Subject: Legal notice in regards to failed delivery and compensation

Dear Ma’am,

In accordance to the instructions from and on behalf of my client Ms. Purvi Soni D/O Mr.
Jyanendra Soni, resident of S2/ C4 Ravindrapuri Colony Varanasi U.P. -221002 , I do hereby
serve you with the following Legal Notice:-

1. That my client Ms. Purvi Soni visited your boutique on 11/08/2021 intended to buy a perfect
dress for her wedding which was scheduled on 22/09/2021.
2. My client chose a red Organza fabric of worth Rs.2600/- per metre for her dress and asked
you to stitch it as specified by her.
3. In pursuant to the instructions given by her you told her the final product will cost
Rs.22800/-, including tailor-making expenses to which she agreed. You promised to give her
the final dress on 02/09/2021 at 6:00 p.m. She paid you Rs 20,000/- in advance.
4. Relying upon your promise my client went to your boutique on 02/09/2021 at 6:30 p.m. she
asked for her dress and you expressed your inability to create her dress in time and asked her
to collect the dress after 6 days. My client again visited you on 09/09/2021 to collect her
dress. Due to unknown reasons you again delayed the due date.
5. On 15/09/2021 my client’s brother collected the dress from your boutique. He paid rest of the
Rs. 2800/-. When my client tried the dress at home she found it was very loose and was not
as per her satisfaction. She sent her brother back to your boutique and told you about the
corrections needed in the dress on a phone call to which you affirmed and promised to do the
same in three days.
6. On 18/09/2021 it was Sunday your boutique was closed so my client’s brother went to your
boutique on 19/09/2021. Your worker told you are in Lucknow and will return on
21/09/2021, he also told he was new and unaware about any Red Organza fabric wedding
dress delivery. Thus my client couldn’t get the dress.
7. My client’s wedding was scheduled on 22/09/2021. She had no option other than buying
another dress in emergency, which otherwise was not needed if you would have delivered the
final dress. The new dress was worth Rs 36,000/-.
8. The events which took place from 11/08/2021 to 21/09/2020 caused a lot of monetary
damage to my client. The sole reason behind the events was your inability to create my
client’s dress. Consequently my client demands compensation from you, which includes-
a) Rs22,800/- for Red Organza Fabric Dress
b) Rs 36,000/- for the dress bought in emergency.
c) Rs 2000/- for travelling and inconvenience caused.
d) Rs 12,200/- for fees payment of the advocate.

I, therefore, call upon you through this notice, to make the payment of Rs73, 000/- to my client,
within the period of 15 days, failing which my client has given clear instructions to me to file a
case against you in District Consumers Court, Varanasi for recovery in the competent court and
in that event you will be fully responsible for all costs, risks, responsibilities, expenses and
consequences thereof. Please note well.

A copy of this Notice is kept in my office for record and further necessary actions and you are
also advised to keep the copy safe, as you might also need it in court.
