USUFRUCT AGREEMENT

I, JAIME ELIP of legal age and with postal address of Barangay May-Anao, Tigaon,
Camarines Sur. Do hereby certify that I am the heir of the late Lorna P. Elip, the owner of
Lot No. 1-106 portion as per Tax Declaration No. 2016-014-0516 situated at Brgy. May-
Anao, Tigaon, Camarines Sur.

I hereby authorized the DSWD KALAHI CIDSS PMNP to CONSTRUCTION OF


SANITARY TOILET WITH HANDWASHING FACILITY.

I also allow the DSWD KALAHI CIDSS PMNP to utilize the property as long as it in
needed (Perpetual Use of the Property/Usufruct Agreement).

I also allow/permit to use the said lot for 25 years from the current year 2023.

DEED OF GRANT OF USUFRACTUARY RIGHTS

KNOWN ALL MEN BY THESE PRESENTS:


This DEED OF GRANT OF USUFRACTUARY RIGHTS made and entered into by and
between:

JAIME ELIP, of legal age, married and resident of Barangay May-Anao, Tigaon,
Camarines Sur, Philippines hereinafter referred to as the “OWNER”,
-and-
The BARANGAY LOCAL GOVERNMENT OF BARANGAY MAY-ANAO, Tigaon,
Camarines Sur represented by the Barangay Chairperson, HON. MARCELO N.
VILLAFUERTE JR., herein referred to as the “USUFRUCTUARY”,

WITNESSETH
WHEREAS, the OWNER is the absolute owner/administrator of a parcel of lot held in
its propriety capacity situated in Barangay May-Anao, Tigaon, Camarines Sur, more
particularly described as follows; PROPERTY IDENTIFICATION NO. 026-34-0014-008-27
with LOT NUMBER 1-106 with TD No. 2016-014-0516,

“A parcel of land owned by the OWNER in Barangay May-Anao, Tigaon Camarines


Sur with an area of 0.7996 hectares declared under the name of ELIP, LORNA P., with the
following technical description:
BOUNDERIES
North: Lot 144 South: SW: Lot 145
East: Creek & Lot 104 SE: Lot 100 West: Lot 145

WHEREAS, the OWNER desire to the USUFRUCTUARY the right of Usufruct over
the portion of land with the latter having the full, right the use and enjoyment of the fruits of
property in return for assuming the obligation to preserve the property during the term of the
usufruct;
NOW THEREFORE, for and in consideration of the mutual agreements, covenants
and stipulations herein set forth, the OWNER hereby transfers and coveys unto the
USUFRUCTUARY by the way of USUFRUCT the portion of the above described parcel of
land measuring 16 square meters, subject the following terms and conditions;
1. This grant of usufruct shall be valid and binding for TWENTY-FIVE (25) years
renewable to another TWENTY-FIVE (25) years thereafter upon prior
authorization from the OWNER;
2. The USUFRUCTUARY shall pay and be liable for all taxes and other charges as
the Government or any of its instrumentalities and agencies may impose by
reason arising out of this agreement and its implementation, including the real
property taxes;
3. The SUFRUCTUARY may build and construct CONSTRUCTION OF SANITARY
TOILET WITH HANDWASHING FACILITY on the property subject to this grant
for the use and occupancy of the COMMUNITY NUTRITION SUB PROJECT
MANAGEMENT COMMITTEE of BARANGAY MAY-ANAO, TIGAON,
CAMARINES SUR and its CONSTITUENTS. And after the expiration of 25 years
Usufruct Agreement, the ownership of the CONSTRUCTION OF SANITARY
TOILET WITH HANDWASHING FACILITY shall be transferred to the OWNER.
The USUFRUCTUARY hereby agrees and binds itself to ensure all its own
expenses, the CONSTRUCTION OF SANITARY TOILET WITH
HANDWASHING FACILITY build or placed therein against loss by fire, typhoon,
flood, force majeure or other similar events. In no case shall the OWNER be
liable for any loss, damage, or injury that may arise, by reason of the use and
enjoyment of the fruits of said property by the USUFRUCTUARY;
4. The USUFRUCTUARY, at its own expense, make all necessary repairs to keep
the premises and its equipment and facilities from deterioration in value or
condition during the term of the grant;
5. The USUFRUCTUARY shall not lease any part or portion of the premises of the
whole thereof, without the express consent of the OWNER;
6. The OWNER hereby covenants that the USUFRUCTUARY shall peaceably hold
and enjoy the full use and possession of the premises at any time;
7. The OWNER may immediately recover possession of the afore described real
property, including all permanent structure and improvements introduced,
thereon, without obligation to reimburse the herein USUFRUCTUARY, terminate
the usufruct should the USUFRUCTUARY violate any of the provision of the
DEED of fail to comply with its obligation in the Usufruct as prescribed in the New
Civil Code of the Philippines, the applicable provisions of which are incorporated
herein and deemed part of the provisions of this deed.
