DEMAND NOTICE UNDER SECTION 138 N.I ACT
Dear Sir,

Under the instruction of my client AnilKumar Gupta,S/O- Gunadhar a permanent resident of

Gatarpara,Kharagpur Municiality Ward no -9,P.O-Kharagpur,P.S-Kharagpur(T),Dist.-Paschim Medinipur. I do
hereby serve you this notice.

I. That you being known and familiar and having cordial relation with my said client, took a friendly
loan of Rs 2,00,000/- (Two lakhs) Only on 05-04-2022 stating your medical urgency, for which my
said client arranged the said amount of money i.e 2,00,000/-from his relatives,well – wisher and out
of his personal savings to tide you over and after taking the said amount , you thereby promised him
to pay it back with in one month in cash.

II. That subsequently you failed to keep your promise and then upon several reminders of my client, you
handed him over a cheque bearing number 33212002 of Rupees 100000/- of your Banker , Union
Bank of India Priyadarshini Nagar, Raipur Branch on 30/06/2022 for the reasons of payment your
such debt.

III. That as per your instructions my aforesaid client on several dates ( 07-07-2022 ,18/07/2012 and
04/08/2022) deposited the said cheque in his account of Union Bank of india Kharagpur Branch for
its encashment but the Bank Authority returned the said cheque to him on 08-04-2022,
19/07/2022 and 04/08/2022 showing a reason "FUNDS INSUFFICIENT" in your account.

IV. That after dishonour of your said cheque, although my client on several times kept contacting with
you in order to know the reason for non encashment of the said cheque but you paid no heed to it so
having no other alternative left for him he has now been compelled to serve you this Demand Notice.

V. That despite knowing it very well about your bank fund capacity you issued the cheque in question to
my client, so you had the intension to cheat my said client and harass him. It’s your liability to pay
him back the said loan amount to my said client and you by your aforesaid acts held guilty as per
provision of Section 138 N.I Act

Under the above facts and circumstances on behalf of my client I request you to pay Rs 100000/-
( One lakhs ) only to my client within 15 days from the date of receipt of this notice otherwise my
client will be compelled to file a case against you under the provision of Section 138 of Negotiable
Instrument Act.

Note – Copy of this letter be kept at my office for future reference.
