No. 343-SW(4)-2019.— In exercise of the powers conferred by Sub-section (1) read with Sub-section (2) of
Section 101 of the Rights of Persons with Disabilities Act, 2016 (Central Act 49 of 2016) and with reference to
Haryana Government, Social Justice and Empowerment Department, notification No. 111-SW(4)-2019, dated
the 11th January, 2019, the Governor of Haryana hereby makes the following rules namely:-
Short title and 1. (1) These rules may be called the Haryana Rights of Persons with Disabilities
commencement.
Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
Definitions. 2. (1) In these rules, unless the context otherwise requires,-
(a) “Act” means the Rights of Persons with Disabilities Act, 2016 (Central Act
49 of 2016);
(b) “Deputy Commissioner” means the Deputy Commissioner of the district
concerned;
(b) “Form” means the Form appended to these rules;
(c) “State Government” means the Government of the State of Haryana in the
Administrative Department.
(2) The words and expressions used herein and not defined but defined in the Act shall
have the same meaning respectively as has been assigned to them in the Act.
Constitution of 3. (1) The Committee for Research on Disability shall consist of the following members,

Provided that at least one member of any one of
the registered organizations shall be a woman.
(2) The Chairperson may invite any expert relating to the field of disability, in
consultation with the Committee.
(3) The term of office of the nominated members shall be for a period of three years
from the date on which they enter upon office. The nominated members shall be eligible for re-
nomination for one more term.
(4) One half of the members shall constitute the quorum for the meeting of the
Committee.
Limited 4. (1) The application for appointment of limited guardian for a person with disability

Form-I.
(2) On receipt of the application for appointment of limited guardian, the designated
authority shall scrutinize the application and call for any document or information, as may be
deemed necessary for deciding the issue of guardianship.
(3) In case where the parents make an application for limited guardianship by another
person, the designated authority may decide to recommend and ask for parents counselling. The
designated authority shall assess and determine whether a guardian other than the parents shall be
a genuine guardian who will ensure the well-being of the person with disability.
(4) The application for limited guardianship for personal care and maintenance shall
cover the following conditions, namely:-
(a) the right to life;
(b) food, clothing and appropriate constructed shelter;
(c) religious needs;
(d) education, skill development and training and employment;
(e) health care including medical and surgical needs and nutrition;
(f) leisure and recreation, including indoor and outdoor sports, exposure to
theatre, music, puppet shows etc.;
(g) protection from exploitation and abuse;
(h) protection of constitutional and human rights.
(5) Both the parents may jointly or in the event of the absence of one due to death,
divorce, legal separation, desertion or conviction, may individually apply for guardianship, of the
ward beyond the age of 18 years.
(6) In the event of death, desertion, conviction of both the parents, the siblings
(including half and step siblings) may apply for limited guardianship.
(7) In the absence of parents or siblings, a relative may make an application for limited
guardianship.
(8) In the absence of parents or siblings or any relative, a registered organization may
make an application for limited guardianship.
(9) The designated authority may direct a registered organization to make an
application for limited guardianship in case of a destitute or abandoned person with disabilities.
(10) In case of considering an institution as a limited guardian, the institution must be
registered under the Societies Registration Act, 1860 (Central Act 21 of 1860) or with the
National Trust Act, 1999 (Central Act 44 of 1999) and must be capable of providing facilities to
the person with disability.
(11) In the event the institution ceases to be registered under a law or stops functioning,
or is found to be otherwise unsuitable, the designated authority shall make alternative
arrangements for the care of the person with disability who was hitherto under the care of the
institution.
(12) The alternative care shall not be permanent in nature and shall be replaced by
permanent guardianship within a period of one year.
(13) The applicant or the prospective guardian whose name the applicant has suggested
must have been residing in close proximity to the place where the person with disability resides.
A male guardian shall be appointed only in co-guardianship with his wife.
(14) The confirmation of appointment of a limited guardian shall be made as per
Form-II.
(15) A person appointed as limited guardian shall submit the information regarding the
property of the person with disability within six months from the date of his appointment as per
Form-III.
5. (1) A person shall be disqualified for being a limited guardian on the following Disqualifications.

representative of the parent organization, one representative of the association for the disabled

(3) This team shall inquire into the complaint against the limited guardian of the person
with disability. The following acts of omissions or commission shall constitute abuse or neglect
on the part of the limited guardian, namely:-
(a) solitary confinement of a person with disability in a closed place or a room
for any period of time;
(b) chaining or restricting movement of the person with disability so as to cause
injury and in a way that has not been recommended in writing by a duly
certified medical authority;
(c) beating or treating a person with disability resulting in bruises, skin or tissue
damage;
(d) sexual abuse;
(e) deprivation of physical needs such as food, water and clothing, fresh air,
clean clothes and bed linen, adequate infrastructure such as fans, coolers, air
conditioners, heaters (with precaution against harm), clean toilets with
disabled friendly fixtures like bars etc.;
(f) lack of provision of recreation, skill development and rehabilitation
programmes as specified by experts in the field of disability training and
made known to the guardian by the designated authority or by any notified
Government authority;
(g) Misappropriation or misuse of the property of the person with disabilities.
(h) lack of facilities and of trained staff and personnel for meeting the health,
education and development needs of the person with disability. The team of
investigators shall submit their report within ten days of receipt of the
matter.
(4) On receiving the report of the investigating team, the designated authority shall
take its decision within a further period of ten days from the date of receipt of the report of the
investigating team on whether to remove the limited guardian or not. The designated authority
shall give a hearing to the limited guardian and record the statement of the limited guardian and
its decision in writing.
(5) A person may be considered to be appointed as limited guardian only if he is
eighteen years old or above and such person should not have been charged with any offence
under the Indian Penal Code, 1860 (Central Act 45 of 1860).
(6) It shall be the duty of a person made limited guardian to consult the person with
disability while taking decisions on his behalf, unless such person is medically certified as being
unable to participate in such decision-making.
(7) It shall be legally binding on a person appointed as limited guardian to keep the
interest and well-being of the person with disability foremost while taking legally binding
decisions on his behalf.
(8) The limited guardian, shall submit an affidavit to the effect that he shall keep the
well-being of the person with disability foremost while taking legally binding decisions and that
he shall be liable for any legally binding decision or any act or decision on the part of the limited
guardian that may cause any disadvantage or harm of any kind-physical, financial or emotional or
other-to the person with disability.

(a) proof of at least three years’ experience of work done by the applicant in the
field of disability in Haryana out of which one year’s work should be within
the district where the application has been received;
(b) audited statement of accounts of the institution of the last three years;
(c) number, category and qualification of employees engaged for running the
institution;
(d) affidavit regarding no criminal case having been filed against the applicant;
(e) proof of registration of the institution under the Societies Registration Act,
1860 (Central Act 21 of 1860) or the Indian Trust Act, 1882 (Central Act 2
of 1882) or the Companies Act, 2013 (Central Act 18 of 2013);
(f) objective of setting up the institution in brief with an affidavit that correctly
describe the bye-laws and does not hide any fact or objective mentioned in
the bye-laws and does not contradict any fact or objective mentioned
therein;
(g) proof of registration with the Rehabilitation Council of India compulsorily

(h) the quantitative impact of the activities performed by the institution on the
lives of disabled persons;
(i) the best practices for the betterment of persons with disability-in education,
health and recreation-initiated or adopted by the institution for the
betterment of persons with disability;
(j) norms and criteria followed for infrastructure and ability to take up useful
education and health practices, prescribed by the National Trust, the
Rehabilitation Council.
(4) The competent authority shall issue a certificate of registration, which shall be valid
for a period of three years from the date of issue.

having taken the approval of the Chairperson, to convene a meeting of the Board whenever there
is an urgent matter to be discussed and action on the part of the Board may be required. Such
meeting may be called through electronic mail or telephonic message.
(4) Notice of every meeting shall be issued by the Member-Secretary to each member
of the State Advisory Board at least fifteen days before the date of the meeting. The notice shall
specify the place, date, time of the meeting and shall contain the statement of the business to be
transacted at such meeting.
(5) Notice of a meeting may be delivered by special messenger or by registered post to
the residence and/or official addresses of the members. Such notice may also be sent by – email.
(6) The agenda of the meeting shall be prepared after allowing each member a week’s
time to include their matters of concern in the agenda. A matter that is not included in the agenda
shall be discussed only with the Chairperson’s permission.
(7) Where a meeting of the Board is adjourned from day to day, notice of such
adjourned meeting shall be given to the members of the Board available at the place where the
meeting was to be held. The rest of the members shall be informed through electronic mail or
telephone message.
(8) The Chairperson of the Board shall preside over every meeting of the Board and in
his absence, the Vice-Chairperson of the Board shall preside over the meeting.
(9) The quorum for meeting of the Board shall be as follows:-
(a) one-third of the total members of the Board shall form the quorum for a
meeting of the Board;
(b) if the quorum is present at the beginning of the meeting and some members
leave the meeting after it has begun, this shall be recorded in the minutes of
the meeting and it shall be the discretion of the Chairperson of the Board
whether to continue to hold the meeting or to adjourn it to a different time
on the same date or to any other date;
(c) No quorum shall be necessary for an adjourned meeting of the Board.
(10) The Member-Secretary shall record the minutes of the meetings of the Board.
(11) Matters considered during meetings of the Board shall be decided by a majority of
the members of the Board present and voting. In the event of equality of votes, the Chairperson of
the Board or the Vice-Chairperson of the Board, as the case may be shall have a casting vote. The
Member-Secretary shall not vote at meetings of the Board and shall not have a casting vote.
(12) No proceeding of the Board shall be invalid by reasons of any vacancy or any
defect in the constitution of the Board. However, it shall be the responsibility of the Chairperson
and the Member-Secretary to identify such defects, at meetings of the Board and act to remedy
these.

(2) The District Level Committee shall perform the following functions, namely:-
(i) to implement all activities mandated by the State Government for the benefit
of the persons with disabilities under the Act;
(ii) to spread awareness regarding the provisions of the Act;
(iii) to effectively implement the Unique Identity for disabled persons in the
shortest possible time;
(iv) to direct the Executive Engineer, Public Works Department or the
Superintending Engineer as the case may be to make an assessment of all
Government buildings in order to make these accessible to disabled persons.
The District Level Committee shall monitor implementation of Accessible
India Campaign in the district regularly and ensure that the work is done in a
time-bound manner. It shall also issue directions to all owners of private
buildings like hotels, restaurants, banquet halls, community halls, corporate
offices, shops and malls, etc. to convert the buildings into disabled-friendly
buildings at the owners expense;
(v) to ensure that every effort is made for accommodating destitute disabled
people of any category in a safe home where their needs are taken care of
and provisions for a healthy lifestyle and skill development are provided.
The committee shall be assisted financially by the State Government in the
accomplishment of these goals;
(vi) to monitor grievances received from disabled persons regarding social
security benefits or on any other issue and try to resolve these by
coordinating with the Social Justice and Empowerment Department;
(vii) to receive complaints from disabled employees of the State Government and
coordinate with departments concerned for their resolution;
(viii) to receive demands of any registered organizations that represent disabled
persons and resolve the same if it is within its competency or forward the
same to the State Government;
(ix) to ensure that there is a clear and harmonized data base of persons with
disabilities receiving benefits under various Government schemes of
different departments;
(x) to make efforts to garner help under Corporate Social Responsibility (CSR)
for pilot projects for the care and benefit of disabled persons. It shall also
represent the case of disabled persons through such pilot projects to the State
Government and ask for financial support from the department;
(xi) any other functions that may be assigned by the State Government.
Salaries, 14. (1) The tenure of State Commissioner shall be for a period of three years. The State
allowances and

Note.— Daily allowance is admissible for ten days in the calendar month;
(iv) Medical facilities:- The State Commissioner may be given medical facilities
as admissible to the Government employees;
(v) Staff Car:- A staff car shall be placed at the disposal of the State
Commissioner for official use at the headquarter and also for outside official
journeys;
Note.— When journeys are undertaken to places outside the State and the staff car
is not used, travelling allowance shall be payable for distance beyond the
State limits. The rate of travelling allowance, when admissible shall be
the same as applicable to Grade-I officers.
(vi) Staff:- Staff may be provided as per requirements assessed and approved by
State Government.
Constitution of 15. (1) The Advisory Committee shall comprise, the following members, namely:-
Advisory
Committee. (i) A person who is a representative of Nodal Non-Governmental Organization
section 79 (7). (NGO) registered with the National Trust in the State of Haryana and has to
his credit quantifiable and qualitative work done for the benefit of persons
with disability;
(ii) A clinical Psychologist/ Rehabilitation Psychologist/ Speech Therapist/
Rehabilitation Professional;
(iii) A doctor from the Post Graduate Institute, Chandigarh or Rohtak or of
Government Medical College and Hospital, Sector-32, Chandigarh dealing
with mental illness;
(iv) A person with disabilities who is an academician not below the rank of
Professor in a recognized university, preferably Punjab University or
Kurukshetra University or Maharshi Dayanand University;
(v) A manufacturer of aids and appliances of disabled persons who fulfils the
international norms outlined from time to time for the manufacture of such
aids and appliances:
Provided that at least one member shall be a woman and one member a senior
citizen.
(2) The term of the members shall be for a period of three years.
(3) The non-official members of the Advisory Committee shall be paid an allowance of
(one thousand rupees per day) for every day on which meetings of the Advisory Committee are
held.
(4) A representative of the Director, Social Justice and Empowerment and of the
Director General Health Services in the meetings of the Advisory Committee shall be invited as
special invitee.
16. (1) The State Commissioner shall submit an annual report as per Form-IV to the State Submission of
annual report.

18. (1) The State Fund for persons with disability shall receive grants-in-aid from the State State Fund.

(3) The Executive committee that manages the State Fund shall be assisted by a Chief
Accounts Officer and two Accounts Officers who shall prepare accounts of all inflow and outflow
of monies from the State Fund and present to the executive committee every month by
circulation.
(4) The executive committee shall meet at least once in every financial year, or as
decided by the Chairperson.
(5) It shall ensure that funds received through Corporate Social Responsibility (CSR)
are accounted for separately and the projects executed by using these funds are monitored closely.
(6) The executive committee of the State Fund shall ensure that the accounts of the
State Fund are audited by the Accountant General, Haryana annually.
(7) The executive committee shall do the needful to ensure that voluntary contributions
or Corporate Social Responsibility (CSR) to the State Fund is exempted under section 80 (G) of
the Income Tax Act, 1961 (Central Act 43 of 1961).
(8) The annual audit report of the accounts of the State Fund shall be placed before the
Council of Ministers and the copies of this report shall be made available to the State
Commissioner.
(9) The State Fund shall be utilized for the following purposes, namely:-
(i) financial assistance in the areas which are not specifically covered under any
scheme and programme of the State/Central Government;
(ii) providing financial assistance for persons with disabilities and implementing
schemes to further the purposes of the Act;
(iii) administrative and other expenses, as may be required to be incurred by or
under the Act;
(iv) such other purposes as may be decided by the executive body.
(10) Every proposal of expenditure shall be placed before the executive body for its
approval.
(11) The State Fund shall be invested in such manner as may be decided by the
executive body.
(12) The Chief Accounts Officer of the State Fund shall prepare the accounts of revenue
and expenditure under the State Fund for each financial year, not later than September, 30th of
the next financial year and shall place the same for the approval of the executive body. The
Accounts shall be audited by the Comptroller and Auditor General of Haryana.
(13) The Accounts of the State Fund for Persons with Disability shall be prepared as per
Form-V.
