जां च करने के नलए जारी
नकया जाता है । इसनलए, यह नकसी व्यक्ति द्वारा सावशजननक कायाश लय के अवैध रूप से उपययग कय रयकता है ।
यह ररट केवल नकसी स्र्ायी या संनवधान द्वारा बनाए गए स्र्ायी चररत्र के एक महत्वपूर्श सावशजननक कायाश लय
के मामले में जारी की जा सकती है ।
यह मंनत्रत्व कायाश लय या ननजी कायाश लय के मामलयं में जारी नहीं नकया जा सकता है ।
अन्य चार ररटयं के नवपरीत, यह नकसी भी इच्छु क व्यक्ति द्वारा जारी नकया जा सकता है और जरूरी नहीं नक

सशस्त्र बि और मौलिक अलधकार (अनुच्छेद 33)
अनुच्छेद 33 संसद कय सशस्त्र बलयं, अधश-सैन्य बलयं, पुनलस बलयं, िुनफया एजेंनसययं और अन्य समरूप बलयं के
सुनननित करना है ।
अनुच्छेद 33 के तहत कानू न बनाने की शक्ति केवल संसद कय न नक राज्य नवधानमण्डल कय ।
संसद द्वारा बनाए गए ऐसे नकसी भी कानून कय नकसी भी मौनलक अनधकार के उल्लंघन के आधार पर नकसी
भी अदालत में चुनौती नहीं दी जा सकती है ।
तदनुसार, संसद ने सेना अनधननयम (1950), नौसेना अनधननयम लागू नकया है (1950), वायु सेना अनधननयम
(1950), पुनलस बल (अनधकारयं पर प्रनतबंध) अनधननयम, 1966, सीमा सुरिा बल अनधननयम आनद प्रभावी
बनाये |
अनधकार,
सावशजननक सभा या प्रदशशन आनद में भाग लेने का अनधकार।
'सैन्य बलयं के सदस्' अनभव्यक्ति का अनभप्राय इसमें वय कमशचारी भी शानमल हैं जय सेना में नाई,
बढ़ई,मेकैननक ,बावची ,चौकीदार ,बूट बनाने वाला दजी आनद का कायश करते हैं |
नकया जाता है ।
यह सैन्य कानून से अलग है जय सशस्त्र बलयं पर लागू हयता है

अनुच्छेद 34
अनुच्छेद 34 में मौनलक अनधकारयं पर प्रनतबंध का प्रावधान है , जब भारत के िेत्र के भीतर नकसी भी इलाके में
माशशल लॉ लागू है ।
•यह संसद कय इस बात की अनुमनत दे ता है नक नकसी भी कमशचारी कय या अन्य व्यक्ति द्वारा नकये जाने वाले
वैध कर सकती है ।
यह नसफश मूल अनधकारयं कय प्रभानवत करता है यह न केवल मूल अनधकारयं कय प्रभानवत करता है बक्ति
यह सरकार और साधारर् ऺानूनी न्यायालययं कय यह सरकार एवं सामान्य ऺानूनी न्याय कय जारी रिता है
ननलंनबत करता है | |
यह कानून और व्यवस्र्ा के भंग हय जाने पर उसे दयबारा यह नसफश तीन आधारयं पर ही लागु हय सकता है , यु र्द् ,

अनुच्छेद 35
अनुच्छेद 35 उपबध करता है । नक कुछ नवनशष्ट् मौनलक अनधकारयं के नलए कानून बनाने की शक्ति केवल
संसद में नननहत हयगी (राज्य नवधानसभाओं के पास नहीं)

यह प्रावधान यह सुनननित करता है नक उन मौनलक अनधकारयं की प्रकृनत और उनके उल्लंघन के नलए सजा के
संबंध में पूरे भारत में एकरूपता है ।
संपलि का अलधकार
मूल रूप से , संपनि का अनधकार संनवधान के भाग III के तहत सात मौनलक अनधकारयं में से एक र्ा।
अनुच्छेद 19 (1) (च) प्रत्येक नागररक कय संपनि के अनधग्रहर्, धारर् और ननपटान के अनधकार की गारं टी दे ता
है ।
दू सरी ओर, अनुच्छेद 31, प्रत्येक व्यक्ति कय, चाहे वह नागररक हय या गैर-नागररक, कय अपनी संपनि वंचन
इसने राज्य कय दय शतों पर नकसी व्यक्ति की संपनि प्राप्त करने या अपेनित करने का अनधकार नदया:
यह सावशजननक उद्दे श्य के नलए हयना चानहए, और
इसने कई संवैधाननक संशयधनयं कय जन्म नदया है , अर्ाश त्, 1, 4 वां , 7 वां , 25 वां , 39 वां , 40 वां और 42 वां
संशयधन।
इन संशयधनयं के माध्यम से, अनुच्छेद 31A, 31B और 31C कय समय-समय पर जय़िा और संशयनधत नकया गया
तानक उच्चतम न्यायालय के ननर्शययं के प्रभाव कय समाप्त नकया जा सके और कुछ कानूनयं कय मौनलक
इसके बजाय, अनधननयम ने 'संपनि के अनधकार' शीषशक के तहत भाग XII में एक नया अनुच्छेद 300A जय़िा
यह प्रावधान करता है नक कयई भी व्यक्ति कानून के अनधकार कय छय़िकर अपनी संपनि से वंनचत नहीं नकया
जाएगा।
इस प्रकार, संपनि का अनधकार अभी भी एक कानूनी अनधकार या संवैधाननक अनधकार बना हुआ है , हालां नक
अब यह कयई मौनलक अनधकार नहीं है । (इसे अब कानून द्वारा पररवनतशत / संशयनधत नकया जा सकता है )
यह संनवधान की मूल संरचना का नहस्सा नहीं है ।

मौनलक अनधकार महत्वपूर्श क्यं हैं ?
ये दे श में लयकतां नत्रक प्रर्ाली कय स्र्ानपत करते हैं ।
ये मनुष्य की भौनतक और नैनतक सुरिा के नलए आवश्यक शतें प्रदान करते हैं ।
ये व्यक्तिगत स्वतंत्रता के एक दु जेय रिक के रूप में सेवा करते हैं ।
1. व्यापक सीमाएँ
ये असंख्य अपवादयं, प्रनतबंधयं, ययग्यताओं और स्पष्ट्ीकरर्यं के अधीन हैं । इसनलए, आलयचकयं ने नटप्पर्ी की नक
संनवधान एक तरफ मौनलक अनधकारयं कय प्रदान करता है और दू सरी तरफ उन्हे छीन लेता है ।
यह सूची व्यापक नहीं है क्यंनक इसमें मुख्य रूप से राजनीनतक अनधकार शानमल हैं । यह सामानजक सुरिा,
काम का अनधकार, रयजगार का अनधकार, आराम करने का अनधकार और अवकाश आनद जैसे महत्वपूर्श
सामानजक और आनर्शक अनधकारयं के नलए कयई प्रावधान नहीं करता है ।
ये अस्पष्ट्, अनननित और अस्पष्ट् तरीके से कहे गए हैं । अध्याय में उपययग नकए जाने वाले नवनभन्न वाक्ां श और
'उनचत प्रनतबंध', 'सावशजननक नहत' और आनद कय स्पष्ट् रूप से पररभानषत नहीं नकया गया है । उनका वर्शन
करने के नलए इस्तेमाल की जाने वाली भाषा बहुत जनटल है और आम आदमी की समझ से परे है ।

4. कोई स्थालयत्व नही ं
ये अलंघनीय या अपररवतशनीय नहीं हैं क्यंनक संसद इनमे कटौती या समाप्त कर सकती है , उदाहरर् के नलए,
इसनलए, ये संसद में बहुसं ख्यक समर्शन रिने वाले राजनीनतज्यं का हनर्यार बन सकते हैं ।
6. महंगा उपचार
न्यायपानलका कय नजम्मेदार बनाया गया है । ‚हालां नक, न्यानयक प्रनिया बहुत महं गी है इसनलए आम आदमी के
नलये न्यायालय जाना कनिन कायश है ।
कुछ आलयचकयं के अनुसार, मौनलक अनधकारयं का अध्याय नकसी भी दाशशननक नसर्द्ां त की उपज नहीं है ।
सर आइवर जेननंग्स ने यह नवचार व्यि नकया नक भारतीय संनवधान द्वारा घयनषत मौनलक अनधकार नबना नकसी
सुसंगत दशशन पर आधाररत हैं ।
यह मौनलक अनधकारयं की व्याख्या करने में सवोच्च न्यायालय और उच्च न्यायालययं के नलए कनिनाई पैदा
करता है ।
